A.P.N.: 386-151-02 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission approves Conditional Use Permit No. 3092-19 and Minor Site Plan No. 0953-18 for construction of a wireless communication facility on an existing church bell tower, located at 1130 E. Walnut Avenue based on the following findings: SECTION 1 – FINDINGS General Plan Finding: 1. The project must be consistent with the goals and policies stated within the City’s General Plan. The project is consistent with the goals and policies stated within the City’s General Plan Infrastructure Element in that the installation of a wireless communication facility will help to provide adequate telephone and data services in an area with demonstrated need for additional service. The project is also consistent with the goals and policies of the Land Use Element in that the facility is an appropriate accessory use for an institutional property and is designed to be adequately screened from adjacent properties and compatible with the existing architecture of the church campus. Conditional Use Permit Findings – Wireless Communication Facilities: 1. A Conditional Use Permit shall be granted only if the wireless communication facility can be installed and operated in a manner that preserves the aesthetic character of the portion of the community in which it is located. The location, design, and operation of the proposed wireless communication facility has been carefully considered and conditioned, such that it preserves the aesthetic character and Resolution PC 17-19 Page 3 of 7 integrity of the project site and surrounding community. The property is 3.6 acres and is developed with a church, school, and associated parking lot. The proposed structure- mounted stealth facility would be concealed within the church bell tower. Additional height of 5 feet 8 inches added to the top of the bell tower provides screening for the proposed antennas and preserves the materials and design character of the Mid-Century Modern church campus. Ground-mounted equipment would be concealed in a concrete block, stacked bond enclosure, in keeping with the Modern design of the campus. Potential construction effects on adjacent trees are addressed with requirements for tree protection, including fencing and monitoring by a certified arborist, in the Conditions of Approval. The proposed facility is unmanned and only has occasional on -site servicing of the facility. Service vehicles will use the existing on-site parking spaces, which exceed in number the total required for existing church and school uses on the property. The wireless communications facility will not create noise or other negative effects within the neighborhood. 2. A Conditional Use Permit shall not be granted if it will cause deterioration of aesthetics for the area in which it is located. The proposed antennas will not cause deterioration of properties bordering the project site, nor cause special problems for its surrounding area because the design of the wireless communication facility is compatible with the Modern design of the existing church campus and is appropriately screened from adjacent residential neighbors. The additional height added to the bell tower to screen the antennas will not negatively affect neighboring properties, because the closest residential neighbor is more than 145 feet from the bell tower. In addition, the potential construction impacts on adjacent trees are addressed through tree protection measures in the Conditions of Approval. 3. A conditional use permit shall be granted if it can be found that the distance separation standards between ground-mounted wireless communication facilities precludes the wireless supplier from providing service. The proposed wireless communication facility is located approximately 0.75 miles from the nearest existing wireless facility for this provider. It would enhance and improve the coverage and capacity for the area. Minor Site Plan Findings: 1. The project design is compatible with surrounding development and neighborhoods. The project is compatible with the Modern character of the property in that it limits removal of original materials from the tower and replicates the design features in new screening. The requested increase in height is minimal in proportion to the existing tower and the proposed design of the screening allows the height increase to blend in appropriately with the church campus and the surrounding area. The large distance between the facility and adjacent properties also ensures that it will not negatively affect the surrounding neighborhood. 2. The project conforms to City development standards and any applicable special design guidelines or specific plan requirements. Resolution PC 17-19 Page 4 of 7 There are no applicable special design guidelines or specific plan requirements for this property. The project conforms to City development standards, including parking and the allowance for additional height in a Single-Family Residential zone for a structure- mounted wireless communication facility through a Conditional Use Permit. 3. The project provides for safe and adequate vehicular and pedestrian circulation, both on- and off-site. The project does not change the property’s existing safe and adequate access and circulation for vehicles and pedestrians. 4. City services are available and adequate to serve the project. The project requires electrical service, which is available on-site. No other City services are envisioned to be needed to accommodate the project. 