REGULAR SESSION 1.1 CALL TO ORDER: Chair Glasgow called the meeting to order at 7:00 p.m. 1.2 FLAG SALUTE: Vice Chair Simpson led the flag salute. 1.3 ROLL CALL: Commissioners Glasgow, Willits, Simpson, Martinez and Vazquez 1.4 PUBLIC PARTICIPATION: Chair Glasgow opened the public hearing portion of the meeting. There were no speakers. 1.5 CONTINUED OR WITHDRAWN ITEMS: None 1.6 PLANNING MANAGER REPORTS: None 1.7 ANNOUNCEMENT OF THE APPEAL PROCEDURES 2. CONSENT CALENDAR: 2.1 APPROVAL OF MINUTES FROM THE REGULARLY SCHEDULED MEETING OF OCTOBER 7, 2019. A motion was made to approve the October 7, 2019 with corrections as noted to staff. Planning Commission October 21, 2019 2 3. NEW HEARING: 3.1 CONDITIONAL USE PERMIT NO. 3081-19, DESIGN REVIEW NO. 4966-19, AND MINOR SITE PLAN REVIEW NO. 0968-19 – 76 GAS STATION, LOCATED AT 5344 E. CHAPMAN AVENUE. The applicant proposes to renovate an existing full-service gas station, including the conversion of existing service bays to convenience store area, expansion of the convenience store building, sale of beer and wine for off-site consumption, and related on-site improvements. NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15304 (Class 4 – Minor Alterations to Land) because the project is for a weekly farmers market which will be a minor temporary use of land with negligible effects on the environment which will not alter the land use or density of the site. No public review is required. RECOMMENDED ACTION: Adopt Planning Commission Resolution No. PC 19-19 entitled: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE APPROVING CONDITIONAL USE PERMIT NO. 3081-19, DESIGN REVIEW NO. 4966-19, AND MINOR SITE PLAN REVIEW NO. 0968-19 TO RENOVATE AN EXISTING FULL-SERVICE GAS STATION, INCLUDING THE CONVERSION OF EXISTING SERVICE BAYS TO CONVENIENCE STORE AREA, EXPANSION OF THE CONVENIENCE STORE BUILDING, ON-SITE IMPROVEMENTS, SALE OF BEER AND WINE UNDER AN ALCOHOLIC BEVERAGE CONTROL (ABC) TYPE 20 (OFF-SALE BEER AND WINE) LICENSE, AND MAKING A FINDING OF PUBLIC CONVENIENCE OR NECESSITY, LOCATED AT 5344 E. CHAPMAN AVENUE Monique Schwartz, Associate Planner, provided an overview of the project consistent with the staff report. She also noted that two responses were received after the public hearing notices were mailed. Issues of concern included potential for increased traffic and noise. Doug Keys, City of Orange Transportation Analyst, explained the process used to calculate trip generation. Chair Glasgow invited the applicant to step forward. Joseph Karaki, applicant and architect for the project, spoke on behalf of the project and noted agreement with all the conditions of approval. He also indicated that light poles would be 14 feet high in response to Commissioner inquiry. Chair Glasgow opened the public hearing. Planning Commission October 21, 2019 3 Judith Deming, owner of the commercial building to the west of the property spoke in opposition of the project and questioned noticing procedures. Chair Glasgow closed the public hearing. Mary Binning, City Attorney explained that the mailing process conforms to the Government Code. Commissioner Willits asked the Police Department for a report. Detective Hank Echandi explained the Police Department support for the project. A motion was made to approve a resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3081-19, Design Review No. 4966-19, And Minor Site Plan Review No. 0968-19 to renovate an existing full-service gas station, including the conversion of existing service bays to convenience store area, expansion of the convenience store building, on-site improvements, sale of beer and wine under an Alcoholic Beverage Control (ABC) Type 20 (Off-Sale Beer and Wine) License, and making a finding of Public Convenience or Necessity, located at 5344 E. Chapman Avenue. LEWIS STREET. Request for a Conditional Use Permit to establish an educational program at an existing office site in an Urban Mixed-Use (UMU) zoning district. NOTE: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15301 (Class 1 – Existing Facilities) since the project consists of permitting an educational use in an existing office building and results in negligible or no expansion of the former office use. RECOMMENDED ACTION: Adopt Planning Commission Resolution No. PC 20-19 entitled: Planning Commission October 21, 2019 4 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE APPROVING CONDITIONAL USE PERMIT NO. 3088-19 APPROVING THE OPERATION OF AN ORANGE COUNTY DEPARTMENT OF EDUCATION-SUPERINTENDENT OF SCHOOLS EDUCATIONAL PROGRAM IN THE URBAN MIXED-USE (UMU) ZONE LOCATED AT 532 AND 601 S. LEWIS STREET Commissioners Glasgow, Willits, Martinez, Simpson all disclosed they met with the applicant and staff. Vidal Marquez, Assistant Planner provided an overview of the project consistent with the staff report. Pat McCaughey, Vern Burton, and Nadine Reynoso approached on behalf of the Orange County Superintendent of Schools and explained the proposed school operations. Chair Glasgow opened the public hearing. Peter Zwickorowski, general partner of the City Plaza Apartments spoke in opposition of the project. Doug Keys, City of Orange Transportation Analyst, explained the findings of trip generation analysis prepared by the applicant of the proposed use. Chair Glasgow closed the public hearing. A motion was made to adopt a resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3088-19 approving the operation of an Orange County Department of Education-Superintendent of Schools Educational Program in the Urban Mixed-Use (UMU) Zone located at 532 and 601 S. Lewis Street. CEQA exempt.
