RES-10888 Letter of Understanding For Orange Police AssociationRESOLUTION NO. 10888 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ORANGE AND THE CITY OF ORANGE POLICE ASSOCIATION EFFECTIVE JULY 1, 2015 THROUGH JUNE 30, 2017 WHEREAS, the City of Orange, hereinafter referred to as "City," and the City of Orange Police Association, hereinafter referred to as "COPA" have met and conferred in accordance with the requirements of the Meyers - Milias -Brown Act; and WHEREAS, the City and COPA have reached agreement on wages, salaries, and other terms and conditions of employment effective July 1, 2015 through June 30, 2017; and WHEREAS, the City Council of the City of Orange has consulted with its Chief Negotiator concerning the proposed employment terms contained in the attached Letter of Understanding; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that the attached Letter of Understanding is approved and incorporated by reference as Exhibit "A." Recitals A. The City of Orange (hereafter, "City ") and the City of Orange Police Association, (hereafter, "COPA ") hereby enter into this LOU effective July 1, 2015. B. The parties agree to incorporate the language addressed in this LOU into a new Memorandum of Understanding ( "New MOU "), once both parties have the opportunity to review and concur on any and all language changes that will become part of the New MOU. A New MOU document will be presented to the City Council at a future meeting for its approval. C. All references to the "MOU" in this LOU shall be to that Memorandum of Understanding by and between the City and COPA adopted by City Council Resolution No. 10779. D. This new "LOU" shall supersede the "MOU" (Resolution No. 10779) as well as the prior "LOU" (Resolution No. 10734) which amended the "MOU" and was adopted by the City Council on September 9, 2014. Aereement 1. Term and Effective Date The term of this LOU shall be from July 1, 2015 to June 30, 2017 and will become effective upon ratification by COPA membership and approval of the City Council. 2. Salary (MOU Exhibit "I ") Implement an across the board base salary increase of 3% for sworn, effective November 1, 2015 and an additional 3% for sworn, effective August 7, 2016. Implement an across the board base salary increase of 2% for non -sworn, effective October 4, 2015 (contingent upon notification of ratification no later than October 3, 2015) and an additional 2% for non -sworn, effective June 26, 2016. Monthly Salary Tables effective June 29, 2014 and October 4, 2015 are attached as Exhibit 64 111 3. Medical Insurance (MOU Article XVII, Section 1B) Modify Article XVII, Section 113 of the MOU to provide that the City's contribution on behalf of each active employee shall be increased by $50 effective January 1, 2016 and increased by an additional $50 effective January 1, 2017. 4. Association Release Time (MOU Article XXI, Section 3) Effective July 1, 2015, modify Article XXI of the MOU to state that the City shall provide 130 hours (up from 110 hours) of Association release time each year for use by the Association President or designated members to attend Association related training, seminars, or other lawful association related business. Release time shall be approved by the Police Chief and shall not be unreasonably withheld. Any unused hours provided by the City shall be rolled over from one fiscal year to the next, provided that the total shall not exceed 260 hours. 5. Grievance Procedure (MOU Article XXV, Section 61 Amend Article XXV, Section 6 to provide that the entire cost of the Hearing Officer shall be borne by the City, effective October 4, 2015. 6. Industrial Disability Retirement (MOU Article XV, Section 5F) Modify Section 5F to include Sick leave payout extended to industrial disability retirement on same terms as service retirement, effective October 4, 2015. 7. Bereavement Leave (MOU Article XV, Section 7) Amend Article XV, Section to add the word "Spouse" under Section 7A2 as follows: any parent, substitute parent, parent -in -law, grand parent, aunt, uncle, spouse, child, brother, sister, domestic partner, the employee's or spouse's /domestic partner's child, grandchild, parent, substitute parent, grandparent, sibling, aunt, or uncle." Overtime (Article VI, Section 9) Amend Article VI, Section 9 as follows: If in the event of circumstances beyond the City's control, such as Acts of Nature, fire, flood, insurrection, riot, national emergency or other similar circumstances, employees covered herein shall be entitled to only a straight time rate for non -FLSA overtime worked under such circumstances." 9. Clothine Allowance (Article XI) Amend Article XI to provide that police officers assigned as a Detective or Investigator /Rotator, and civilian employees assigned as a Civilian Investigative Officer CIO), shall receive a clothing allowance while so assigned in an amount of $500.00 per fiscal year; these employees are allocated two uniforms per fiscal year consisting of two pants and two shirts. If the employee elects to take the $500 clothing allowance, he /she will not be entitled to the two uniforms for that fiscal year. 10. Travel Expenses Allowed (Article XX) Amend Article XX to provide that when an employee is required to remain at an out of town location for an entire day, the City will provide the employee with his or her own hotel room so that the employee will not be required to share a hotel room with another individual. 11. Language Clean -up /Other Implement mutually agreed language clean -up to conform MOU to current practices or agreements. 12. Status of MOU Except as specifically provided and amended herein, the terms and conditions of the MOU shall govern the provisions of wages, salaries and other benefits for all employees covered by the MOU through June 30, 2017. This LOU shall not be interpreted to extend and /or limit any other rights, benefits, or compensation of either party except as specifically provided herein and both this LOU and MOU shall expire on June 30, 2017.
