KITCHEN. A REQUEST FOR A CONDITIONAL USE PERMIT.
Ms. Leslie Roseberry read the Staff Report to the Commission. She mentioned the Police
Department had reviewed and supported this item and as such; there was no
representative from the p.o. at this time.

Chair Bonina opened up the Public Hearing.
Mr. Edward Patrick. 141 South Glassell. Orange. He stated this was a full service
restaurant with a small menu with a full bar.
Chair Bonina asked if this restaurant was new to the area.
The applicant replied yes, although they were located in Costa Mesa. He said they had
been a catering company, and Gabbi had grown up in the restaurant business.
Commissioner Pruett asked the applicant ifhe had read the Conditions and ifhe had any
problem with them.
The applicant replied no.
Chair Bonina closed the Public Hearing.
Commissioner Pruett stated this project was categorically exempt from CEQA, and he
moved to adopt Resolution No. PC 08-06 approving Conditional Use Permit No. 2568-
05.

(3) DESIGN REVIEW COMMITTEE NO. 4036-05 - BRADBURY RESIDENCE.
A PROPOSAL TO DEMOLISH A DETACHED TWO-CAR GARAGE, AND
CONSTRUCT A ONE-STORY ACCESSORY SECOND UNIT.
Chair Bonina stated although this was not a Public Hearing, he would solicit Public
Comment from anyone in the audience.
Ms. Leslie Roseberry provided a full reading of the Staff Report to the Planning
Commission. She mentioned this Item went before the Design Review Committee and
they recommended approval of the project to the Planning Commission. Additionally,
the Commission had received a letter of OTP A stating although they would not be

present tonight, they were submitting a letter of support, and were in support of the
project at the DRC Meeting.
Commissioner Imboden asked Staff for clarification of Item 17.14.170, Page 750 of the
Zoning Code.
Ms. Roseberry explained that if you were to look in the definitions of accessory
structures and accessory second units, and put them all together, it would point you to
consider the accessory second unit as a principal structure as opposed to an accessory
structure. Therefore, she stated, when you look at the square footage of the existing
residence plus the proposed accessory second unit and 50 per cent of that should work
out for the construction of the three-car garage.
Commissioner Imboden then asked if they were looking at two principal structures and
was this appropriate under R I zoning.
Ms. Roseberry replied yes.
Chair Bonina asked Staff if there was an issue on the existing residence and the proposed
granny unit at the point of the garage, i.e., was there a possible problem in terms of fire
since he thought there was a long drive on the property, and wondered if the cars could
turn around.
Ms. Roseberry stated that Fire had reviewed this and had no issue with it. She said when
they looked at the ability of cars being able to back up or turn around, there was a 25-foot
clearance between the proposed accessory unit and the garage, and this is what they
require for 90 degree parking.
Mr. Dale Bradburv. applicant. 151 South Waverlv St.. Orange. He stated that Staff had
presented the proj ect in full.
Chair Bonina asked the applicant if the garage would have any attic space.
Mr. Bradbury replied no, that he was going to build it with open space.
Chair Bonina asked the applicant if had anything else to tell about the project.
Mr. Bradbury stated this had been an exhausting process to get this far. He explained that
it had taken three months to get on the Agenda because the Planning Department did not
have enough staff, and the Design Review Committee had gone without a hitch.
Ms. Roseberry commented that the plans were quite different when the applicant first
submitted his proposal, and Staff had worked with him to get it to a point where the DRC
Meeting would go smoothly.

Chair Bonina asked Staff if the granny flat was a one-story unit, and she stated yes.
Mr. Bradbury explained that he wanted to insinuate a room without making the room
enclosed. He thought he could have a bookcase go across the room to make two separate
spaces yet keeping it as open as possible. He also wanted to make it a big space that
opened up to a big courtyard. He wanted to position the structure to be between their
house and their neighbor's garage. This is why they had double doors that are opening
up into the courtyard as well as the main house would open into the courtyard. He
explained the houses in his neighborhood were built with the garages right on the
property line so there was no block wall built. As a result, he can see the side of his
neighbor's garage, as does his neighbor. He continued where he will demo the garage,
there is a note for a new concrete block wall to match the existing.
Chair Bonina asked ifthere were any landscaping requirements.
Ms. Roseberry replied that not usually for a single family resident unless they are
proposing something, and then Staff will review it or ifthere is a tree to be replaced, then
Staff will have the applicant coordinate with the City.
Mr. Bradbury stated there was an Open Space Requirement between the structures, which
he did meet.
Commissioner Imboden asked what the Open Space Requirements were for the two
primary structures.
Ms. Roseberry stated the amount of open space would be per unit.
Commissioner Imboden asked if this was being met with the proposed plan because he
did not see the Open Space Requirements.
Ms. Roseberry stated this had been looked at, and 900 square feet per unit was required.
She added this did not include what was between the accessory second unit and the
garage doors.
Commissioner Imboden stated that the driveway could not be counted as Open Space
Requirement.
Chair Bonina wanted to verify that the Open Space Requirement was met, given that both
structures are primary units.
Mr. Bradbury commented that the 900 square feet did not include the driveway, and was
based between the house and the structure, which was about 1,000 square feet.

Chair Bonina asked if the total square footage for the open space was 450 square feet per
unit or 900 square feet per unit.
Ms. Roseberry replied that it was 900 for the Zone presuming there was one on the lot,
but she was looking in the documentation for the requirements of the second unit.
Mr. Bradbury explained 900 square feet was required for the lot so no matter what is on
the lot, 900 square feet would have to be kept open.
Ms. Roseberry confirmed this and stated this was her understanding of the Code also.
She mentioned it did not indicate it was a per unit requirement, it simply indicated 900
and referred back to what would include open space and what would not. Also, in the
area that talks about the accessory second unit, it did not address Open Space
Requirements.
Chair Bonina stated as it stands, it meets the requirement.
Commissioner Enderby made a motion to approve Design Review Committee No. 4036-
05 for demolition of an existing garage, construction of a new detached garage and the
construction of an accessory second unit for the residence located at 151 S. Waverly
Street within the Old Towne Orange Historic District.
Commissioner Pruett seconded the motion.
