PROJECT DESCRIPTION
The Superintendent of Schools of the Orange County Department of Education proposes to occupy
the existing office building co support persoruiel and to operate an educational program known as
ACCESS {Altemative, Cammunity, and Correctionai Educational Schools and Services). The
ACCESS program affers year-round educational services to students througho�t the county referred
from county service agencies and the 27 schaal districts. The prapasal at this location will operate
two ed�cation programs,a community day school and independent study.The community day school
pragram will serve 7-12 grades and the independent study program will serve students at the age of
18-25. There will also be adult independent study night classes until to 5:00 PM. A complete
brealcdown of classes is provided in Applicant Letter af Explanation {Attachment 3). In addition to
the proposed education programs, the remaining building will be accupied by administrative and
support staff. The applicant is requesting to conceptually have up to 500 students, 18 instructors and
66 staff. The education programs hours af operation are 7:34 AM-5:00 PM Monday to Friday with
night classes on specific days until 8:00 PM. The administrative staff hours will begin at 7:00 AM.

application. Therefore, a comparison of the building to existing development standards has not been

Required Findirrgs:

ANALYSISISTATEMENT OF TI3E ISSUES
Issue 1: School Attendance
The property was previously operating as a University for adult students by the farmer Argosy
University, approved by the Planning Commission under CUP Na. 2729-08 in 2009. Under CUP No.
2846-12 approved in 2013,the Planning Commission approved the restriction of 330 students and 25
facuity due to parking problems generated by the university's adult student drivers. The Department
of Education ACCESS Prograrn prapases ta operate a community day schooi program and the
independent study prograzn will serve students that will serve grades 7-12. There will also be adnit
independent study night classes through to 8:00 PM that will serve students at the age of 18-25. A
complete brealcdown of classes is provided in Attactiment 3 (Applicant Letter of Explanation}. The
applicant is requesting to cflnceptual�y have up to 540 enrolled students. Based on the schoal model
and operation details provicied by the applicant, not all students will be on the property at one time.
Far the community day school operations, classroom instruction will be all day between the haurs of
7:30 AM to 5:0�PM.The Pragram Administration expects an average of 150 students over the course
of any given day based on the average daily attendance. For the independent study students,they will
meet with the instr�ctor on an appointment-based education model for one-hour 1-on-1 and work
independently at home and return to schaol once a week for new assigr�nents.Conditian 8 wilI restrict
the number of students to no more than 300 of the 500 possible enrolled students who may be an-
campus at any given time. Finally, na K-12 instruction is praposed at this site.

Issue 2: Parkin�and Traffic
Based on the strict application of Orange Municipal Code, Table 17.34.060.B, the school wauld
require eight parking spaces p�r class, pius 4 spaces per 1,OOQ gross square feet of administrative
office. Based on plans and exhibits laheled Exhi�it A in the Planning Cammission staff report (date
stamped October 14, 2019}, the first floor proposes six classrooms and some minor office and
reception uses. The second floor proposes five classrooms of comparable size to those on the first
floor and the third floor is entirely dedicated to administrativelfaculty offices and storage. In total,
11 c�assraoms aze shown on the praposed floor plans which would require a total of 88 spaces to be
provided for the schoal.The third floor is approximately l 0,273 SF and the required parking for office
use is 41 spaces. A total of 139 parking spaces will be required to �e available for the schoal.
The site maintains a satellite parking lot consisting of 20 pazking spaces located to the north across
Lewis Street at 532 S. Lewis Street with the same owner that will be leased by the applicant. All
drop-off and pick-up will occur on the sc�ool property 601 S. Lewis St. and not in the City right-of-
way in accordance with plans and exhibits lab�led Exhibit A in the PIanning Commissian staff report
{date stamped Octaber 14, 2019). The majority of these students will nat be driving and will be
dropped offby parents and guazdians. The applicant has alsa restricted students driving ta the school
to only those over the age of l 8. Adult students wilI drive to the adult independent study classes for
1-an-1 one ho�r meetings schedule� weekly. Based on the applicant's projected average daily
attendance, Conditians $ & 9 are recammended ta limit the number af students to the applicant's
expected number and to allow the Community Development Director to request that the school
Administration provide a list of class schedules, student enrollment, and a parking count in the event
that staff observations or complaints are received regarding parking problems generated by�he schoal
prograir�. In the event that the information provided shows tha�a parking problem exists, the school
Administration shalI icnplement measures approved by the Community Development Director such
as class schedule modifications,to eliminate the parking problem.
The applicant has submitted a Trip Generation Comparison analysis to evaluate tl�e change in trip
generation that can be expected from the office land �se and the proposed schaol use. The analysis
evaluates the trips ta be generated based an the schoal instruction madel,the expected trips genera�ed
by student arrivals by private vehicles from parentslguazdians and alternative modes of transportatian
such as walking and public transit. There are nn shuttles or schaol buses associated with the operation
of the ACCESS Program.The applicant has also provided estimations that parentslguardians arriving
ta the school aze 55°/a af the trips and 16%of trips are from bus or public transportation and 29%are
from walking or biking. The operational characteristics af the schooi pragram demonstrate in the
report to show that not all classrooFns are utilized in a continuous manner and alI trips to the schaol
will not occur at one time during the morning period. In addition to Planning Division review, Public
Works Tr�c Divisian staff has reviewed the submitted Trip Generation Cornparisan (Attachment
4) and has no objectians to the methodology or conclusions in the report.

