Administrative Session — 5:00
Vice Chair Fox opened the Administrative Session at 5:13 p.m.
Vice Chair Fox inquired if there was any Policy or Procedural information. Robert Garcia, Senior
Planner, explained that the item on the agenda was an appeal of a staff determination, and he asked
the Committee to mention the appeal procedure during the regular session.
Mr. Garcia also stated the meeting would adjourn to a special meeting on October 21 at 3:30 p.m.
Kelly Rifuffo, Associate Planner, further explained that the special meeting would take place at
Chapman University at the Global Citizen's Plaza and it would adjourn at the site and reconvene for
the regular DRC meeting at 5:00 p.m.
Committee Members reviewed the Design Review Committee minutes for September 16, 2015.
Committee Member Wheeler made a motion to close the Administrative Session of the Design
Review Committee meeting.

(2) DRC No. 4818 -15 — Maloney Fence
• A proposal to construct a vinyl fence in the front and side yards of a non - contributing
detached duplex in the Old Towne Historic District.

Chair McCormack read aloud the appeal procedure.
Marissa Moshier, Associate Planner- Historic Preservation, presented a project overview consistent
with the Staff Report. She explained that based on the requirements of the Old Towne Design
Standards, staff considered compatible fencing materials to be wood and wrought iron/metal. The
Design Standards do include provisions for the use of alternate materials provided those materials
convey the appearance of similar features on historic properties. Staff determined the proposed
vinyl fencing on this project was not compatible with the character of the Historic District, and
denied the request. The applicants chose to appeal Staff s determination to the DRC.
The applicants who were present for this project were Lyn and Geoff Maloney. Mr. Maloney
explained that the two homes on the property were built in 1994 and originally they had a wood
fence. Due to maintenance and safety issues, they chose to install vinyl fencing. He found that the
vinyl fence was aesthetically better than wood. He said he could not find any documentation
explaining that a vinyl picket fence was not allowed.
Ms. Maloney said it was important to note that the fence style was consistent with the style of the
property. She also said it helps maintain the value of the property.
Public Comments
Chair McCormack opened the item to the Public for comments. Tony Trabucco, representing
OTPA, stated they are in support of staff s recommendation to deny the request due to the materials
not fitting in with the Design Standards. He said if everyone did it, it would distract from the
character of Old Towne.
Chair McCormack opened the item to the Committee for discussion.
The DRC had the following questions and comments:
• Asked if any of the vinyl fences currently in Old Towne were approved. Ms. Moshier said
not to her knowledge.
• Stated that aesthetically wood fences look different than vinyl.
• Agreed that the Old Towne Design Standards do not explicitly prohibit vinyl fences, but any
fence in the front and side yard has to be reviewed by staff.

• For the record, fences are not required in the front yard. Eliminating the fence would allow
for open space in the front area similar to the neighboring houses on Pine Street.
• Addressed the concern regarding the maintenance of wood fences stating there are well
constructed wood fences.
• Regarding the liability issue, there was no requirement that the fence has to be at the
sidewalk. Suggested placing the fence back from the sidewalk.
• Did not feel this was a material that, by the Code, was either in -kind or matches the texture
and construction details of the historic material and that was addressed clearly in the Design
Standards.
• Suggested minimizing the amount of fence by pulling back the front yard fence at the corner
of the building and allowing the side yard to have some openness.
• Explained there are alternatives such as a historic wire fence.
• Ms. Maloney asked where in the Ordinance that it defines historic materials. The Committee
stated there are no historic vinyl fences in Old Towne, so vinyl is not considered to be a
historic material.
• Stated artificial turf was not allowed in Old Towne and vinyl fences were a similar issue.
• Placement of the fence, the material, and the construction design has to be considered for
conformance with the Design Standards.
Ms. Maloney asked if there was a compromise such as using wood pickets, wood caps, and
sandblasting the vinyl to add texture. Mr. Garcia clarified that if the applicant wanted to make an
alternative submittal, it would need to come back to staff.
Ms. Moshier explained that a project that required staff approval would need the same level of
findings that the Committee would need to make.
Committee Member Fox made a motion to deny the appeal of DRC No. 4818 -15, Maloney Fence,
based on the Committee's discussion.

Committee Member Imboden noted that technology is changing rapidly and there are issues with
solar panels, satellite dishes and vinyl fences. His recommendation was to bring information to the
Committee, discuss some options, and get it dealt with more clearly in the Code. Ms. Moshier said
she would organize a study session to address this issue.

Committee Member Wheeler made a motion to adjourn to a special meeting on Wednesday, October
21, 2015 at 3:30 p.m. at Chapman University, One University Drive.
