MINOR SITE PLAN REVIEW 152-00 AND NEGATIVE DECLARATION 1646-00 - ROBERT & THERESA BEARD A request to construct a second unit and the conversion/partial demolition of an existing detached accessory structure into a garagelworkshop. The site is located at 525 South Orange Street. This item was continued from the December 4,2000 and the January 15, 2001 Planning Commission meetings. NOTE: This project is categorically exempt from the provisions of the California Environmental Quality Act. The applicant requested that the proposed project be continued indefinitely to allow him additional time to revise his plans. MOTION Moved by Commissioner Romero and seconded by Commissioner Pruett to continue Minor Site Plan Review 152-00 and Negative Declaration 1646-00 indefinitely. CONDITIONAL USE PERMIT 2364-01 - TOYOTA OF ORANGE A request to allow the construction of a five-bay car wash/auto detailing structure and two buildings for storage of equipment and supplies at an existing auto dealership. The site is located at 1400 North Tustin Avenue. Planning Commission Minutes March 5, 2001 NOTE: This project is categorically exempt from the provisions of the California Environmental Quality Act. Chris Carnes, Senior Planner, presented a request by Toyota of Orange for a conditional use permit to allow the construction of five car wash service bays to be used for car washes and auto detailing, and the construction of two small storage buildings south of their present building. The dealership was doubled in size in 1966 and included the incorporation of the Trenton Street right of way as part of the dealership. At that time, the dealership building was expanded. Recently, the Staff Review Committee approved minor additions onto the front of the building for an enlarged showroom and for the remodeling of the main building. In addition to that, the applicant wanted to include the car wash/auto detailing bays and the storage buildings; however, the SRC felt that should be included with the conditional use permit application under a separate submittal. The DRC has reviewed the proposed buildings and has recommended Planning Commission approval. There are 13 conditions of approval thai apply to the new car wash and storage buildings. In response to a question by Commission Romero regarding the number of bays, Mr. Carnes explained that the site plan shows six bays, but the porter bay is for the storage of supplies. It will not be used for car wash or auto detail. There are only five car wash/auto detail bays. Chair Smith questioned the specifics of the structure designed for the actual car wash area. There are no specified design elements in the staff report other than it being described as a structure that will be covered with a gray awning with white supports. She would like clarification on the design of the bays. A landscape plan was not provided in the Commission's packets. Mr. Carnes said the bays will be divided by a block wall and the awnings will be held up by a metal piping framework. The applicant is required to get a building permit for the structure. Because Toyota of Orange is an existing dealership, new landscaping will be required along a 5 foot strip along the southern property line. The DRC will be reviewing the final landscape plans to assure that the City's minimum standards will be met. The public hearing was opened. Bill Mason, of WMA Architecture in Costa Mesa, represented Toyota of Orange. Phase 2 of their project is presented for review and approval by the Planning Commission, which consists of a car wash/detailing building. There are five bays. Two bays will be used for detailing and three bays will be used for washing. The sixth bay is used for storage goods and materials. On the south side of the property there is a storage building, adjacent to a trash enclosure. There are also two other contiguous buildings consisting of a parts and oil room. Their intent is to take the existing oil room that is on the south side of the building that is enclosed with a masonry wall and a screened chain link fence, and basically enclose it so that all of the uses that are exposed to the outside will be enclosed in the oil room. Within that room they have four tanks. One tank will store new oil and another tank will house the waste oil. It will be held until an outside source comes in and takes it off site. Within that room there is also a tank for the auto transmission fluid waste and then the waste coolant. It is essentially a storage room for oil and a storage room for waste. There is also a compressor in that room and a dryer. They plan on making improvements to the existing facilities that are there. Currently the car wash takes place outside on the lot. The oil is already there and the storage building is proposed to be behind the chain link fence that is currently existing. He explained how the car wash building will be constructed. The material that will be used is light to medium gray fabric that is like a woven plastic type of mesh canvas. They will present back to the DRC landscape plans for the southerly area of the property, which includes ground cover, shrubs and some sort of trees. There is striping currently on the lot, but they will be re-striping that area to include the required number of vehicles to meet code requirements. The applicant read the conditions of approval in the staff report and questioned condition 6 about the wording for storage vs. oil room. They would like the condition to state, "Additional storage and car wash/detailing uses, and to delete the word oil." It is their intent to use one of the storage rooms as an oil room. The oil room is subject to review by the EPA. 2 Planning Commission Minutes March 5, 2001 The Commission had a few concerns about the noise factor on the site. However, there have been no complaints. And, the building is proposed to be enclosed, which will help to alleviate noise from carrying over to the residences. Ron Sullivan. 27710 Jefferson Avenue. Temecula, spoke on behalf of the owner of the property, the FISher Family Partnership. Toyota of Orange actually leases the property. The Fisher Family Trust owns the mobile home park that is adjacent to the dealership. He voiced two concerns expressed by the owners: They are required to dedicate an easement for the signalization of the driveway. The Trust that owns the mobile home park owns that access. They wonder what that easement is. Toyota of Orange cannot sign that. The other concern is that they are still trying to obtain the agreement for the access that goes out onto Trenton. They were looking to reserving some space where the storage building is for the auto parts as an alternate access that is adjacent to a public alley. The owners have not had enough time to sit down with Toyota of Orange to find out what is going on. Mr. Hohnbaum responded to Mr. Sullivan's concern about the easement for the signalization of the driveway. Condition 8 is to be able to put certain types of traffic control equipment into that signalized access driveway; specifically, traffic signal loops. The City's concern is with the easement which the City can legally control to prohibit parking of vehicles over the traffic loops. Mr. Sheatz was not sure the existing easement shows up on the plans. He believed there would have to be a private party civil action for the easement. The tenant on the property can only grant what they have an interest in. He didn't know what type of agreement exists between the partnership and the dealership. Commissioner Pruett clarified that if the Commission takes action to approve the conditional use permit with the conditions of approval listed in the staff report, that does not mean that the property owner has to execute the appropriate document. It's still an issue between the applicant and the property owner. Mr. Mason has not had any discussions with Toyota of Orange, nor did he know of the agreement between the two parties. He suggested the two parties get together and voice their concerns. He could not at this point speak for Toyota of Orange as to whether or not they would be willing to relocate their buildings or eliminate them in order to accommodate a potential future easement onto the property. He also amended his statement made earlier as to agreeing to the conditions. There are some mitigating measures that he cannot address. The public hearing was closed. Mr. Sheatz said that the Planning Commission could move forward at this time with the understanding that if the applicant is unable to satisfy all of the conditions for the dedication, that the item would not be approved. This will create some confusion because a condition could not be satisfied. The more prudent way to handle this would be to ask the applicant if he were willing to continue the hearing in order to allow them sufficient time to sit down with Mr. Sullivan to work out the conditions of approval. The Commission would like clarification on this issue before making a decision about the easement. Mr. Mason agreed to a continuance to clarify the easement issue. Conditions 6 and 8 need to be addressed. Ms. Sully would like to see an ownership map plotted on the site, indicating where the easements are located. Mr. Carnes would like to have a notarized letter from the property owner agreeing to the dedication of the easement. Staff will talk to the Fire and Building Departments to find out what the EPA requires for ihe oil storage. And, also get the final landscape plan back to the Commission. 3 Planning Commission Minutes March 5, 2001 MOTION Moved by Commissioner Romero and seconded by Commissioner Carlton to continue Conditional Use Permit 2364-01 to the meeting of April 16, 2001. The Commission agreed to meet on Monday, March 12, 2001 at 5:30 p.m. to review the General Plan and Zoning for the 300/400 blocks of South Grand Street.