Issue 3: Surrenderin;�existin�entitiements
Staff is recarnmending the property owners to surrender the prior entitlements far the aperation of a
University for adult students by the farmer Argosy University. The praperty awners are in agreement
that the prior operator,Argosy is no lon�er in operation at the site and the lease is no longer in effect.
ADVISORY BOARD RECOMMENDATION
The City's interdepartmental Streamlined, MuIti-Disciplined, Accelerated Review Team (SMART)
considered the submittal on September 4, 2019 and recommended approval of the praject.

WHEREAS, the Planning Commission has authority per Orange Municipal Code (OMC}

WHEREAS, the application far Conditianal Use Permit No. 3088-19 was filed by the
applicant in accordance with the pravisions of the City of Orange Municipal Code; and
WHEREAS,the application for Conditional Use Permit No. 3088-19 was processed in the
tirne and rnanner prescribed by state and local law; and
WHEREAS, the application for Conditional Use Fermit No. 3088-19 is categorically
exempt from the provisians of the California Environn�ental Quality Act(CEQA)per State CEQA
Guidelines 15301 (Class 1 — Existing Facilities) since the project consists af permitting an
educatianal use in an existing office building and results in negligible or no expansion of the former
office use beyond that existing at the time of the City's determination; and
WHEREAS, on September 4, 2019 staff from interested departments reviewed the project
and determined that the project includes all necessary application materials and meets code
requirements to allow Flanning Commission review to occur; and,
WHEREAS, the Planning Commission canducted one duly advertised public hearing on
October 21, 2019 at which time interesteci persons had an opportunity ta testify either in support
of, or opposition to, the praposed project and for the purp�se of considering Canditional Use
Permit No. 30$8-19 upon property located at 532-601 S. Lewis Street as legally described in

NOW, THEREFORE, BE IT RESOLVED tt�at the Planning Commission of the City of
�range hereby approves Canditional Use Permit No. 3U$S-1 9 to establish a school located at 532-
601 S. Lewis Street based on the following findings:
SECTION 1—FINDINGS
General Plan Findin�:
1. The project must be cortsistent with the goals and policies stated withfta the City's General
Plan.
The Land Use Element of the City's General Plan encourages "a well-balanced cammunity,"
"one which provides a broad range of housing and business apportunities as well as
recreational, institutional and cultural activities that enhance the overall living envirnnment."
The proposed use, operating a school serving grades 7-12 and adult education within the
existing building an the subject property continues to provide an opportunity ta thase
residents desiring educational alternatives.
Conditional Use Permit
1. A carrditional use�ermit shall be granted upon sound principles of land use and in response
ta services required by the community.
Public educatinn facilities are one of the basic services required for any municipality to
provide to its residents. As such,the community as a whole benefits from both public and
private schools developed in canformity with the land use and development standards of the
Orange Municipal Code. Schools aze permitted pursuant to a Conditional Use Permit in the
Urban Mixed-Use (LJMU}zone, and are customarily found in both commercial and
residential areas. Th�proposed location of the school is consistent with the pattern of
development far both public and private schools throu�hout the city.
2. A conditional use permit shall rrot be granted if it will cause deterioration of bordering land
uses or create special problems for the area in which it is Iocated.
The proposed use will occur on a site that has already been serving as a private schflol,the
former Argosy University, where any po�ential impacts were analyzed and mitigated ta a less
than significant impact. The existing building and related site improvements previously
authorized are adeyuate to serve the current request to operate a school with a maximu�n of
300 students. Therefore the school in this circurnstance would not cause the deterioration af
the bardering residential land uses nor create special problems for the area.
The site is surrounded by a mix af residential,commercia!and religious institutionaI uses. The
site is adjacent to commerciai,rnulti-family residential and single family development.Schools
are permitted pursuant ta a Conditiona!Use Permit in the Urban Mixed-Use{UMU)zone, and
are customarily found in both commercial and residential areas. The proposed location of the

