Some attendees expressed a preference for a rotating mayor rather than a

■ Some attendees thought having a say on both the mayor and a councilmember
allows for one district to be overrepresented

The total costs associafed with :the transition from at-large eletions to district=based
: elections is unknown at this time, however, staff estimates.the costs could:exceed several
hundred thousand dollars. A request for appropriation of funds.will be presented to City
Council when the estimate becomes precise.

6. DISCUSSION AND BACKGROUND
In April 2019, the City Council adopted Resolution No. 11155 to initiate the, transition to
district-based elections. A critical component of that process is establishing district
boundaries.. As part of that process, the City conducted two community meetings in June

to receive input from the public related to considerations pertaining to the composition of
district boundaries.
At tonight's meeting, City Council will receive a report from the NDC, City's hired
demographer, regarding input received at the two community meetings. Meeting minutes
and notes are included for each of the meetings as Attachment B for the June 13, 2019
meeting and as Attachment C for the June 26, 2019 meeting.
The next step in the districting process is for the City Council to adopt a resolution that
indicates a list of criteria to guide the establishment of electoral districts. Based on
feedback received from the community meetings, legal requirements, traditional
districting criteria, and the unique circumstances of the City of Orange, Attachment A is
proposed Resolution No. 11178 that lists the draft criteria, which can be summarized as
follows:
1. Districts shall be equal in population
2. Boundaries shall not be gerrymandered
3. Boundaries shall not result in a denial or abridgement of the right of any citizen to
vote on account of race or color
4. Boundaries may take into consideration communities of interest
5. Boundaries may consider compactness
6. Boundaries shall contain contiguous territory
7. Boundaries may observe topography and geography
8. Boundaries shall be created using whole census blocks
The proposed resolution also reflects the intent to create six City Council districts, while
retaining the voter-approved directly-elected mayor. Further, the resolution indicates the
intent to implement district-based elections beginning with the November 2020 City Council
elections.
Utilizing established criteria, demographic statistics, and community input, the next step
in the process is to direct the demographer to create draft maps. The public is still
encouraged to submit feedback and proposed maps. Mapping tools were available at
both community meetings and continue to be available to the public at the city's website
or by calling the City Manager's office. Spanish translation was offered at both community
meetings, and all information on the website is available in English and Spanish. The
deadline for members of the public to submit maps is August 1, 2019. As such, all
proposed draft maps, both created by the public and the demographer, will be available
on the city's website for public review no later than August 20, 2019.
It is anticipated draft maps from the demographer will be presented to the City Council for
their review and feedback at the Adjourned Regular August 27, 2019 meeting. The
proposed resolution sets the deadline of August 29, 2019 for submission of any amended
maps the public would like the City Council to consider at its September 10, 2019 public
hearing. It is anticipated that the City Council will select the map establishing electoral
districts at that time.

