SUBJECT . Second Amendment to Agreement with Annealta Group for field inspection services for the Building Division of the Community Development Department. 2. SUMMARY Currently, the Building Division is understaffed with Combination Building Inspectors due to a vacancy left open by an employee on long term disability. Staff is continuing to experience a large number of inspection requests. This contract amendment will continue to augment our existing staff with the use of professional consultants through the end of October 2019 to maintain service levels. 3. RECOMMENDED ACTION Approve the amendment to agreement with Annealta Group in the amount of$66,000 for building inspection services and authorize the Mayor and the City Clerk to execute on behalf of the City. 4. FISCAL IMPACT The total expenditure for this amendment is $66,000 and will be funded through General Fund (100). 5. STRATEGIC PLAN GOALS Goal 1: Provide for a safe community d. Assure the development of the City occurs in a fashion that maximizes public safety. Goal 4: Provide outstanding public service b. Provide facilities and services to meet customer expectations. 6. DISCUSSION AND BACKGROUND There continues to be a need to utilize the services of professional consultants to assist staff with the inspection of structures for compliance with local ordinances and state laws pertaining to the building code. Due to a vacancy created by an employee on long term ITEM 3 . �� � 05/14/2019 disability, recruitment for the position had been placed on hold. It was determined in April 2019 that recruitment could begin to fill the vacancy. This request is for contract building services while the recruitment efforts are underway to assist staff during this busy period until the position is filled. The original and first amendments to the agreement with Annealta provided staff support for the vacant Combination Building Inspector through May 30, 2019. The second amendment will cover the cost of continuing the staff support through the end of October, 2019. Staff recommends approval of the Second Amendment to Consultant Services Agreement with Annealta Group. 7. ATTACHMENT • Second Amendment to Consultant Services Agreement with Annealta Group ITEM 2 05/14/2019 AGMT No. 6476.B.2 SECOND AMENDMENT TO , CONSULTANT SERVICES AGREEMENT THIS SECOND AMENDMENT TO CONSULTANT SERVICES AGREEMENT (the "Second Amendment") is made and entered into as of ,2019,by and between the CITY OF ORANGE, a municipal corporation ("City"), and ANNEALTA GROUP, a California corporation("Consultant"),with reference to the following: A. City and Consultant entered into that certain Consultant Services Agreement (Agreement No. 6476.B) dated as of December 18, 2018 (the"Original Agreement"); B. City and Consultant amended the Original Agreement by that certain First Amendment to Consultant Services Agreement, dated as of February 12, 2019 (Agreement No.6476.B.1) (the "First Amendment"). The Original Agreement and the First Amendment are incorporated herein by this reference; and C. City and Consultant desire to further amend the Original Agreement to modify, amend and supplement certain portions of the Original Agreement. NOW,THEREFORE,the parties hereby agree as follows: Section 1. Defined Terms. Except as otherwise defined herein, all capitalized terms used herein shall have the meanings set forth for such terms in the Original Agreement. Section 2. Cross-References. City and Contractor hereby agree that all references in the Agreement or this Second Amendment to the "Agreement" are deemed and construed to refer to the Agreement, as implemented by this Second Amendment. Section 3. Compensation. The total not-to-exceed compensation for the services to be rendered as set forth in Section 2.a of the Original Agreement, as amended by the First Amendment, is increased by SIXTY-SIX THOUSAND DOLLARS and 00/100 ($66,000.00) and is hereby amended in its entirety to read as follows: "Consultant's total compensation for all services performed under this Agreement, shall not exceed ONE HUNDRED EIGHTY-SIX THOUSAND DOLLARS and 00/100 ($186,000.00) without the prior written authorization of City." Section 4. Integration. This Second Amendment amends, as set forth herein, the Original Agreement and the First Amendment and, except as specifically amended hereby, the Original Agreement and the First Amendment shall remain in full force and effect. To the extent that there is any conflict or inconsistency between the terms and provisions of this Second Amendment and the terms and provisions of the Original Agreement and/or the First Amendment, the terms and provisions of this Second Amendment shall control and govern the rights and obligations of the parties. Electronic Plan Check programs enables applicants to submit Portable Document Files (PDF), as an alternative to submitting the required, application, construction drawings, and supportive documentation (i.e. structural calculations, soils reports, water supply tests, etc.) in the traditional paper form. Many cities are utilizing a variety of software programs to adopt this method as a means improve turnaround time and reduce time and cost for the applicant. City of Lake Forest— Building Official Mr. D'Zmura served as the contract building official with responsibility of managing the city's building & safety department. He provided building department administration, plan check, managed inspection and permit technician staff,and assisted residents and the development community with any inquiries or complaints.Attended meetings as needed and reviewed all building code updates for municipal adoption. City of Pomona— Building Official Mr. D'Zmura served as Public Works Director/City EngineedBuilding Official reporting directly to the City Manager. Charged with overall responsibility for managing and directing the engineering, public works and building safety divisions, Tim focused on ensuring the timely implementation of the City's capital improvement program and re- structuring the building safety division.