schaol is consistent with the pattern af development for both public and private schools
throughout the city.
The applicant has provided a trip generation report demonstrating that the proposed school use
will generate approximately 98 more daily trips than t�e existing office land use, including 65
more trips during the AM peak hour and 10 more trips ciuring the PM pealc hour. This forecast
does nat exceed 100 additional vehicle trips in either peak periods and nots not forecast ta
exceed 1,640 daily trips. All drop-off and pick-up wi�l occur an the school property 601 S.
Lewis St. and not in the City right-of-way. Parking is provided for an both 523-b01 S. Lewis
St. parking lots. The proposal wil� not impact the adjacent commercial and residential
praperties.
3. A conditianal use permit must he carrsidered in relationship to its ef_j''ect an the community or
neighborhood plan for the area in which it is lacated.
The existin� nei�hborhaod consists of an urban and d�veloped environmen�and the proposal
is consistent with the General Plan. There is na neighborhood ar community plan
specifically for the area, other than#he City's Ger�eral Plan. As proposed, the project will
have no detrimental effects on the neighborhood or surrounding businesses, as the site pIan
has been designed to contain all operational impacts to the praject site such as the drop-off
and pick-up areas occurring entirely on the subject property and nat in the public righ�-of-
way. Furthermore, the project has the potential to help the city meet its long-term General
Plan gaals as related to coordinated planning for school facilities within the city. The Land
Use Element encourages the distribution of parks, schaols, and churches throughout the City
near these types of residential neighborhoods. The proposed school at the subject property
will not affect the established neighborhaod or any long-range plan for this area.
4. A conditiortal use permit, if granted, shall he made subject to those cortditiorrs necessary to
preserve the general welfare, not the individual welfare of any particular applicatat.
Conditions have been included to insure that the schaol operates in a manner consistent with
the description provided by the applicant and in consideratian to prescrve the general welfaze
of the immediately surrounding residential neighborhoods. Conditions have been proposed to
address concems with the aperatians, sa as it not have an adverse ef�'ect on surrounding
properties and property owners.
SECTI4N 2—ENVIRONMENTAL REVIEW
The application for Canditional Use Permit No. 3488-19 is categorically exempt fram
the provisions of the California Environmental Quality Act(CEQA)per State CEQA Guidelines
15301 (Class 1 �-Existing Facilities) since the project consists of permitting an educational use
in an existing office building and results in negligible or no expansion of the former office use
beyond that existing at the time of the City's determination.

SECTION 3—SURRENDER OF EXISTING ENTITLEMENTS
The existing entitlements Conditional Use Permit No. 2729-08 and Conditional Use
Permit No. 2846-12 shall 6e surrendered in agreement with the property owner by written
author�zatian to the City.
SECTION 4—CONDITIONS OF APPROVAL
BE IT FURTHER RESOLVED that the following conditions are imposed with appraval
of Resolution No. PC 20-19 and Conditianal Use Permit No. 3088-I9:
1. The project shal! conform in substance and be maintained in general canfarmance with
plans and e�thibits labeled Eachibit A in the Planning Commission staff report(date stamped
October 14, 2019), including modificatians required by the conditions of appraval, as
approved by the Pla�ing Commission.
2. The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents
and employees from any and all liability or claims that may be brought a�ainst the City
arising out of its approvaI of this permit, save and except that caused by the City's active
negligence. The City shall prorriptly notify the applicant of any such claim, action, or
proceedings and shall cooperate fully in the defense.
3. The applicant shall comply with a1l federal, state, and lacal laws, including all City
reguiations. Vioiation of any of those laws in connection with the use will be cause for
revocatian of this permit.
4. Except as otherwise provided herein, this project is approved as a precise pIan. After any
application has been approved, if changes are proposed regarding the location or alteration
afany use or structure, a chan�ed plan may be submitted to the Community Develapment
Director for approval. If the Community Develapment Director determines that the
proposed change complies with the provisions and the spirit and intent of the approval
action, and that the action would have been the same for the changed plan as for the
approved plan, the Cammunity Develapment Director may a�prove the changed plan
without requiring a new public hearing.
5. Building permits shall be obtained for all constr�ction work, as required by the City of
Orange, Community Develapment Department's Building Division. Failure to obtain the
reyuired buiiding permits may be cause for revocation of this entitlement.
fi. These conditions shall be reprinted on the second page of the construction documents when
submitted to the Building Division far the plan check process.
7. If not utilized, project appraval expires twenty-four rnonths from the approval date.
Extensions of time may be granted in accordance with OMC Section 1'1.08.060. The