WHEREAS, on Apri123, 2019 the City Council of the City of Orange ("City") adopted
Resolution No. 11155, stating its intention to adopted district-based elections pursuant to
Elections Code section 10010, Government Code section 34886, and the California Voting
Rights Act; and
WHEREAS, at the March 2, 1976 General Municipal Election, the voters of the City
of Orange determined by majority vote to change the City's electoral system to thereafter
directly elect a mayor for a two-year term; and
WHEREAS, the City has retained an experienced demographer and special legal counsel
to assist the City in establishing a by-district electoral system; and
WHEREAS, the City held public hearings on June 13, 2019 and June 26, 2019 at which
the City, through its consultants provided information to the public about the districting process
and traditional districting criteria and received information from the public regarding the
composition of the districts; and
WHEREA�S, the City Council has also received public comment concerning the
composition of districts by other means including by email and written submissions directly to
the City, and/or its consultants; and
WHEREAS, the City Council has fully considered the presentations of its consultants and
a11 of the public comments received; and
WHEREAS, the City Council now wishes to adopt criteria to guide the establishment of
electoral districts consistent with legal requirements, including reasonably equal population and
Section 2 of the federal Voting Rights Act, and which address other concerns and considerations
important to the City; and
WHEREAS, the City Council also des�res to take into account the purposes of the
California Voting Rights Act in determining the sequencing of elections in the new electoral
districts and to take into consideration areas of the City which have not had a resident elected to
the City Council in recent elections, including the southwesterly portion of the City (generally
south of W. Sycamore Ave. and west of Main St.); and
WHEREAS, the City has made available on its website materials, including an online
mapping program, that are designed to enable members of the public to submit proposed district
maps for consideration by the Council; and
WHEREAS, pursuant to Resolution No. 11155, staff proposed to the City Council a
timeline for development and consideration of draft maps, which timeline was received by the
City Council as proposed; and
WHEREAS,to facilitate analysis by the City's demographic consultant of maps proposed
by members of the public, and full consideration of such proposed maps at the public hearing
scheduled for September 10, 2019, the Council wishes to adopt a deadline for submission of
amended maps from the public to ensure their consideration.
NOW, THEREFORE,BE IT RESOLVED, the above recitals are true and correct; and
BE IT FURTHER RESOLVED,that the City shall consider draft electoral district maps
with six City Council persons and a directly-elected mayor consistent with Government Code
section 34886 and the electoral system approved by the voters in March 1976; and
BE IT FURTHER RESOLVED, that the City Council hereby adopts the criteria
identified in Exhibit A to this Resolution as criteria to guide the establishment of electoral districts
to be implemented beginning with the November 2020 City Council elections; and
BE IT FURTHER RESOLVED, that the numbering of the criteria 4 through 9 shall not
be construed as a prioritization of such criteria; and
BE IT FURTHER RESOLVED, that the City's redistricting/demographic consulting
firm, acting under the supervision of the City Manager, is hereby authorized and directed to
formulate one or more electoral district plan scenarios based upon the criteria speci�ed in Exhibit
A for review by the public and by the City Council at three public hearings (or more if necessary),
in accordance with the timeline received by the City Council; and
BE IT FURTHER RESOLVED, that the City's redistricting/demographic consulting
firm, acting under the supervision of the City Manager, is hereby authorized and directed to

Speci�cation of Criteria to Guide the Establishment of Electoral Districts
1. The boundaries of the electoral districts shall be established so that the electoral districts
are equal in population as defined by law.
2. The boundaries of the electoral districts shall not be gerrymandered in violation of the
principles established by the United States Supreme Court in Shaw v. Reno, 509 U.S. 630
(1993), and its progeny.
3. The boundaries of the electoral districts shall be established so that the electoral districts
do not result in a denial or abridgement of the right of any citizen to vote on account of
race or color as provided in Section 2 of the federal Voting Rights Act.
4. The boundaries of the electoral districts may take into consideration communities of
interest as identified in public comment or identified by the city council, including,but not
limited to social interests;educational,industrial or service industry interests;various types
of residential and commercial areas, homeowner and mobile home park associations, the
location of city facilities and historical sites and areas, and the like, insofar as practicable.
5. The boundaries of the electoral districts may consider compactness, insofar as practicable.
6. The boundaries of the electoral districts shall be created to contain contiguous territory,
insofar as practicable. A district shall not be determined to be non-contiguous within the
meaning of this criterion on the sole basis that its parts are connected through the
incorporated territory of another jurisdiction or unincorporated islands within the
boundaries of the City that are not part of the City.
7. The boundaries of the electoral districts may observe topography and geography, such as
the existence of hills,flat land,wooded lands,waterways,man-made geographical features
such as highways, major roadways, canals, other jurisdictional boundaries, etc., as natural
divisions between districts, insofar as practicable.
8. Unless otherwise required by law,the electoral districts shall be created using whole census
blocks, insofar as practicable.
9. The boundaries of the electoral districts shall comply with such other factors which become

• By adding the numbers up, in order to keep communities together, there may have to be 2
additional districts. There needs to be enough residents in each district

• Q: Are there any requirements for how long a candidate has to be living in the district in
order to run for that district? Answer: Normally only 30 days. Has to be registered to
vote in that district on the day they file papers
• Q: How much is the process costing the city? Answer: It depends on how long this
processtakes
• Is the census going to cause a re-do or will there just be an adjustment to the districts
instead of going through this whole process again? It's hard to determine now without
knowing the information. The City will not have to, but the CC could decide to.
• Q: Would it be helpful to know zone's within the districts as some areas will have more
development? Answer: That information could be looked at by the City
• Q: How will new developments (Town and Country) be counted since it's in the process
of being built and that population will not be part of the 2010 census information.
• Q: Will this process have an impact to the 2019 special election? Answer: That process
will go on as planned and it's an answer that has to be answered by the politicians
• Q: Is there a best practice for establishing the number of districts? Answer: State law has
a default of 5 with one seat being an "at large" mayor. To go with more districts would
require a charter.
• Q: Will the current council be unseated? Answer: Each council member remains on
council until term is up

