CONDITIONAL USE PERMIT 2364-01 - TOYOTA OF ORANGE ITEM TO BE CONTINUED A request to allow the construction of a five-bay car wash/auto detailing structure and two buildings for storage of equipment and supplies at an existing auto dealership. The site is located at 1400 North Tustin Avenue. This item was continued from the March 5 and April 16, 2001 meetings. NOTE' This project is categorically exempt from the provisions of the California Environmental Quality Act. Ms. Sully requested that this item be continued to the meeting of June 4, 2001, to allow the applicant additional time to work out terms of ownership, easements and landscaping. MOTION Moved by Commissioner Carlton and seconded by Commissioner Pruett to continue Conditional Use Permit 2364-01 to the meeting of June 4, 2001. GENERAL PLAN CONFORMITY FINDING - SEVEN YEAR CAPITAL IMPROVEMENT PROGRAM (CIP) - FY 2001-02 THRU FY 2007-08 Recommended Action: Find that the projects identified within the proposed Seven Year Capital Improvement Program are consistent with the City's General Plan policy. AYES: NOES: ABSENT: Commissioners Carlton, Pruett, Smith None Commissioner Romero MOTION CARRIED 1 Planning Commission Minutes May 7, 2001 INRE: NEW HEARINGS 4. CONDITIONAL USE PERMIT 2367-01 AND NEGATIVE DECLARATION 1669-01 - MATRIX SERVICE A request to allow office space in the Industrial Zone (M-2) exceeding 25 percent of the gross floor area (GFA) for a proposed industrial manufacturing facility. The proposed project includes a 19,870 square foot two-story office building and a 32,400 square foot single-story manufacturing building. The site is located at 500 West Collins Avenue. NOTE' Negative Declaration 1669-01 was prepared to evaluate the environmental impacts of this project. Ms. Sully pointed out two changes in the conditions of approval. The first being to add wording to condition 9: "The applicant shall install a street light for illumination purposes and public safety on Collins Avenue, adjacent to the railroad crossing. The precise location of the light shall be determined by the City of Orange Public Works Department. A street light plan shall be submitted and approved by the Public Works Department prior to issuance of building permits. The street light shall be Installed prior to finaling of building permits." The second change is in condition 11: Point 1 should be deleted. And, add a phrase to Point 3: "The Staff Review Committee determines that the proposed expansion Is in conformance with CUP 2367-01. When the proposed expansion requires a review by a higher body, that body shall determine conformance with CUP 2367-01. Determination of conformance shall consider cumulative impacts on public services and consistency with the City's General Plan." This modification is intended to provide flexibility and project specific consideration for future proposals at the site. Jay Eastman, Assistant Planner, explained that additional wording was added to condition 9 to clarify that it is a street light; not a traffic signal. This is a safety issue for pedestrians and vehicles entering and exiting the site. The publiC hearing was opened. Ralah Hastinas Hastinas Partners Inc - Architects & Planners, has read the conditions of approval and asked for clarification on the proposed changes. He wanted to know their /imitation as far as the FAR is concerned. Mr. Eastman said the purpose for the change in condition 11 is to allow for more project specific considerations should the applicant come forward at a later date relative to any industrial additions. The FAR still stays the same; ifs still .4 in terms of the General Plan's maximum FAR. However, any office space that is added, staff could determine that the specific proposal at that time may have some negative impact in terms of the City's ability to provide public services. Staff wanted to provide more flexibility in the future to address the General Plan's FAR and intensity issues. Ms. Sully clarified the applicant would be bound to the General Plan and zoning that is in effect at the time their proposed development was submitted to the City for consideration. William Sullivan Matrix Service, agrees with the changes to the conditions of approval. They are looking forward to moving to Orange and asked for approval of their project. The public hearing was closed. 2 Planning Commission Minutes May 7, 2001 MOTION Moved by Commissioner Pruett and seconded by Commissioner Carlton to approve Negative Declaration 1669-01 finding that the project will not have a significant adverse impact on the environment or wildlife resources. AYES: NOES: ABSENT: Commissioners Carlton, Pruett, Smith None Commissioner Romero MOTION CARRIED MOTION Moved by Commissioner Pruett and seconded by Commissioner Carlton to approve Conditional Use Permit 2367-01 with conditions 1 through 16, modifying conditions 9 and 11, as previously stated by staff. The conditional use permit is granted upon sound principles of land use and in response to services required by the community. It will not cause deterioration of bordering land uses or create special problems for the area in which the site is located. It has been considered in its relationship to its effect on the community and neighborhood plans for the area. It is being made subject to those conditions necessary to preserve the general welfare, not the individual welfare of the applicant. AYES: NOES: ABSENT: Commissioners Carlton, Pruett, Smith None Commissioner Romero MOTION CARRIED 5. CONDITIONAL USE PERMIT 2371 - LA PLATA ENTERPRISES, INC. (REFERENCE PREVIOUSLY APPROVED CONDITIONAL USE PERMIT 2282-99) A request for a one (1) year time extension (reference Conditional Use Permit 2282-99) of a conditional use permit allowing the construction of a 20-unit senior citizen apartment building on property in a commercial district located at 170 North Prospect Street. NOTE' This project is categorically exempt from the provisions of the California Environmental Quality Act. Ms. Sully explained the reason for the continuance is based on the fact that the applicant is still in the building plan check process, and is working out some final details prior to pulling building permits. It is anticipated that the applicant will be under construction within the next couple of months. The public hearing was opened. Wavne Arnold 5841 East Crater Lake, said they have been working out some engineering issues with the plan checker, which will be resolved shortly. They have hired a new architect and engineer and are requesting a one-year extension to proceed with their original plan. Commissioner Carlton questioned if the plans or drawings were going to be changed. Mr. Arnold replied that due to some changes in the code, the garage ceiling needs to be changed to concrete. Commissioner Pruett asked staff if it were more appropriate to approve a revision to the original conditional use permit with the extension of time, and not approve a new conditional use permit. 3 Planning Commission Minutes May 7, 2001 Ms. Sully said the reason staff assigned a new conditional use permit to this project is because they have just acquired a new tracking system in the Planning Department, and it does not allow them to make amendments to past permits at this point in time. It does, however, allow for historical data to be entered and to link certain projects. As new permits are entered into the system, it will allow staff to make the necessary changes. The public hearing was closed. MOTION Moved by Commissioner Pruett and seconded by Commissioner Carlton to approve Conditional Use Permit 2371 to allow the one-year extension of time for the project originally approved by Conditional Use Permit 2282-99.