Planning entitlements expire unless Building Permits are pulled within 2 years of the
original approvai.
$. In conjunction with the operation of the schaol, no more than 300 of the SOQ possible
enrolled students may be on-carnpus at any given time.
9. In the ev�nt that City staff observes, ar complaints are received, regazding pazking
problems generated by the schaol,the Community Devel�pcnent Director may request that
the school provide a flaor plan of�h� facility and/or provide a list of class schedules andlor
provide a list of school enrollment andlor provide a pazking count. In the event that the
information provided shows that pazking problems exist, the schodl shall implement
measures approved by the Community Development Director such as class sch�dule
modifcations,ta eliminate the parking problem. Failure on behaif of the school to provide
the requested information may result in Conditional Use Permit revocation proceedings,
10. Any future expansion in area or in the nature and aperatian of the approved use by
Conditianal Use Permit No. 3488-19, including but not limi�ed an increase in student
enrollment, faculty, or building azea, shall require a new ar amended application as
required by the Orange Municipal Code.
11. In accordance with the aperation of the applicant's operations on the proj ect site,the SchpO�
may only operate weekdays between 7:30 AM and 5:00 PM,and the assaciated after hours
adult school program to 8:40 PM. The administrative staff hours may begin at 7:00 AM.
Exceptians for speciai events may be made with the prior written approval of the
Cornmunity Development Directar. Requests shauld be made in writing at least two weeks
prior to the e�ent.
12. The school shaIl aperate pick up and drop off of students in accordance with plans and
exhibits labeled Exhibit A in the Planning Commission staff report (date stamped Octaber
14, 2019}, as reviewed and approved hy the Planning Commission as part of this
Conditional Use Permit. No students shall be permitted to drive to the school at any time
for classes ar other school reiated activities other than adult students aver the age of 18.
In addition ta the above conditions,procedural requirements are contained in Attachment B�o this
resolution.

The ACCE55 Program serves as the center for educational leadership and coorciination
providing the broadest possible services for an a�erage of 3,000 students on a daily hasis
and nearly 6,500 students annually all of whom are referred to us by county service
agencies and Orange County's 27 school districts. ACCESS is a highly efFective program
that offers year-round educatianal options and service5 to students throughout the
county. Our student populatian is unique in that it encampasses a wide range of youth,
including students in group homes or incarcerated in institutions,students on probation
or homeless, students who are parents or working full-time, students participating in a
home schooling program, and students who are referred by local school district.
Students improve both their learning skills and their test scores, achieve course
completian, transition, and earn credits toward graduation. Our successful student's
transition back to their local schaal districts, higher education, or the wor�cforce and

location. We will be �perating a 7-12 grade education program along with an adult
independent study program for students ages 18—25. Not afl students will be nn site at
one time, it will depend on their education madel. There will he approximately 150
students enrolled in our community day schoal program, z58 students enrolled in aur
7-12 grade independent study program and approximately 8fi 5tudents enrolled in our
acfult independent study program. Overall,the possible number of students enrolled at
this school site is 494-5U0 students.
The average number of students attending our commu�ity day school program over the
course of any given day i5 approximately 170 students. This number is based on the
ADA (Average Daily AttendanceJ. The average n�mber of students attending our 7-12
grade independent study program o�er the course of any gi�en day is approximately 48-
50 students. Not all of the 48—50 studants are onsite at one time. 7here will be 8-10
student5 in attendance during the course of the entire day for each independent study

