03.20 Surplus Property W. La Veta Avenue1 . SUBJECT A Resolution of the City Council of the City of Orange finding that certain city-owned real property known as 617, 625, and 637 West La Veta Avenue, in the City of Orange is surplus to the City's needs and authorizing the disposal of said property. 2. SUMMARY Resolution No. 11177 will operate to cause City owned property located at 617, 625, and 637 West La Veta Avenue to be declared surplus to the City's needs and declare it available for disposal. RECOMMENDED ACTION Approve Resolution No. 11177. 4. FISCAL IMPACT None. 5. STRATEGIC PLAN GOALS Goal 1. Provide for a safe community d. Assure the development of the City occurs in a fashion that maximizes public safety. Goal 2. Be a fiscally healthy community d. Effectively manage and develop City assets. 6. DISCUSSION AND BACKGROUND These three properties located on La Veta Avenue were purchased by the City in the 1990's in anticipation of a project to widen La Veta Avenue. Each of the properties are residential and each contain one single family residence. The City has been renting these properties out since their respective purchases. The La Veta Avenue widening plan has since been abandoned and thus these properties are no longer needed for any anticipated future use by the City. ITEM 3,a O 1 4/14/2020 With declaring these properties surplus to City needs, the City's real property agent can begin the surplus property process. That process begins with the notification to all City departments and various agencies in Orange County of the availability of the surplus property, as required Government Code Section 54220, et seq. After the expiration of the 60-day notification period, the property will became available for sale to the general public. It is important to note that the three properties are contributing structures to the Old Towne Historic District, and are zoned R1-6. Tonight's City Council action is to approve the resolution declaring the properties surplus, thus allowing the City real property agent to begin the disposition process. Any sale and transfer of the properties will require the approval of the City Council. 7. ATTACHMENTS 1. Resolution No. 11177 2. Location map ITEM 2 4/14/2020 RESOLUTION NO. 11177 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE FINDING THAT CERTAIN CITY-OWNED REAL PROPERTY KNOWN AS 617, 625, AND 637 WEST LA VETA AVENUE, IN THE CITY OF ORANGE IS SURPLUS TO THE CITY'S NEEDS AND AUTHORIZING THE DISPOSAL OF SAID PROPERTY. WHEREAS, the City of Orange (the "City") is a municipal corporation exercising governmental functions and powers, organized and existing under the laws of the State of California; and WHEREAS,the City owns property consisting of three residential parcels, commonly known as 617, 625, and 637 West La Veta Avenue (the "Property"); and WHEREAS, pursuant Section 65402 of the California Government Code, the City Council finds and determines that the location, purpose and extent of the proposed disposition of the Property, have been considered and reported on by the Director of the Community Development Department of the City and that said proposed disposition conforms to the City's adopted general plan; and WHEREAS, as authorized by California Government Code Section 37350, the City Council finds and determines that the Properiy is not needed for the purpose for which it was acquired or for any other public purpose and is,therefore, surplus real property; and WHEREAS, this City Council, as the "lead agency" under the California Environmental Quality Act("CEQA"), finds and determines that the disposal of the Property is categorically exempt from the provisions of CEQA under Section 15312 of the State CEQA Guidelines relating to the sale of surplus government property; and WHEREAS,the City Council believes that the sale and disposition of the Property is to the common benefit of the City and its residents, and in accord with the public purposes and provisions of applicable State and local law requirements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange, on the basis of the facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows: 1. The faregoing recitals are true and correct. 2. The City Council finds and determines that the Property is categorically exempt from the provisions of CEQA under Section 15312 of the State CEQA Guidelines because the Property is of no value for wildlife or environmental purposes, and is of such an irregular shape and size that it is incapable of independent development or use. As such, the City Council hereby authorizes and directs the City Clerk to file a Notice of Exemption with the Orange County Clerk. 3. The City Council hereby finds and determines that the Property is not needed for the purpose for which it was acquired or for any other public purpose and is, therefore, surplus real property, and directs staff to solicit bids for the sale and disposition of the Property, which bids shall be considered at the time of bid closing by the City Council.
