Commissioner Pruett read and presented Resolution No. PC 5-01, and offered best wishes to Mr. Bosch. ORDINANCE AMENDMENT 3-00 - CITY OF ORANGE SPECIAL EVENTS A proposal to amend the City Zoning Ordinance related to special events in order to clarify the definition of a special event, and establish criteria and findings related to event duration, land use compatibility, 1 Planning Commission Minutes February 5, 2001 vehicular traffic, public heanh, safety and welfare, and maintenance and promotion of the City's business environment. (This item was continued from the October 16, and December 4, 2000 meetings.) NOTE: This project is categorically exempt from the provisions of the California Environmental Quality Act. Mr. Godlewski said the Planning Commission reviewed this ordinance amendment for special events on two different occasions, and staff has revised the document per the Commission's request. The hearing was opened for public comments, but there were none. Therefore, the public hearing was closed. MOTION Moved by Commissioner Romero and seconded by Commissioner Carlton to recommend to the City Council to approve Ordinance Amendment 3-00. AYES: NOES: Commissioners Carlton, Pruett, Romero, Smith None MOTION CARRIED IN RE: NEW HEARINGS 3. CONDITIONAL USE PERMIT 2274-99 AND MAJOR SITE PLAN REVIEW 86-99 - SAV-ON A request that the Planning Commission make a finding of public convenience or necessity to allow the sale of beer, wine, and distilled liquors for the purpose of off-site consumption at its new retail store. The new store will be built on a vacant lot at the southwest corner of Chapman Avenue and Esplanade Street. The site is located at 4040 East Chapman Avenue. NOTE: This project is categorically exempt from the provisions of the California Environmental Quality Act. There was no opposition to this item: therefore, the full reading of the staff report was waived and the public hearing was opened. Paulette Dewire. liQuor LicensinQ/ComDliance ManaQer with Albertson's, Inc., said this is the same type of land use and the same type of license that was approved for Rite Aid. And, Rite Aid did have a finding of public convenience approved by the City Council. The Department of Alcoholic Beverage Control does not allow the transfer of a finding of public convenience or necessity. They have reviewed the Commission's approvals and Albertson's will comply with all conditions agreed to by Rite Aid. The public hearing was closed. MOTION Moved by Commissioner Romero and seconded by Commissioner Pruett to approve Conditional Use Permit 2274-99 and Major Site Plan Review 86-99 for Sav-On, finding that it is a public convenience or necessity for the sale of alcoholic beverages.