Staff escorts students off campus and remain in view until students are gane. Students

dismissal time, they may wait at the bus stop. Consequences for students disobeying

Our students are not allowed to drive to school with the exception of our adult 5tudents
over the age of 18. The majority of the students that will be attending this location are
drapped off and picked up by a parent or guardian, walk, bike, or come by public
transit. A copy of aur student drap off and pick up location5 are attached for your

Parking is only needed for staff members and students enroll�d in our adult independent

We will not!�e using the parking lot at 532 S. Lewis Street or 333 City Boulevard West
which includes a shuttle because our K-12 students don't drive, 3�oth parking lots
aren't necessary.

educational program is compatible with existing use and will nat create significant noise,

No incarcerated students will be served at this site. !t is the respansibility of ail staff that are on
site to supervise all of the students, while the students are on the school site. All students,
including probatian referred stuclents will be supervisecf by teschers, support staff, and
administrative staff. The teacher to student ratio for classrooms is no more that 25:1.
Paraeducatars are located in the classrooms afong with the t�acher ta help with super++ision and
instruction. Other support skaff include: Titie 1 tutors, Family Community Liaisons, Transition
Specialists, Counselors, Reading Specialists, TOSA's {Teacher on Special Assignment),

The ACCESS Program has a Comprehensi�e Site Saf�ty Committee that is comprised af
representatives from every schaol arsa and a law enforcement representative from the Orange
County Sherif�'s Department. The Orange County Sheriff's Department wiEl act as a connection to
the community and serves as a liaison between Orange County Department of E�ucation's
ACCESS and the local police department assaciated with e�ery ACCESS school site. For the
proposed schflol that would be located at 6D1 Sou#h Lewis, in the city of Orange; the Orange
County Sheriff's Department will id�ntify and connect us to the Isad individual within the Orange
Police Department who will be our designated repr�sentative. In the event that any schaol related
situation arises, that would require law enforcement personnel; the school will contact
the representative from the Orange Police Department as their primary source far emergencies.
3) Will the proposed schoof location be an apen campus where staff, students are free to enter
and exit the property during the day or lunch period?
The schoo! does not have an open campus for students. None of aur school sit�s has an open
campus for stude�ts. All students are to remain on the campus firom when they arriv� until the
end of their instructional day. Schaol staff are allowed to lea�e the campus during their [unch
period only after supervision of students is secured.
4) Will students access the properry during breaks or lunch?
The school will par#icipate in the National School Breakfast and Lunch Pragram. Our students
will be served breakfast, lunch and snacks on the school site. No studenks are allowed to leave
campus until reEeased at the end of their instructional day. Exceptions to this would b� if a need

Independent study is designed to provide each pupil with an educationaf alternative to classroam-
based instruction with flexibility with class scheduling.
With this in mind, ind�pendent study is used in ACCESS as an aptional educationaf alternative to
classraom instruction, availahle t� students from kindergarten through high school, and adult.
The intent is to respanci to various students' sPecific educational needs, interests, aptitude and
abilities.
Students in independent study courses are under the general supervision of certificated
�mploy�es (teachers} of the Orange County Department of Educatian as opposed to direct
supervision by certificated emplayees (teachers} ir� a c[assroom-3�ased course. In independent
study, certifica#ed �mp{oyees {teachers) anc! each pupil are required to communicate and meet
in p�rsan, by telephone, or by any other live visual or audio conr�ection no less than once �er
wEek, per cafendar rr�onth, to assess whether each pupif is making satisfactary educational
progress.
Assessrnent of satisfa�tory educational progress is made during their schedufed individual weekly
meetings. This assessment of a student's educatiana! progress includes, but is not limited to,
applicable statewide accountability measures and the completion of assignments, exam'tnations,
ar other indicatars that evidence that the pupil is warking on assignments, learning required
concepts, and progressing toward successful completion of the course, as determined by the
certificated employee (teacher) providing the independent study course. Courses o�fered in
inde�endent study are consistent in rigor and educational quality as equivalent classroom-based