5. The project has been designed to fully mitigate or substantially minimize adverse environmental effects. No adverse environmental effect is identified. The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15303 (Class 3 - New Construction or Conversion of Small Structures) and is designed, with the Conditions of Approval in this Resolution, to address potential effects on the environment from construction or operation of the facility. SECTION 3 – ENVIRONMENTAL REVIEW The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15303 (Class 3 – New Construction or Conversion of Small Structures) because the project consists of the installation of a new wireless communication facility within an existing bell tower with a minor increase in the tower’s height to accommodate appropriate screening of the facility. There is no environmental public review required for a Categorical Exemption. SECTION 4– CONDITIONS OF APPROVAL BE IT FURTHER RESOLVED that the following conditions are imposed with approval: Community Development Department – Planning 1. The project, including operation of the antennas and ground equipment, shall conform in substance and be maintained in general conformance with plans and exhibits labeled __________ including any modifications required by conditions of approval, and as approved by the Planning Commission. Any future expansion in area or in the nature and operation of the use approved by CUP No. 3092-19 and MNSP No. 0953-18 shall require an application for a new or amended Conditional Use Permit and Site Plan Review. 2. Except as otherwise provided herein, this project is approved as a precise plan. After any application has been approved, if changes are proposed regarding the location or alteration of any use or structure, .a changed plan may be submitted to the Community Development Director for approval. If the Community Development Director determines Resolution PC 17-19 Page 5 of 7 that the proposed change complies with the provisions and the spirit and intent of the approval action, and that the action would have been the same for the changed plan as for the approved plan, the Community Development Director may approve the changed plan without requiring a new public hearing. Should the modifications be considered substantial, the modifications shall be reviewed and approved by the Planning Commission. 3. These conditions shall be reprinted on the first or second page of the construction documents when submitted to the Building Division for the plan check process. 4. The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents and employees from any and all liability or claims that may be brou ght against the City arising out of its approval of this permits, save and except that caused by the City’s active negligence. The City shall promptly notify the applicant of any such claim, action, or proceedings and shall cooperate fully in the defense. 5. CUP No. 3092-19 and MNSP No. 0953-18 shall become void if not vested within two years from the date of approval. Time extensions may be granted for up to one year, pursuant to OMC Section 17.08.060. 6. Building permits shall be obtained for all construction work, as required by the City of Orange, Community Development Department’s Building Division. Failure to obtain the required building permits may be cause for revocation of this entitlement. 7. Prior to issuance of building permits for the project, the applicant shall pay all applicable development fees, including but not limited to: City sewer connection, Orange County Sanitation District Connection Fee, Transportation System Improvement Program, Fire Facility, Police Facility, Park Acquisition, Sanitation District, and School District, as required. 8. At such time as the antennas authorized by this permit are no longer in use, all antennas and improvements associated with the site shall be removed from the premises and the tower shall be rebuilt to its original design, height, and materials within 90 days after discontinuation of use. 9. In accordance with City of Orange Municipal Code Section 17.12.025.B.5, any owner of a wireless communication facility and any person or entity leasing property for a wireless communication facility shall provide written notification to the City of the discontinuance of the use of a wireless communication facility for wireless communication purposes for any period longer than thirty (30) days. The notice shall state the date the use was discontinued and shall be addressed to City of Orange Community Development Director, 300 E. Chapman Avenue, Orange, CA 92866 and shall be placed in the United States mail within thirty-one (31) days of such discontinuance. 10. Any excavation associated with the project shall be conducted with the following tree protection measures in place, consistent with the Tree Inventory and Tree Protection Report prepared by Davey Resource Group, dated August 2019: a. When digging will be conducted within the Tree Protection Zone (TPZ), the area of the TPZ outside the work area shall be fenced to avoid soil compaction. Resolution PC 17-19 Page 6 of 7 b. Tree Protection Fence as seen in the Tree Protection Plan shall be used. This may be field adjusted under the supervision of a Certified Arborist, or as directed by The City of Orange. c. Certified Arborist supervision is required for boring/receiving pits associated with trees #4-8 and facility construction near trees #9-16. d. Tree wrap shall be used where heavy equipment will be used within 5’ of a tree trunk e. The Certified Arborist shall be authorized to field adjust bore/receive pit locations when roots over 2” in diameter are encountered. f. All work performed in the TPZ of the trees to be retained shall be supervised by a Certified Arborist. g. All equipment shall be restricted to paved areas and not enter any soil, gravel or mulched area to avoid soil compaction. 11. Prior to issuance of a building permit associated with CUP No. 3092-19 and MNSP No. 0953-18, the applicant shall provide the City of Orange Community Development Department and Community Services Department with a copy of the applicant’s signed and executed contract with a Certified Arborist to provide construction monitoring services consistent with the condition of approval for tree protection (Condition No. 10). The Arborist shall be certified by the International Society of Arboriculture (ISA). Documentation of the certification shall be provided to the City of Orange Community Development Department and Community Services Department with the signed and executed contract. 