2014 - August 18Planning Commission August 18, 2014 Minutes Planning Commission August 18, 2014 City of Orange Monday 7:00 p.m. PRESENT: Commissioners Steiner, Buttress, Cathcart, Correa, and Gladson STAFF PRESENT: Leslie Aranda Roseberry, Planning Manager Gary Sheatz, Senior Assistant City Attorney Anna Pehoushek, Principal Planner Chad Ortlieb, Senior Planner Robert Garcia, Senior Planner Angie Cisneros, Recording Secretary REGULAR SESSION 1.1 CALL TO ORDER: Chair Steiner called the meeting to order at 7:01 p.m. 1.2 FLAG SALUTE: Commissioner Correa led the flag salute. 1.3 ROLL CALL: All Planning Commissioners were present. 1.4 PUBLIC PARTICIPATION None 1.5 CONTINUED OR WITHDRAWN ITEMS: None 1.6 PLANNING MANAGER REPORTS Ms Leslie Roseberry introduced to the Planning Commission the recent hiring of Pete Goodrich as the Chief Building Official, Jeffery Borchardt as Assistant Planner and Kelly Christensen as Associate Planner. Planning Commission August 18, 2014 2. CONSENT CALENDAR: 2.1 APPROVAL OF MINUTES FROM THE REGULAR MEETING OF AUGUST 4, 2014. Motion was made to approve the minutes as written. CONTINUED ITEM: 3.1 CONDITIONAL USE PERMIT NO. 2925 -13 — 99 CENTS ONLY STORE This item was continued from the July 21, 2014 Planning Commission meeting. The applicant is requesting an Alcoholic Beverage Control License Type 20 (Off -Sale Beer and Wine) and a Finding of Public Convenience or Necessity for an existing 14,710 SF general merchandise and grocery store. LOCATION: 789 S. Tustin Street NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15301 (Class 1 — Existing Facilities) because the project consists of the operation and licensing of an existing private structure. RECOMMENDED ACTION: Adopt Planning Commission Resolution 11 -14 approving a request for an Alcoholic Beverage Control License Type 20 (Off -Sale Beer and Wine) and a Finding of Public Convenience or Necessity at a general merchandise and grocery store. Chair Steiner explained that this was a continued item from the July 21, 2014 meeting and that the Planning Commission, at that meeting, had asked for a number of additional conditions which have been included. He then proceeded to open the public hearing for those wanting to speak in favor of or in opposition to the proposed project. Steve Rawlings, applicant's representative was present to answer questions and concerns of the Planning Commissioners. He stated that the applicant had agreed to the 32 Conditions of Approval. Chair Steiner officially closed the public hearing. NEW HEARINGS: 4.1 CONDITIONAL USE PERMIT NO. 2942-14 — TRU BRU COFFEE The applicant proposes to serve beer and wine at an existing restaurant under a State Alcohol and Beverage Control (ABC) Type 41 License. LOCATION: 7626 -D E. Chapman Avenue NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State Guidelines 15301 (Class 1 — Existing Facilities) because the project consists of the operation and licensing of an existing private structure. RECOMMENDED ACTION: Adopt Planning Commission 14 -14 approving an Alcohol Beverage Control (ABC) Type 41 License for the purpose of selling beer and wine at a coffee serving establishment. Discussion: Chad Ortlieb, Senior Planner presented a project overview consistent with the Staff Report. Chair Steiner opened the public hearing for those wanting to speak in favor of or in opposition to the proposed project. Larry Larson, applicant, was present to answer questions or concerns of the Planning Commission. He stated that he was in agreement with all 38 Conditions of Approval. Chair Steiner officially closed the public hearing. A motion was made to adopt Planning Commission Resolution No. 14 -14 approving an Alcoholic Beverage Control (ABC) License Type 41 (On Sale Beer and Wine — Eating Place) for the purpose of selling beer and wine at a coffee serving establishment. LOCATION: 691 S. Main Street, Unit 140 NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15301 (Class 1 — Existing Facilities) because the project consists of the operation and licensing of an existing private structure. RECOMMENDED ACTION: Adopt Planning Commission Resolution 13 -14 approving a State of California Department of Alcohol and Beverage Control Type 41 License for the purpose of selling beer and wine at a restaurant. Discussion: Chad Ortlieb, Senior Planner presented a project overview consistent with the Staff Report. Chair Steiner opened the public hearing for those wanting to speak in favor of or in opposition to the proposed project. Long Ji Jin, applicant, was present to answer questions or concerns of the Planning Commission. Chair Steiner officially closed the public hearing. A motion was made to adopt Planning Commission Resolution No. 13 -14 approving an Alcoholic Beverage Control (ABC) Type 41 License (On Sale Beer and Wine — Eating Place) for the purpose of selling beer and wine at a restaurant.
