RES-11244 Amend Conflict of Interest Code to include OCPFFA MembersRESOLUTION N0. 11244 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING THE CONFLICT OF INTEREST CODE FOR THE CITY OF ORANGE TO INCLUDE MEMBERS OF THE ORANGE CITY PUBLIC FACILITIES FINANCING AUTHORITY. WHEREAS,the Political Reform Act, Government Code Sections 81000 et s,requires the CiTy to adopt and promulgate a conflict of interest code; and WFIEREAS, the City has complied with this requirement by adopting by reference the model conflict of interest code developed by the Fair Political Practices Commission as the Conflict of Interest Code for the City of Orange; and WH REAS, the Political Reform Act, in Government Code Section 87306 (a), requires the City to review and revise as necessary, its Conflict of Interest Code when necessitated by changed circumstances, including the creation of new positions; and WHEREAS, the City has determined that the members of the newly created Orange CiTy Public Faciliries Financing Authority should be included in the City's Conflict of Interest Code. NOW,THEREFORE,BE IT RESOLVED by the City Council of the CiTy of Orange as follows: 1. The list of designated employees required to file statements of economic interests is hereby amended to include the newly created Orange City Public Facilities Financing Authority, as set forth in E chibit "A", which is attached hereto and incorporated herein by this reference. 2.Members designated in the City's Conflict of Interest Code for the newly created agency shall file their statements pursuant to Govemment Code Section 87302.6. 3.All officials and designated positions required to submit a statement of economic interests shall file their statements with the City Clerk as the City's Filing Officer. The City Clerk shall make and retain a copy of all statements filed by the Mayor,Councilmembers,Orange City Public Facilities Financing Authority, Planning Commissioners, City Manager, City Attorney, and City Treasurer, and forwazd the originals of such statements to the Fair Political PracGces Commission. The CiTy Clerk shall retain the originals of the statements filed by all other officials and designated posiGons and will make all retained statements available for public inspection and reproduction upon request during regular business hours. DISCLOSURE CATEGORIES Cate¢ory 1 Category 1 relates to interests in real property wi[hin or close (2 miles) to the City of Orange in which the designated employee, spouse and dependent children have an aggregate interest of$1,000 or more in value. I[ includes interests in real property held by a business entity or trust in which the employee, spouse and dependent children have an aggregate intetest of 10%or more. Cateeory 2 Category 2 relates to inveshnents held by the designated employee, spouse and dependent children,with an aggregate value of mote than$1,000,in business entities having real property in the City of Orange or doing business,planning to do business,or having dane business in the City of Orenge within the past two years. I[ includes investments held by a business entity or trust in which the filer,spouse and dependent children have an aggregate interest of 10%or geater. Cateaory 3 Category 3 relates to sources of income (including loans)aggregating$250 or more if the source is located within or doing business within the City of Orange. It includes gifts aggregating$50 or more whether or not the source(donor)is in the City of Omnge. It includes sources of income to the designated employee,to the designated employee's community property interest in the income of a spouse,and to the employee's pro rata share of any income of a hvst in which the employee, spouse or dependent children have individually or collectively an aggregate interest of 10%or eater.
