Chair Steiner called the meeting to order at 7:00 p.m.

Commissioner Buttress made a motion to approve the meeting minutes from the August
6, 2012 Planning Commission meeting with the corrections noted.

(2) CONDITIONAL USE PERMIT NO. 2859 -12- FORSDICK RESIDENCE
The applicant proposes to add a 22 SF bathroom with plumbing facilities (toilet, sink and
shower) within an existing detached 286 square foot accessory structure used as a
recreation/pool room. This item was continued from the August 6, 2012 meeting because
the applicant requested to add the bar sink to the plans.
LOCATION: 2294 North Batavia
NOTE: The proposed project is categorically exempt from the provisions
of the California Environmental Quality Act (CEQA) per State
CEQA Guidelines 15301 (Class 1- Existing Facilities) because the
project is to construct a 22 square foot bathroom with a toilet, sink
and shower within an existing 286 square foot accessory structure.
RECOMMENDED ACTION:
Adopt Planning Commission Resolution 30 -12 approving the
construction of a toilet, sink and shower within a 286 square foot
detached accessory structure upon property zoned R -1 -8.
Associate Planner Doris Nguyen presented a project overview consistent with the Staff
Report.
Chair Steiner asked if there were any questions for Staff or any additional information
submitted. There was none.
Chair Steiner opened the meeting for Public Comment and invited the applicant to
address the Commission.
Diana Forsdick, address on file, stated she wanted to add an additional bathroom to the
pool area for convenience and to also have a bar sink to have an area for clean up when
using the BBQ.
Chair Steiner brought the item back to the Commission for further discussion or action.
Commissioner Buttress made a motion to adopt PC Resolution No. 30 -12 approving CUP
No. 2859 -12- Forsdick Residence, subject to the conditions contained in the Staff Report
and noting the item's categorical exemption from CEQA.

(3) ZONE CHANGE 1265 -12 — UPTOWN ORANGE 2010 GENERAL PLAN
LAND USE FOCUS AREA
The City of Orange General Plan update was adopted in March 2010. In both the 1989
and 2010 General Plans, the portion of the Uptown Orange General Plan Land Use Focus
Area east of The City Drive and Manchester Avenue is designated Public Facilities and
Institutions (PFI). Presently, the properties falling within the PFI General Plan
designation are zoned Single Family Residential (R -1), General Business (C -2) or are
unzoned. State law and the City's General Plan Implementation Plan require consistency
to be established between the General Plan land use designation and zoning
classifications. The zoning classification that corresponds to the PFI General Plan land
use designations is Public Institution (PI). Zone Change No. 1265 -12 establishes General
Plan and Zoning consistency for the affected properties.
NOTE: Final Program Environmental Impact Report (EIR) No. 1815 -09 for the
Comprehensive General Plan Update was certified on March 9, 2010 and
prepared in accordance with the California Environmental Quality Act
(CEQA). The proposed activity is within the scope of the previously
approved General Plan and is adequately described in the previously
certified General Plan Program EIR for purposes of CEQA.
RECOMMENDED ACTION:
Adopt Planning Commission Resolution 32 -12 recommending the City
Council approve Zone Change 1265 -12 and adopt an Ordinance rezoning
properties in the portion of the Uptown Orange 2010 General Plan Land
Use Focus Area east of The City Drive, south and west of Interstate 5 and
north of the intersection of The City Drive and Metropolitan Drive to
Public Institution to establish consistency between the Public Institutions
and Facilities General Plan Land Use Designation and Zoning
classification in accordance with State law.
Principal Planner Anna Pehoushek presented a project overview consistent with the Staff
Report.
Chair Steiner opened the item for any questions for Staff and asked if there was
additional information submitted? There was none.
Chair Steiner opened the item for Public Comment. There was none.
Chair Steiner brought the item back to the Commission for action or a motion.
Commission Buttress made a motion to adopt PC Resolution No. 32 -12, recommending
to the City Council approval of Zone Change No. 1265 -12- Uptown Orange General Plan
Land Use Focus Area, noting that the final program EIR No. 1815 -09 for the General
Plan Update was certified on March 9, 2010 and prepared in accordance with CEQA.

Chair Steiner stated he wanted to ensure that in reading the agenda item that there were
no required findings for an Ordinance Amendment as it was considered a legislative
action. As the Planning Commission was making a recommendation to the City Council
they needed to include their decision through a resolution.
Ms. Pehoushek stated that was correct.

(4) ZONE CHANGE 1266 -12 — REZONE PROPERTIES IN THE
KATELLA CORRIDOR 2010 GENERAL PLAN LAND USE FOCUS
AREA
The City of Orange General Plan update was adopted in March 2010. As part of the 2010
General Plan update, properties located between Glassell Street and Batavia Street in the
Katella Corridor General Plan Land Use Focus Area were designated General
Commercial (GC). Presently, the properties in this area are zoned Commercial
Recreation (CR). State law and the City's General Plan Implementation Plan require
consistency to be established between the General Plan land use designation and zoning
classifications. The zoning classification that corresponds to the GC General Plan land
use designation that is appropriate for this area is General Business (C -2). Zone Change
1266 -12 establishes General Plan and Zoning consistency for the affected properties.

Commissioner Buttress asked if there had been any opposition received for the proposed
zone change.
Ms. Pehoushek stated no.
Chair Steiner asked if there was any further communication received on the item. There
was none.
Commissioner Gladson asked if it was a fair assessment that expanding to a C -2 class of
zoning from a Commercial Recreational zoning would actually afford the properties more
opportunities for use; including a potential for mixed use?

Ms. Pehoushek stated the C -2 zoning would allow for a broader range of commercial
uses than would ordinarily be allowed in the C -R zone. For example uses such as
medical offices and veterinary offices were not allowed in C -R, but were allowed in C -2.
In terms of mixed use, it was not the intent of the C -2 zoning to allow for mixed use.
Currently the zoning ordinance made accommodations for mixed use development
through a Conditional Use Permit; with the City establishing mixed use districts in the
General Plan. With a follow up of adoption of the mixed use zoning standards and
putting in place the mixed use zone in various areas of the City, the ultimate goal was to
concentrate mixed use development in those particular districts and phase out the option
for mixed use development in strictly commercial districts.
Chair Steiner opened the hearing for Public Comment. There was none.
Chair Steiner brought the item back to the Commission for further discussion or action.
Commissioner Gladson stated she would move the item and she wanted to provide
further information in support of the motion. Specifically, it seemed apparent in the
action of updating the City's General Plan in 2010 that the commercial recreational zone
had not panned out for that stretch of Katella Avenue and affording other options in the
commercial zone seemed appropriate and she supported zoning that created compliance
with the General Plan.
Commissioner Gladson made a motion to adopt PC Resolution No. 33 -12, recommending
to the City Council approval of Zone Change No. 1266 -12 - Rezone properties in the
Katella Corridor 2010 General Plan Land Use focus area, noting that the final program
EIR No. 1815 -09 for the General Plan Update was certified on March 9, 2010 and
prepared in accordance with CEQA.
