RES-11203 Library Facilities Fee Categories RevisedRESOLUTION N0. 11203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REPEALING RESOLUTION NO. 9725 AND REVISING THE LIBRARY FACILITIES FEE CATEGORIES AND RELATED FEES. WHEREAS, the City Council adopted Chapter 3.50 of the Orange Municipal Code to require that developers contribute their fair shaze of the costs of the acquisition and construction of librazy facilities and expansion of services and infrastructure; and WHEREAS,the Orange Municipal Code provides that fees may be increased by resolution adopted by the CiTy Council; and WHEREAS, the Library Facilities fees were last updated by the City in 2003; and WHEREAS, the CiTy contracted with a consultant to perform an analysis of the fees necessary to be chazged to new development to provide the library facilities required as a result of such development and also to perform an analysis of the current categories of new development that would generate the need for library facilities fees; and WHEREAS,the consultant performed this analysis and calculated the fees in compliance with the requirements of the Mitigation Fee Act (Califomia Government Code Section 66000 et seq.) and recommended the consolidation of the three residential categories of development and the additional of a commercial category; and WHEREAS, the City Council has considered the information in the consultanYs report and the City's staff report and has determined the fees should be adjusted to more equitably allocate new developmenYs fair shaze of the cost of new library facilities and to cover increased construction costs and administrative wsts. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange as follows: 1. The current three residen6al dwelling unit fee categories are consolidated into one category designated as"Residential"and a new fee category designated as"Commercial"is added. 2. Resolution No. 9725 is repealed and the Library Facilities fees, including administrative fees, for all categories aze hereby adopted as set forth in Exhibit"A." 3. The Librazy Facilities fees shall be automatically adjusted on the fust day of July each yeaz,beginning July 1,2021,to reflect the percentage of increase or decrease in the Consumer Price Index for All Urban Consumers (CPI-U) (Los Angeles-Long Beach-Anaheim; all items, not seasonally adjusted; 1982-1984=100 reference base) for the timeframe since the most recent increase. The adjusted fee,if any, shall be rounded to the neazest dollaz for the"per dwelling uniY' fees and to the neazest one-tenth of a cent for the"per squaze fooY' fees.
