RES-11205 Revising Park-in-Lieu Fee Catagories and Related FeesRESOLUTION NO. 11205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REPEALING RESOLUTION NO. 9723 AND REVISING THE PARK IN LIEU FEE CATEGORIES AND RELATED FEES. WIIEREAS, the City Council adopted Chapter 16.60 of the Orange Municipal Code to establish certain standazds and formulas for pazk land dedication and the payment of a fee in lieu thereof as a condition of subdivision approval; and WHEREAS,the Orange Municipal Code provides that fees may be increased by resolution adopted by the CiTy Council; and WHEREAS, the Pazk Dedication and fees requirements were last updated by the City in 2003; and WHEREAS, the Ciry contracted with a consultant to perform an analysis of the fees necessazy to be charged to new development to provide the pazk and recreation facilities required as a result of such development and also to perform an analysis of the current categories of new development that would generate the need for park dedication and fees; and WHEREAS, the consultant performed this analysis and calculated the fees in compliance with the requirements of the Quimby Act(California Govemment Code Section 66447 et seq.)and recommended the elimination of the district designations; and WIIEREAS, the City Council has considered the information in the consultanYs report and the City's staffreport and has determined the fees should be adjusted to more equitably allocate new developmenYs fair shaze of the cost of new pazk and recreation facilities and to cover increased construction costs and administrative costs. NOW, TAEREFORE BE IT RESOLVED by the City Council of the City of Orange as follows: 1.The current three fee categories based on the number of dwelling units aze and the current two district-based categories aze consolidated into one single category designated as Residential." 2.Resolution No. 9723 is repealed and the Park In Lieu fee, including an administrative fee, is hereby adopted as set forth in Exhibit "A." 3.The Park In Lieu fees shall be automatically adjusted on the first day of July each year, beginning July 1, 2021, to reflect the percentage of increase or decrease in the Consumer Price Index for All Urban Consumers(CPI-Ln (Los Angeles-Long Beach-Anaheim; all items,not seasonally adjusted; 1982-1984=100 reference base) for the timeframe since the most recent increase.
