RES-11213 Sufficiency of Referendum Petition_Trails at Santiago Creek ProjectRESOLUTION NO. 11213 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ACCEPTING THE CffiEF CLERK'S DECLARATION OF SUFFICIENCY OF REFERENDUM PETITION AGAINST RESOLUTION NO. 11188 APPROVING GENERAL PLAN AMENDMENT NO. 2018-0001 FOR THE TRAILS AT SANTIAGO CREEK PROJECT. WH REAS, on October 22, 2019, the City Council adopted Resolution No. 11188 approving General Plan Amendment No. 2018-0001 for the Trails at Santiago Creek project in accordance with the provisions of the City of Orange Municipal Code, and authorizing and directing the Mayor of the City of Orange to execute the same; and WII REAS, after resolving issues between the project opponents and the City over the effectuating language contained in Resolution No. 11188,it was executed by the Mayor of the City of Orange on November 5, 2019; and WHEREAS, on December 4, 2019, the Chief Clerk received a Referendum Petition against Resolution No. 11188, approving General Plan Amendment No. 2018-0001; and WII REAS, pursuant to Election Code Section 9237, a referendum petition must be signed by at least 10 percent of the registered voters in the CiTy based upon the County Election Official's last official report of registrations to the Secretary of State; and WII REAS, the Orange County Registraz's last official report of registration to the Secretary of State for the City of Orange was 70,007 registered voters and ten percent of said registration would require 7,001 valid signatures to qualify the referendum petition; and WHEREAS, on January 8, 2020, the Orange County Registrar of Voters determined that the Referendum Petition contained 7,005 valid signatures and notified the Chief Clerk as set forth in E7chibit A, attached hereto and incorporated herein by reference; and WII REAS, the Chief Clerk has prepared the Declazation of Sufficiency of Petition for Referendum as set forth in Exhibit B, attached hereto and incorporated herein by reference; and WII REAS, California Elections Code Section 9240 requires that referendum petitions must be submitted to the City Council at the next regulaz City Council meeting following the certification. NOW, THEREFORE, BE IT RESOLVED that the CiTy Council of the City of Orange hereby accepts the Declaration of Sufficiency of Petition for Referendum prepazed by the Chief Clerk for the Referendum Petition against Resolution No. 11188, a copy of which Declazation is attached hereto as Exhibit B. In accordance with my duties under the Election Code, I have found the petition to be sufficient in accordance with the requirements of the Election Code. Attached is the Cer[ificate as to verification of signatures on petition by Neal Kelly, Registraz of Voters, Orange County. Pursuant to that certification, 8,740 signatures have been verified including l7 withdrawal signatures,with 7005 si natures found valid. Electiun Code Section 9237 requires 10% of the Registered Voters to sign the petition.
