RES-10724 South Coast Air Quality Management District RuleRESOLUTION NO. 10724 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE URGING THE BOARD OF THE SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT (SCAQMD) TO HONOR THE RULE OF LOCAL CONTROL AND ALLOW EACH AGENCY THE ABILITY TO REGULATE PLACEMENT AND CONTROL OF FIRE RINGS WITHIN ITS JURISDICTION. WHEREAS, the SCAQMD has proposed an amendment to Rule 444 which, if approved, will add beaches to the list of prohibited areas for open fire burning on a state- wide prohibition; and WHEREAS, it is well known that visitors, tourists, and residents are drawn to the California coast for personal and family recreation, surfing and water sports, iconic piers, and unforgettable sunsets; and WHEREAS, the City of Orange recognizes the importance for each beach community to maintain their own local control in regulating their City with local ordinances; and WHEREAS, beach bonfires are a safe and inexpensive recreational activity and are enjoyed by all the members of our community, regardless of socioeconomic class; and WHEREAS, beach communities within the jurisdiction of the SCAQMD have different needs and they should each be given the opportunity to individually make their own decisions prior to a complete blanketed ban on open burning in fire rings; and WHEREAS, beach attractions, such as bonfires, result in optimum economic and community activity, from gatherings of family and friends, beach barbecues, community events, and beach sports, and much more; and WHEREAS, Orange County boasts numerous fire rings available on the city and state beaches for nightly bonfires, a favorite activity among locals, visitors, and international tourists; and WHEREAS, the City of Orange supports each beach city's interests and encourages the SCAQMD to allow each jurisdiction to decide what is best for its own communities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange strongly supports the Rule of Local Control and allowing each City the ability to regulate within its jurisdiction as appropriate for each community. FURTHERMORE, the City Council of the City of Orange strongly opposes the South Coast Air Quality Management District's (SCAQMD) proposed amended Rule 444, prohibiting open burning on beaches on a mandatory State -wide basis.