12. The applicant agrees to hold a pre-construction meeting with the contractor, Certified Arborist identified in Condition No. 11, and staff from the Community Development Department and Community Services Department. The pre-construction meeting shall be held prior to the start of any excavation. City staff shall be provided with at least 48 hours notice prior to the meeting. 13. Prior to issuance of a Certificate of Occupancy, all landscaping improvements shall be completed according to the approved plans and to the satisfaction of the Community Development Director and the Community Services Director. 14. All landscape areas associated with CUP No. 3092-19 and MNSP No. 0953-18 shall be maintained in neat and healthy condition. Should any plant material die, the property owner/operator shall replace it with new healthy plant material to match the approved landscape plans. 15. Plans submitted for Building Plan Review shall compl y with the California Fire Code as amended b y the Cit y and as frequentl y amended and in effect at the time of application for Building Permit. 16. Prior to building permit issuance, construction plans shall show that all structures shall comply with the requirements of Orange Municipal Code (Chapter 15.52 Building Resolution PC 17-19 Page 7 of 7 Security Standards), which relates to the use of specific hardware, doors, windows, lighting, etc. (Ord. No. 06-18). Architect drawings shall include sections of the Ordinance that apply under “Security Notes”. An “Approved Products List 1/08” of hardware, windows, etc. is available upon request. 17. The area inside the entire lease area (inclusive of the enclosure area and adjacent areas) shall be kept clean of trash and debris at all times. 18. During installation, on-going normal operations, equipment maintenance, and any other maintenance on-site, the project shall be in compliance with the Orange Municipal Code Title 7 Environment - Water Quality and Storm Water Discharges. A copy of the code is available on the City’s website homepage under Municipal Code. Per Section W. of the City of Orange’s Land Use Application Checklist, the attached maps show the proposed facility’s location within the Applicant’s existing network and the gap that it is intended to fill. The attached maps also provide the location and coverage of all on-air sites operated by the Applicant within a one-mile radius of the proposed site. The facility is open to collocation to a future wireless carrier, who would enter a separate agreement with the property owner and design a facility that the bell tower can accommodate. Summary In May 2019,Davey Resource Group,Inc.(DRG)was contracted by Eukon Group,a SFC Communicaons,Inc.company –cerfied DBE WBE,to conduct a tree inventory and develop a tree protecon plan for the trees in the area of impact at 1130 E.Walnut Ave.Orange,CA.The request was made to assess the current condion of the trees and how the planned facility construcon, bore pits and pipe boring would impact the exisng trees. An Internaonal Society of Arboriculture (ISA)Cerfied Arborist from DRG conducted the evaluaon of forty-two (42) trees that may be impacted by future development.The trees were assessed by their locaon,size,current condion, and overall health.The current site survey was used to plot the crical root zones (CRZ)of the trees to help guide construcon opons to reduce potenal impacts on the trees. Tree condion was rated as good (19 trees),fair (14 trees),poor (14),crical (6)and dead (3).It was determined that the minimally invasive approach of boring under the root zones is unlikely to impact tree condion,and no trees are idenfied for removal due to the proposed construcon.Several trees may require removal at the property owners discreon due to crical or dead condion not related to construcon.Many of the trees will have minor impacts from construcon as test pits are required every me an exisng ulity is crossed.These small hand excavaons should be conducted under arborist supervision and field adjusted if roots over 2”in diameter are found.Heavy equipment should be restricted to paved areas and not on soil areas to avoid compacon. Introduction Background Eukon Group is preparing to provide bored-in underground power/fiber run below the area where tree roots are likely to be encountered.The lines will be bored underneath an exisng parking lot as well as the lawn area of a church.Each of bore and receive pits require excavaon.The City of Orange requires a tree inventory of any trees within the Tree Protecon Zone (TPZ).Per the City’s Ordinance,“Tree Protecon Zone is defined as that area within the drip line of a Protected Tree and extending to a point five (5)feet outside the greatest extent of the drip line,or fieen (15)feet from the trunk of a tree,whichever distance is greater.”In the unlikely event this acvity compromises a tree significantly,a removal or monitoring recommendaon will be made by the field arborist,and migaon can be arranged. Assignment This inventory is the first step in assessing which trees will require arborist supervision for bore pit excavaon and which trees are within the project area,but far enough from surface disrupon that they are not likely to be impacted. This inventory establishes the quanty and condion of trees in the project area.The condion of each tree was visually assessed, and the trees were photographed so that change in condion can be assessed if needed. The Tree Protecon Plans show where the proposed power/fiber runs will be located in relaon to the exisng trees, both on and off site.This Tree Protecon plan proposes tree protecon fencing and Tree Protecon Zones that should be established before construcon begins. Limits of Assignment Many factors can limit specific and accurate data when performing evaluaons of trees,their condions,and potenal for failure or response to site disturbances.No soil or ssue tesng was performed.All observaons were made from the ground on May 29th,2019,and no soil excavaon to expose roots was performed.The most recent development plans were available to assist in determining potenal construcon impacts.The determinaons and recommendaons presented here are based on current data and condions that existed at the me of the evaluaon and cannot be a predictor of the ulmate outcome for the evaluated trees in the future. 