Stud�nts enrolled in classroom-based courses participate in cours�s each day in a classroom
setting far the minimum tatal of ciaily instructional minutes required pursuant to California
EducatEon Code, 240 instructional min�tes per day. Students taking classes through independent
study are gi�en course wor�C to complete outside of a classroom based setting, equivaEent ta the
combined weekly instructianal minutes for classroom-based courses of 120Q minutes. This is
equi�alent to the time that a studen# would spend in classroom-based courses for a week.
For purposes of this application, what is typically called an independent study classroam is, in a
practical context, an affice where the teacher makes an assessment of a student's educational
progress in c�urses pro�ide through independent study. Classroom basec� courses are offered
in a classroom in the traditional sense, where students physically participate and recei�e
instr�ctian for a given set of instructional minutes each day.
Explanation of Open Area Room 206 and 2U7
The Area 206 designated as open is re-designated as offices. This space will ha�e nine (9} staff
memhers in a cubical style setting. We will not be building offices. The function of these staff
members is to enter student informatian, data and records in the 5tudent Information System.
This staff is comprised of seven (7y Program Data Technicians and two (2) Student Recards
Technicians.

There are approximately fi�teen (15) Support staff housed at this site who provide direct senrices
to studer�ts enrolled at this site as well as students off site that are �nrolEed and attending
educational programs at ather ACCESS schoal sites. The amount of time spent on site or at other
sites is dependent on the staff's caseload. The office space pro�ides them with a base site to do
the office work and ta connect with administration and other staff. Staff includes:

The number of students projected to arrive per hour is dependent on tFre time af day #hat the

classes. Arrival time is staggered for cammunity cfay school students. Some studenks will arriv�
for community day school classes that begin at 8:00 a.m., other students will arrive for cEasses
that begin at 9:a0. We are projecting approximately seventy (75) cammuniry day school students
arriving per hour at the school site. There are thre� (3) primary means that students use ta go ta
the site. They either walk/bicycle/skateboard, take public transportation (bus} or are dropped off

Education Code 51241-51242 allows counry office of education to waive the P.E. requirement if
certain conditions have occurred in a student's educational history. Students eligible and
authorized to waive the physical educakian waiver would not be enrolled in physical education
classes at this site.
If a student is not eligible for the wa�ver, then they woufd complete the academic portian oi the
P.E requirement in a P.E. course whi�e attending class on the site. Academic instruction includes
but is nat [imited to Physiology, physical fitness concepts, principles and strategies to impro�e
health and performance, etc.
The physicaf activity portion of the physical education requirement would be completed by the
student off the school site, such as at a gym, athletic club, or community center. . 1n order for the
student to compleke and rec�ive credit for the physical activity portion of the class �erification of
participation in a physical activiry is required to be verified by a designated adult, such as
prafessional trainer or other authorized adult.
The ACCESS Program does not offer extra-curricular activities such as school dances, grad night,
sports activities, etc.

evaluate the change in trip generat'on that can be expected between the exist"ng office building(existing land
use)and the 601 5. Lew�s 5treet Project(proposed project).
PROJECT DESCRIPTI�N
The Orange County f7epartment af Education (OCDE)�s proposing to lease the existing 31,�16 square foot
office building located at ba1 S. Lewis Street in the City of Orange to aperate their ACCESS (Alfernative,
Cornmunity, and Corre�t'onal Educatian 5c�ools and Services) Program. Figure 1 shows the project location
map and Figure 2 exhibits the praject site plan. The fallowing description of operational characteristics is
based on infarmation provided by OCDE.
Prosram Descrintion
i�he ACCE55 Program serves as the center for educational leadership and coordination providing the broadest
passible services far an average oF 3,OQ0 students on a daily basis and nearly 6,500 students annually; al4 of
whom are referred to OCDE by counry service agencies and Orange County's 27 school districts. ACCESS
is a highly effective prograrn that offers year-round educa�ional options and services to students throughout
the county. The student populatian is unique in that it encompasses a wide range of youth,including students
in group homes ar incarcerated in institutions, sfudents on probat�on ar homeless, students who are parents
or warking Full-time, students participating in a home schooling pragram, and studenEs who are referred by
the lacal school district. Students improve both their learning skills and their test scores, achieve course
completion, transikion, and eam credits toward graduatian. 7he successFul students transition back to their
Iocal school districks,higher education,or thn workforce and become praductive members of their community.
Instruction Model
Stud�nts will participate in ane of two education programs: day schools, also known as "Community Day
Schaol" in a classroom setting prouding instructian in all subjects for a minimum of 240 minutes as outlined
by California �ducatian Code or contract learning also known as "Independent 5tudy", in wh;ch st�dents

