A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE CONSENTING TO THE
COUNTY OF ORANGE DECLARING THOSE
PORTIONS OF LINCOLN AVENUE, LOCATED IN
THE CITY LIMITS, FROM APPROXIMATELY
PIER NO. 3 ON THE SOUTH SIDE OF THE
LINCOLN AVENUE BRIDGE OVER THE SANTA
ANA RIVER EAST TO BATAVIA STREET, TO BE A
COUNTY HIGHWAY FOR THE PURPOSES OF
DESIGN, RIGHT- OF-WAY ACQUISITION, AND
CONSTRUCTION BY THE COUNTY OF ORANGE.
WHEREAS, THE City of Orange ( "City ") consents to the County of Orange
County ") declaring those portions of Lincoln Avenue which are located within the City
limits, from approximately pier #3 on the south side of the Lincoln Avenue bridge over the
Santa Ana river east to Batavia Street, as County highway; and
WHEREAS, the County and the City propose to construct roadway improvements
along Lincoln Avenue to Batavia Street, including the bridge over the Santa Ana River,
collectively referred to as "City Streets "; and
WHEREAS, the County and the City have entered into Agreement No. D12-026 to
define the responsibilities of the County and the City with respect to construction of the City
Streets; and
WHEREAS, California Streets & Highways Code Sections 1700 -1704 set forth the
procedures by which the County may perform improvements on City Streets.
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the City's
hereby consents to the County declaring the aforementioned City Streets to be County
highway for the purposes of design, right -of -way acquisition, and construction by the County
of Orange.
