Kisela, Chief of Police REVIEW: City Manager Finance 1. SUBJECT First Amendment to Agreement No. 6447.3 with the County of Orange for a Lead Forensic Specialist during Fiscal Year 2020-2021. 2. SUMMARY The First Amendment with the County of Orange authorizes the continuation of services for a dedicated Lead Forensic Specialist to conduct fingerprint examinations in the amount of$154,909 for Fiscal Year 2020-2021. 3. RECOMMENDED ACTION Approve First Amendment to Agreement No. 6447.3 with the County of Orange for a Lead Forensic Specialist in the amount of$154,909 and authorize the Mayor and City Clerk to execute on behalf of the City. 4. FISCAL IMPACT The total expenditure for this agreement is $154,909 and will be funded through General Fund (100). 5. STRATEGIC PLAN GOALS Goal 1: Provide for a safe community b: Provide and maintain infrastructure necessary to ensure the safety of the public. 6. DISCUSSION AND BACKGROUND Over the years, the Police Department's Forensic Services Specialist position remained vacant due to lack of qualified candidates. The Forensic Services Specialist position provides vital services to the department and requires a unique skill set and qualifications not easily attained. The department relied on the assistance of the Orange County Sheriff's Department (OCSD) for many years; however, this process resulted in a delay in processing evidence that resulted in a backlog of fingerprint analysis. In January 2017, the Police Department transitioned from a first-come, first-serve basis with the County to a contractual services agreement that assigned a dedicated fingerprint examiner to the ITEM J 'OS/12/2020 Orange Police Department casework. The department mitigated the cost of services by holding the departmenYs Forensic Services Specialist position vacant, and ultimately eliminated the position in July 2019. Since contracting with OCSD, the department has cleared the backlog of fingerprint analysis and has remained current with daily activity. The current three-year agreement with the County, commencing July 1, 2019 and terminating June 30, 2022, provides a full-time Lead Forensic Specialist assigned to the Orange Police Department in the amount of $144,079 through June 30, 2020. This First Amendment increases the cost of services by $10,830 for a total not to exceed amount of $154,909 for Fiscal Year 2020-2021 (FY 20-21). Costs for services are calculated on an annual basis by the County and reflect the full anticipated cost of services, equipment, and supplies in accordance with current County cost data. Based on their high level of service and positive results, the department is requesting the continuation of services in an amount not to exceed $154,909 for FY 20-21. 7. ATTACHMENT First Amendment to Agreement with the County of Orange ITEM 2 OS/12/2020 FIRST AMENDMENT TO AGREEMENT 2 BETWEEN THE s CITY OF ORANGE a AND THE s COUNTY OF ORANGE 6 THIS FIRST AMENDMENT TO AGREEMENT is entered into this s Seventeenth day of March, 2020, which date is enumerated for purposes of reference s only, by and between the CITY OF ORANGE, hereinafter referred to as "CITY", and the o COUNTY OF ORANGE, a political subdivision of the State of California, hereinafter 11 referred to as "COUNTY" to amend, effective July 1, 2020, that certain Agreement z between the parties commencing July 1, 2019, hereinafter referred to as "AgreemenY'. s 1 . For the period of July 1, 2020 through June 30, 2021 Subsections E-2 and E-3 of the 14 Agreement are amended to read as follows: is E-2. The cost of regular services, equipment and supplies provided by COUNTY s for the period from July 1, 2020 through June 30, 2021 shall be as follows: i SERVICE COST OF SERVICE is Personnel Costs: 19 One (1) Lead Forensic Specialist 154,909 2o TOTAL COST 154,909. 2 E-3. COUNTY shall invoice CITY monthly. During the period July 1, 2020 through 22 June 30, 2021 said invoices will require payment by City of one-twelfth (1/12) zs of the cost for services referenced in paragraph E-2 of this Agreement." 2a 2. For the period July 1, 2020 to June 30, 2021, Subsection E-7 of the Agreement is 2s amended to read as follows: 2s E-7. The cost of potential future salary and benefit increases or decreases are not 2 included in the costs set forth in Subsection E-2 of this Agreement. If COUNTY 2a incurs or becomes obligated to pay for any such increases for or on account Page 1 of 3 of personnel whose costs are included in the calculations of costs charged to z CITY hereunder, CITY shall pay COUNTY, in addition to the cost of service 3 set forth in Subsection E-2 of this Agreement, the full costs of said increases a to the extent such increases are attributable to work performed by such 5 personnel after July 1, 2020, and CITY's cost of service hereunder shall be s deemed to have increased accordingly. CITY shall pay COUNTY in full for such increases on a pro-rata basis over the portion of the period between e July 1, 2020 and June 30, 2021 remaining after COUNTY notifies CITY that s increases are payable. o In the event that salaries and benefits costs for COUNTY employees 11 decrease for or on account of personnel whose costs are included in the 2 calculations of costs charged to CITY hereunder, COUNTY shall notify CITY 13 of decreased cost and bill accordingly." ia 3.