There will be approximately 41D studenEs receiv�ng education ser�ices at this lacation.The ACCESS Program
propo5es to operate a 7th-12th grade educat:or�pragram along with an adult independent study program for
students ages 18 - 25. Not all students will be on site at one time as it w�ll depend on their educatian mode4.
7here will be approximately �.70 students enralled in the Community Day School Program, 207 students
enrolled in the 7th-12fh Grade Independent Study Program, and approx`mately 33 skudents enrolled in the
Adult Independent Study Program.�verall,the possible number of students enrolled at this school site is 410
students.
The average number af 5tudent5 attending the Community Day School Pragram aver the course of any given
day is appraximately 170 students. 7his numher is based on the ADA(A�erage Daily Attendance).The average
number of students attending our 7t�-12th Grade lndependent Study Program over th�course oE any given
day i5 approximately 40 students. Not all of tF�e 40 skudents are an-site at one time. �here will be eight(8)
students in attendance during the course oF the entire day for each Independent 5tudy Program teacher.
Approximately one ta two students per hour will actua�ly be on-site a� ��e time per each aF the five (5)
fndependEnt 5tudy Pragram teachers.The Adult Independent Study Program operates the same as the 7th-
12th Grad� Independent Study Program. The Adult Independent 5tudy Frogram wiil have six(6)students on
average attending two cla�ses with tnree (3)students on average per teacher each day.�his number is also
based on the ADA{qverage DaiEy Attendance).
The schoal prQgram will operafe w;th six (6) Community Day Schoal Program keachers, five (5) 7th-12th
Independent Study Program teachers and two(2)Adult Independent Study Program teachers.
The praposed program will afso employ approximately 5fi administraEive staff at this location.Staff will consist

5:00 PM. It has been assumed that the 22 office staff at this location for the enEireEy of the business day,all
22 go aff-site for lunch araund 12:00 Noon and retum prior to 1:00 PM.
Operating Hours
Both ACCESS school programs will operate 244 days per year. 5chool hours will be fram 8:D0 AM to 5:00
PM Monday through Friday with the possibility af night classes on specific days until 8:00 PM.Admir�istration
hours will he 7:30 AM to 5:00 PM Monday through Friday, except when night classes are in operation to
provide administrative coverage through 8:40 PM.
The Community Day School Program wi�l have a staggered schedule with approximately half of the 170
students attending classe5 From$:00 AM to 12:00�M,and the ather half attending classes from 9:00 AM to

Students are not al;owed to drive ta school with the ex��pt'on of adult students over the age of 18. The
majority of the students that will be attending this location are drapped aff and picked up by a parent or
guardian, walk, b'ke, or come by pubiic Eransif. Consequences for students disobeying this rule range from
parent notification, i�hau5e suspension,detentions, notificatian of prohatian,and suspensiar�from school.
Parking is only needed far staff inembers and students enrolled in the Adult Inde�endent Study Program;
therefare, the proposed clevelopment wi:i not be using the parEcing lot located at 333 City Boufevard West.
The project applicant has agreed with the property owner at 532 S. Lewis 5treet(City Office�.P.}for use oF
the 20 parking spaces located at this site.There are t�mes when meetings are held with parent5 and if they
drive, parking wi�l be available. Usually meekings are he d in the evening when parking demand is low.
The project site plan {Figure 2) shaws the pick-up/drop-aff route far parents/guardian5. Parents/guardians
will drive south on Lewis Street entering the r►orth project driveway.They wilf proceed east alo�g the drive
aisle adjacent to the building's narth fa4ade. Near th� eastern terminus of this drive aisle adjacent to the
building's north fa�ade will be a drop-aff/pick-up location. Once StUdents are dro�ped-off/picked-up,
parents/guardians will then head north circling the parking lot and exiting onfo Lewis 5treet thraugh the 5ame
north praject driveway that they previously entered.
5ite Selection
The location, size, design, and operation characteristics of the property at 601 S. Lewis 5treet meet the
established criteria Eor ACC�SS educakianal centers. Their educational program is compatible with the existing
land use and they will he occupying the entire huilding. Approximately 9,360 square feet wilk be used for
classrooms.The remaini�g space will be used for support and administrakive use.
Canditional IJse Permit No.2846-12 was in place for tF�e prape�ty's last pre�ious ottupant,Argosy Un;ver5ity,
which vacated the property on or before December 31,2Q18 when their lease ended.
LAND USE COMPARISON
The existing land us�is a 31,116 square faot of�ice huilding previously occupied by Argosy Univers;ty.OCDE
is propasing to lease th�existing office building to aperate their ACCESS Pragram for 410 students.

