RES-10924A Letter of Understanding For Municipal EmployeesRESOLUTION NO. 10924A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ORANGE AND THE ORANGE MUNICIPAL EMPLOYEES' ASSOCIATION EFFECTIVE JULY 1, 2015 THROUGH JUNE 30, 2017. WHEREAS, the City of Orange, hereinafter referred to as "City," and the Orange Municipal Employees' Association have met and conferred in accordance with the requirements of the Meyers - Milias -Brown Act; and WHEREAS, the City and the Orange Municipal Employees' Association have previously reached agreement on wages, salaries, and other terms and conditions of employment effective July 1, 2015 through June 30, 2017; and WHEREAS, the City Council of the City of Orange has previously approved Resolution 10924 after consulting with its Chief Negotiator concerning the proposed employment terms contained in the attached Letter of Understanding; and WHEREAS, staff became aware of a typographical error in the year two percentage raise in previously approved Resolution 10924 and now wishes to correct that error to reflect the true agreement between the parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that the attached Letter of Understanding is approved and incorporated by reference as Exhibit "A." Recitals A. The City of Orange (hereafter, "City ") and the Orange Municipal Employees' Association ( "OMEA ") hereby enter into this LOU effective July 1, 2015. B. The parties agree to incorporate the language addressed in this LOU into a new Memorandum of Understanding ( "New MOU "), once both parties have the opportunity to review and concur on any and all language changes that will become part of the New MOU. A New MOU document will be presented to the City Council at a future meeting for its approval. C. All references to the "MOU" in this LOU shall be to that Memorandum of Understanding by and between the City and OMEA adopted by City Council Resolution No. 10763. D. This new "LOU" shall supersede the "MOU" (Resolution No. 10763) and was adopted by the City Council on February 11, 2014. Agreement 1. Term and Effective Date. The term of this LOU shall be from July 1, 2015 to June 30, 2017 and will become effective upon ratification by the OMEA membership and approval of the City Council. 2. Salary (MOU Appendix "A "). Implement an across the board base salary increase of 2.5 %, effective January 24, 2016. Implement an across the board base salary increase of 1.5 %, effective July 24, 2016. Monthly Salary Tables effective June 29, 2014, January 24, 2016 and July 24, 2016 are attached as Appendix "A ". 6380902.2 OR020 -059 3 3. Medical Insurance (MOU Article XVI, Section 113). Modify Article XVIII, Section 113 of the MOU to provide that the City's contribution on behalf of each active employee shall be increased by $50 effective January 1, 2016 and increased by an additional $50 effective January 1, 2017. 4. Vacation Conversion (MOU Article XII, Section 3). Effective July 1, 2015, an employee may convert up to 33% of his current annual vacation accrual into cash in lieu of time off with pay during the 2015 -2016 fiscal Year. Effective July 1, 2016, an employee may convert up to 33% of his current annual vacation accrual into cash in lieu of time off with pay during the 2016 -2017 fiscal year. 5. Educational Reimbursement (MOU Article XVII, Section 3) Effective July 1, 2015, the parties agree to amend Article XVII, Section 3 to provide an increase to $475 (up from $200) of $1,250 educational reimbursement shall be available "for activities that aid in their professional development." 6. Overtime (MOU Article X, Section 3). Amend Article X, Section 1 to include clarification that any paid leave hours used during the Christmas/New Year's Holiday Closure shall count as hours worked for purposes of computation of overtime. 7. Shift Differential Pay (MOU Article III). Effective upon execution of this agreement, Article III shall be amended to add Community Services Supervisor under Section 9. 8. Language Clean-up/Other. Implement mutually agreed language clean -up to conform MOU to current practices or agreements. 6380902.2 OR020 -059 4 9. Status of MOU. Except as specifically provided and amended herein, the terms and conditions of the MOU shall govern the provisions of wages, salaries and other benefits for all employees covered by the MOU through June 30, 2017. This LOU shall not be interpreted to extend and /or limit any other rights, benefits, or compensation of either party except as specifically provided herein and both this LOU and MOU shall expire on June 30, 2017.