1130 E. Purpose and Use of Report The purpose of this report is to provide a summary inventory of all trees within the project area of impact,including an assessment of the current condion and health,as well as providing a tree protecon plan for all evaluated trees/canopies that may be impacted by construcon plans.The findings in this report can be used to make informed decisions on design planning and be used to guide long-term care of the trees.This report and detailed tree protecon plan can also be submied to the City of Orange for perming purposes. Observations Methods Only a visual inspecon was used to develop the findings,conclusions,and recommendaons found in this report. Data collecon included measuring the diameter of significant trees at approximately 54 inches above grade (DBH), height esmaon,canopy radius esmaon,a visual assessment of tree condion,structure,and health,and a photographic record.Numerical values were assigned to grade the aributes of the roots,trunk,branches,and foliage,including structure and health,and to obtain an overall condion rang.No physical inspecon of the upper canopy,sounding,root crown excavaon,resistance drilling,or other technologies were used in the evaluaon of the trees. Site Observations The project site is at a church at 1130 E.Walnut Ave.in Orange,CA.The trees are primarily located along the edge of a parking lot and in the front yard of the church. Tree Observations Forty-two (42)trees were assessed within the project area including eight (8)disnct species.The most common species were Canary Island pine ( Pinus canariensis ,15 trees),queen palm ( Arecastrum romanzoffianum ,8 trees)and sweetgum ( Liquidambar styraciflua,8 trees).Tree condion was rated mostly fair good (19 trees),fair (14 trees)to crical (6)poor (14)dead (3).Tree Diameters ranged from 4”to 29”with an average of 13”and heights ranged from 10’ - 75’ with an average of 38’. Analysis and Discussion The City of Orange considers the tree protecon zone (TPZ)as that area within the drip line of a Protected Tree and extending to a point five (5)feet outside the greatest extent of the drip line,or fieen (15)feet from the trunk of a tree,whichever distance is greater.For this project,DRG recommends a conservave root zone area calculaon standard as follows: The trunk diameters of the surveyed trees were used to illustrate the potenal crical root zone (CRZ)of each tree. The CRZ is considered the maximum possible radius of the root zone of a tree.The CRZ was calculated by mulplying the DBH by 1.5 feet.For instance,tree #1 has a DBH of 12 inches and a calculated CRZ of 18 feet (12 x 1.5).This distance may extend beyond the tree canopy dripline and is normally considered the tree protecon zone (TPZ).Tree protecon fencing is normally installed to protect the CRZ,but this would be prohibive for this project due to sidewalk, parking lot and road access needs. Like the CRZ,the structural root zone was also calculated using a commonly accepted method established by Dr.Kim Coder in Construction Damage Assessments:Trees and Sites.In this method,the root plate size (i.e.pedestal roots, 1 zone of rapid taper area,and roots under compression)and limit of disrupon based upon tree DBH is considered as a minimum distance that any disrupon should occur during construcon.Significant risk of catastrophic tree failure exists if structural roots within this given radius are destroyed or severely damaged.The SRZ is the area minimal or no disturbance should occur without arborist supervision.Both the CRZ and SRZ for the surveyed trees are illustrated in Appendix C. Conclusion and Recommendations Tree preservaon is possible for all inventoried trees,understanding that any tree with significant construcon impacts to the tree roots may require addional monitoring.Tree protecon measures will be implemented by several different measures including the following: ●When digging will be conducted within the TPZ,fence the area of the TPZ outside the work area to avoid soil compacon. ●Use suggested Tree Protecon Fence as seen in the Tree Protecon Plan.This may be field adjusted under the supervision of a cerfied arborist, or as directed by The City of Orange. ●Arborist supervision required for boring/receiving pits associated with trees #4-8 and facility construcon near trees #9-16 ●Use tree wrap where heavy equipment will be used within 5’ of a tree trunk ●Field adjustbore/receive pit locaons when roots over 2” in diameter are encountered. ●All work performed in the TPZ of the trees to be retained should be supervised by a Cerfied Arborist. ●All equipment shall be restricted to paved areas and not enter any soil,gravel or mulched area to avoid soil compacon. Following construcon,the trees should be monitored monthly by a Cerfied Arborist,or as determined by the City of Orange,to ensure the condion and structure of the tree do not decline over me,or become hazardous.If a change in state is observed,the Arborist should recommend migaon measures,which may include,but are not limited to, increased monitoring, pruning, general plant health care, or removal. 1 Dr. Kim D.