land use quantity.As shown in Tahle 1,the existing project site land u5e{per current entitlements)is eskjmated
to generate appraximafely 303 daily trips,including 36 trips during the AM peak hour and 36 trips during the
PM peak hour.
p�iOPOSED PRO��CT TRlP GENERATION
5ince tf�e proposed project daes not�urrction in a similar operation to that af the traditianal schools in�lucled
in the !TE Trip Generation Manual, the trip generation for this project has heen determined based on the
operational charackeristics described above. 7he project applicant has pravided the operating hours far the
various activities, number af students, teachers, and office staff, and mode of transporf based on surveys oF
s'milar location5. Table 2 compiles this information and shows ti�e nurnber of students/teath�rs/affice staff,
aperating hours of each activiEy,and anticipated arrival/departure schedule.�'he data is broken down ta shaw
the number of persons arriving and departing the project site per hour.The data provided in Table 2 is then
used to identify t�e AM peak hour, PM peak hour,and daily trip generation shown in Ta51e 3.
According to the project applicant, survey5 of the student populatian at similar facilities operated by OCDE
ind�cate�he Following transpartatio�made split:

■ Public transportation(bus)= 169'Q
• Drop-off/Pick-up by private vehicle = 55%
Thus, 45% of skudents arrive/depatt via al�ernative modes of transpart. OCTA Route 47 stops at the
intersection of 5. Lewis Street/Lampson Avenue, which is located within 1,Q00 feet of the project building.
�CTA Route 47 provides service between Fullerton and Newport Seacn, with major stops including the
Fullerton 7ransportation Center,The Outlets at Orange Area,Orange Coast College,and the Balboa PeninSula.
As shown in Table 3, the proposed project is forecast ta generate approximately 4fl1 daily vehicle trips,
including ?01 vehi�ie trips during the AM peak hour and 46 vehicl�trips during the PM peak hour.
TRIP GENERATION COMPARISON
Table 4 shows the difference in project site trip generation between the exi5ting land use and the proposed
praject.As Sl�awn in Table 4, the proposed praj�ct is forecast to generate approximately 9B more daily trips
than the existing entitled land use,including 65 more trips during the AM peak hour and �0 more trips during
the PM peak hour.
PROPOSED PitOJECT TRIP D�57R1BUTiON AND ASSIGNMENT
Figure 3 and Figure 4 show the forecast directional outbound and inbound distribution paEterns for t�e project
generated trips. The praject trip distribution patterns are based on a detai°ed analysis of student enrollment
by city provicied by the praject applicant.

required For a pro;ect that meets any of the follawing criEeria:

the proposed development.
■ Projects on the Arterial Highway 5ystem which generate 1,60p Average Daily Trips(AD'1').
■ Projects that will add 51 or mare trips during either the AM oT PM pea[c hours to any intersection.
� Any project where variations fram the standards and guidelines pravided in this manual are being
proposed.
The praposed develapment is forecast to generate approximately 9$more daily trips than the existing entitled

AM peak ho�r the intersectian af Lewis Street at Lampson Avenue/Metropolitan Drive is projected for 25
AM peak hour trips ((70 AM peak hour inbound trips x 40� inbound trip distribution) + (-5 AM peak hour
outbound krips x 7095 outbound trip distribution}). During the AM peaK hour the intersection of Lewis Skreet
at Garden Grove Baulevard is projected for 41 AM peak hour trip5 ((70 AM peak houT inbound trips x 6056
inbound trip distribution)�(-5 AM peak hour outbaunci trips x 30%outbound trip distribution}).The prapo5ed
development is forecast to generate less than 51 additianal PM peak hour trips.
Therefore, the proposed project will nat add 51 ar more acEditional trips during the AM or PM peak hour �o
th�n�ares� patential s�udy area intersections_
The proposed develapment i5 not proposing variations from City of Orange traffic impact analysis standards
and guidelines.
