Chair Steiner called the meeting to order at 7:00 p.m.

3. NEW HEARING:
3.1 CONDITIONAL USE PERMIT NO. 2908 -13, DESIGN REVIEW
COMMITTEE NO. 4695 -13, AND MINOR SITE PLAN REVIEW
NO. 0741-13 — AT &T WIRELESS SITE
The applicant proposes to construct a 45' tall by 12' wide by 12' deep tower to
house equipment for a wireless communication facility in the Old Towne Historic
District. The proposed tower will be integrated with an existing 28' tall structure
on a property that contains non - contributing structures to the Historic District.
Although the tower is integrated with an existing structure, it requires separate
structural supports and is considered to be a ground- mounted stealth installation,
which requires a Conditional Use Permit request in the Old Towne Historic
District.
LOCATION: 520 W. Walnut Avenue
NOTE: The proposed project is categorically exempt from the
provisions of the California Environmental Quality Act
(CEQA) per State CEQA Guidelines Section 15303 (Class
3 — New Construction or Conversion of Small Structures),
because the project involves construction of a small
structure. There is no environmental public review
required for a Categorical Exemption.
RECOMMENDED ACTION:
Adopt Planning Commission Resolution No. 07 -14 of the
City of Orange approving Conditional Use Permit No.
2908 -13, Design Review Committee No. 4695 -13 and
Minor Site Plan Review No. 0741 -13 for construction of a
tower to house antennas and equipment for a wireless
communication facility in the Old Towne Historic District
on property located at 520 West Walnut Avenue.
Discussion: Marissa Moshier, Associate Planner, presented a project overview
consistent with the Staff Report.
Chair Steiner opened the public meeting for those wanting to speak in favor of or
in opposition to the proposed project.
Alexander Lew, AT &T representative, responded directly to questions from the
commissioners and addressed their concerns.
A motion was made to adopt Planning Commission Resolution No. 07 -14 of the
City of Orange approving Conditional Use Permit No. 2908 -13, Design Review

3.2 CONDITIONAL USE PERMIT NO. 2929 -14 AND DESIGN REVIEW
COMMITTEE NO. 4744-14 — THE TILTED KILT
The applicant proposes a new outdoor patio area of 1,160 SF and making exterior
changes for the outdoor patio at a restaurant building within the Stadium
Promenade center. They are also proposing to serve alcohol in the outdoor patio
area.
LOCATION: 1625 West Katella Avenue
NOTE: The proposed project is categorically exempt from the
provisions of the California Environmental Quality Act per
State CEQA Guidelines Section 15301 (Class 1 — Existing
Facilities) because the project only involves the licensing of
alcohol sales and an outdoor seating area of less than 2,500
square feet. There is no environmental public review
required for a Categorical Exemption.
RECOMMENDED ACTION:
Adopt Planning Commission Resolution No. 08 -14
approving a new outdoor patio area of 1,160 square feet
and modify the exterior of the building.
Discussion: Robert Garcia, Associate Planner, presented a project overview
consistent with the Staff Report.
Chair Steiner opened the public meeting for those wanting to speak in favor of or
in opposition to the proposed project.
Matthew Cunningham, Pacific Strategies, applicant representative, responded
directly to questions from the commissioners and addressed their concerns.
Mr. Cunningham requested a minor alteration in Condition 4 substituting
language for the Commission's consideration. The condition reads now that the
new proposed door from the inside of the restaurant to the patio will match the
two existing entry doors to the building to the greatest extent possible.
The problem with the proposed language is the entry doors into The Tilted Kilt
are heavy double wooden doors with stained glass that would actually defeat the
purpose the applicant was trying to achieve of having maximum visibility with
that door, which was what the Police Department wanted.
These doors would be more like the doors out to the existing back patio. They
will be wood, but there will be glass so there is some visibility for staff. It will

satisfy with the spirit of the DRC condition and accommodate the Police
Department concerns.
Robert Garcia, Associate Planner, stated that staff did not have any objection to
the language change. Attachment #6, the minutes of the DRC are consistent with
the proposed language change. The language for Condition #4 will now change
from "two existing entry doors" to "two existing doors."
A motion was made to adopt Planning Commission Resolution No. 08 -14
approving a new outdoor patio area of 1,160 square feet and modify the exterior
of the building. A motion was made to change the existing language in Condition
4 of DRC 4744 -14.
