NEW HEARING: 3.1 CONDITIONAL USE PERMIT NO. 2978 -15; MAJOR SITE PLAN NO. 813 -15 AND DESIGN REVIEW NO. 4798-15 — RAISING CANE'S RESTAURANT The applicant proposes to demolish an existing 11,854 SF office building and construct a new 3,823 SF drive -thru restaurant. The project includes a 793 SF outdoor dining patio, new drought tolerant landscaping and a new parking layout. LOCATION: 2249 N. TUSTIN NOTE: This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15332 (Class 32 — In -fill Development Projects). RECOMMENDED ACTION: Adopt Planning Commission Resolution No. 23 -15 approving the construction of a 3,823 SF drive -thru restaurant. Discussion: Kelly Ribuffo, Associate Planner, presented a project overview consistent with the staff report. She explained the two issues concerning the project were the drive - thru queuing and the "Blue Dog" artwork. Staff felt the drive -thru size was adequate for the anticipated demand and she stated the Design Review Committee has asked that the artwork be returned to them for further consideration. Ms. Ribuffo indicated staff had heard from a concerned resident about the construction and demolition noise. The resident was informed that there are construction hours and the applicant was made aware of the concerns of that resident. The Planning Commission had a question and concern regarding the square footage of the "Blue Dog" art and the need to strengthen the pedestrian connections particularly on Tustin Street. Leslie Roseberry, Planning Manager, explained that recently there has been a trend to add more artwork to projects but the definition in the code does not give guidance as to what might be art and what might be branding in signage. Staff is currently trying to determine how to deal with things that are not signage and to be consistent for this project and projects in the future. Robert Montgomery, from Raising Cane's, expressed his excitement about opening this new restaurant. He noted that Kelly Ribuffo and Lisa Kim have been wonderful to work with as well as the rest of the staff. He is addressing the concerns of the Design Review Committee regarding the landscaping lights and the "Blue Dog" art. He explained the demolition would occur during the proper hours and should last 3 days. He heard the concern of the Taco Bell property owner next to this project before the meeting. 2 Planning Commission August 3, 2015 Commissioner Glasgow had concern that the queuing would be at the same spot as the entrance coming out behind the Taco Bell. Phil Schanberger, PM Design Group, indicated they had changed the original design per comments made by City staff. Mr. Montgomery also explained that if there is a problem with the queuing, the managers will come out and help with the traffic. He stated that during peak hours, vehicles move forward every 33 seconds. Ms. Ribuffo explained, as shown in Figure 1 of the Traffic Study, how all the cars stack up in the drive -thru lane and that 9 cars are the maximum amount the applicant is anticipating to be at the restaurant at one time. The Commission had a question about the green building standards and concern about the crumbling wall on the north side of the property. Tyler Holst, civil engineer, stated they would be keeping the wall but would be increasing the landscaping in that area. Mr. Montgomery indicated they would also repair the brick wall. Public Hearing was opened. Tommy Wong, owner of the Taco Bell property, had concern about the traffic on Tustin Street and increased congestion. Public Hearing was closed. The Commission expressed their support of the project feeling it was a great addition to Tustin Street and an appropriate project for the area. Their concern regarding the queuing had been addressed and recommended trying to strengthen some of the sidewalk connections particularly on the north side of the building. Motion was made to adopt Planning Commission Resolution No. PC 23 -15 approving Conditional Use Permit 2978 -15, Major Site Plan Review 0813 -15, and Design Review 4798 -15 for Raising Cane's Restaurant at 2249 N.
