RES-11201 Fire Protection Facilities Fee Categories RevisedRESOLUTION NO. 11201 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REPEALING RESOLUTION NO. 10195 AND REVISING THE FIRE PROTECTION FACILITIES FEE CATEGORIES AND RELATED FEES. WH REAS, the City Council adopted Chapter 1538 of the Orange Municipal Code to require that developers contribute their fair shaze of the costs of the acquisition and construction of new fire protection facilities and certain other improvements and additions to fire protection facilities; and WHEREAS,the Orange Municipal Code provides that fees may be increased by resolution adopted by the City Council; and WH REAS, the Fire Protection Facilities Program fees were last updated by the City in 2007; and WHEREAS, the City contracted with a consultant to perform an analysis of the fees necessary to be charged to new development to provide the fire protection facilities required as a result of such development and also to perform an analysis of the current categories of new development that would generate the need for fire protection facilities program fees; and WI REAS,the consultant performed this analysis and calculated the fees in compliance with the requirements of the Mitigation Fee Act (California Government Code Section 66000 et seq.) and recommended consolidation of some categories of development; and WHEREAS, the City Council has considered the information in the consultanYs repod and the City's staff report and has determined the fees should be adjusted to more equitably allocate new developmenYs fair share of the cost of new fire facilities and to cover increased construction costs and administrative costs. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange as follows: 1. The eight current Fire Protection Facilities Program fee categories (Detached Residential, Attached Residential, College/University Dorm, Group/Congregate Units, Commercial Lodging, CommerciaUOffice Use, IndustriaUManufacturing Use, Private Hospital Use) aze consolidated into four fee categories (Single-/Multi-Family, Dormitory, CommerciaUIndustrial, and Hospital). 2.Resolution No. 10195 is repealed and the Fire Protection Facilities Program fees for the four new categories,including administrative fees,are hereby adopted as set forth in Exhibit A „ 3.The Fire Protection Facilities Program fees shall be automatically adjusted on the first day of July each yeaz,beginning July 1,2020,to reflect the percentage of increase or decrease in the Consumer Price Index for All Urban Consumers (CPI-U) (Los Angeles-Long Beach- Anaheim; all items, not seasonally adjusted; 1982-1984=100 reference base) for the timeframe since the most recent increase. The adjusted fee, if any, shall be rounded to the neazest dollaz for the "per uniY' fees and to the neazest one-tenth of a cent for the"per squaze fooY'fees. ADOPTED this 14th day of January 2020.