factor in the districting boundaries? Answer: It's hard to predict if the project will be
build or not, but they can work with city to determine if that information should be made
available.
• Comment: Main Place needs to be considered due to new apartments being build.
Answer: That does not apply currently because this is based on 2010 census. .
• Q: What if we want more than 4 districts? Answer: that can be submitted in map
drawings, in order to be shared, and/or contact the City.

• NDC has worked with 200 cities that have switched from an at large system to a by
district system
• Each district resident will select one member to be on the City Council to represent their
district.
• NDC works with so many cities because of the California voting act
• By-districting is designed to help communities to achieve representation
• The City of Orange is not the only city that has gone through this process. Other cities
that have gone through this are Santa Ana, San Diego, School Districts and over 125
other cities are going through by districting at this time
The reason cities go through this process:
• No other city has won this type of lawsuit
• Cities that have fought the lawsuit have resulted in multimillion dollar payouts
• The most recent case in Santa Monica, the plaintiff requested 23 million dollars in the
settlement
The requirements for this process are:
• We are legally obligated to hold two community meetings during districting process
• You are given maps without any lines drawn, so you can review the maps and draw your
own districts
• You can submit your comments in writing to NDC or the City of Orange
• This meeting is held to give residents the opportunity to give the City feedback
What should be considered when drawing districts on a map
• The information with the criteria in districting was reviewed
Federal Laws—Equal Population
The district needs to have an equal amount of people
Traditional Districting Principles
Communities of Interest
Compact
Contiguous
Visible
• Districting should be easy to understand
The information was reviewed to advise what is relevant for districting:
• You must look at majority of eligible voters
• Maps that are available show both the Latino/Asian population
• Supreme court has no description to define community of interest
• Consider where you go to school, shop,roads you drive
• We are looking for your input as to what would be a district that would work
• Draw the streets you think would be a part of your neighborhood
• Some communities of interest would like to be broken up so they would have
more than one Council member for their area
Options of how to submit a map for City Council review were given:
• Maps available are in English and Spanish
• You can express opinion in writing

The online map tool was reviewed in detail and information on how to submit a map was given.

Community Conversation with maps began at 7:49pm
Attendees broke up into groups and had discussions on communities of interest
Meeting came back in session at 8:18 pm
The following are comments from the community meeting attendees
• East Orange and North Orange originally was thought to be together but a resident drove
the city and she no longer thinks are should be together.
• Don't consider topography alone.
• Important for everyone to be accountable,but the main neighborhood is Orange
• Everyone needs to have a say in all districts
• We would want everyone represented; Chapman University has grown and has brought in
lots of people
• The Outlets of Orange need to be considered
• Separate districts because we are such a large city
• Four districts are too few; people in Old Towne and Chapman University and people in
East Orange
• There are different ways of life and different issues throughout the City of Orange. North
Orange residents do not have anything in common with East Orange "Horse area.' North
Orange area deals with homeless issues
• 55 freeway should be considered as a boundary for a district
• Four districts with a Mayor makes sense and this would give voters an opportunity to
vote for a Mayor and Councilmember
• Orange Park acres, north Orange and Old Towne need to be considered
• We have to figure out how many districts we will have
• All areas need to be represented
• A rotating Mayor and expand to six districts
• 7 districts may be too many
Response from Justin Levitt and questions from attendees at 8:39pm
• Government code allows General Law Cities like Orange a rotating Mayor, and to
expand to six districts.
• You would need to be a Charter city in order to have seven districts, which Orange is not
a Charter City.
• Q: How long of a comment can you leave for the Council review? Answer: You can
submit as long of a comment as you would like to NDC or directly to the City.

• Q: Can you email the Council? Answer: Yes you are able to email the Council your
comments.
• Q: City Attorney was asked if this case has gone before the judge?Answer: A settlement
conference is scheduled in May of 2020.
• Q: Is there an option to remain at large and not go to by-districting?Answer: The City
Council adopted a resolution to move to by-districting and we are moving in that
direction.
