1. SUBJECT
. Second Amendment to Agreement with Annealta Group for field inspection services for
the Building Division of the Community Development Department.
2. SUMMARY
Currently, the Building Division is understaffed with Combination Building Inspectors due
to a vacancy left open by an employee on long term disability. Staff is continuing to
experience a large number of inspection requests. This contract amendment will continue
to augment our existing staff with the use of professional consultants through the end of
October 2019 to maintain service levels.
3. RECOMMENDED ACTION
Approve the amendment to agreement with Annealta Group in the amount of$66,000 for
building inspection services and authorize the Mayor and the City Clerk to execute on
behalf of the City.
4. FISCAL IMPACT
The total expenditure for this amendment is $66,000 and will be funded through General
Fund (100).

6. DISCUSSION AND BACKGROUND
There continues to be a need to utilize the services of professional consultants to assist
staff with the inspection of structures for compliance with local ordinances and state laws
pertaining to the building code. Due to a vacancy created by an employee on long term

disability, recruitment for the position had been placed on hold. It was determined in April
2019 that recruitment could begin to fill the vacancy. This request is for contract building
services while the recruitment efforts are underway to assist staff during this busy period
until the position is filled.
The original and first amendments to the agreement with Annealta provided staff support
for the vacant Combination Building Inspector through May 30, 2019. The second
amendment will cover the cost of continuing the staff support through the end of October,
2019. Staff recommends approval of the Second Amendment to Consultant Services
Agreement with Annealta Group.

SECOND AMENDMENT
TO ,
CONSULTANT SERVICES AGREEMENT
THIS SECOND AMENDMENT TO CONSULTANT SERVICES AGREEMENT (the
"Second Amendment") is made and entered into as of ,2019,by and between the
CITY OF ORANGE, a municipal corporation ("City"), and ANNEALTA GROUP, a California
corporation("Consultant"),with reference to the following:
A. City and Consultant entered into that certain Consultant Services Agreement
(Agreement No. 6476.B) dated as of December 18, 2018 (the"Original Agreement");
B. City and Consultant amended the Original Agreement by that certain First
Amendment to Consultant Services Agreement, dated as of February 12, 2019 (Agreement
No.6476.B.1) (the "First Amendment"). The Original Agreement and the First Amendment are
incorporated herein by this reference; and
C. City and Consultant desire to further amend the Original Agreement to modify,
amend and supplement certain portions of the Original Agreement.
NOW,THEREFORE,the parties hereby agree as follows:
Section 1. Defined Terms. Except as otherwise defined herein, all capitalized terms
used herein shall have the meanings set forth for such terms in the Original Agreement.
Section 2. Cross-References. City and Contractor hereby agree that all references in
the Agreement or this Second Amendment to the "Agreement" are deemed and construed to refer to
the Agreement, as implemented by this Second Amendment.
Section 3. Compensation. The total not-to-exceed compensation for the services to be
rendered as set forth in Section 2.a of the Original Agreement, as amended by the First Amendment,
is increased by SIXTY-SIX THOUSAND DOLLARS and 00/100 ($66,000.00) and is hereby
amended in its entirety to read as follows:
"Consultant's total compensation for all services performed under this
Agreement, shall not exceed ONE HUNDRED EIGHTY-SIX THOUSAND
DOLLARS and 00/100 ($186,000.00) without the prior written
authorization of City."
Section 4. Integration. This Second Amendment amends, as set forth herein, the
Original Agreement and the First Amendment and, except as specifically amended hereby, the
Original Agreement and the First Amendment shall remain in full force and effect. To the extent
that there is any conflict or inconsistency between the terms and provisions of this Second
Amendment and the terms and provisions of the Original Agreement and/or the First Amendment,
the terms and provisions of this Second Amendment shall control and govern the rights and
obligations of the parties.
IN WITNESS of this Agreement, the parties enter into this Agreement on the year and day
first above written.

✓ When notified,pick up plans at the City or we will provide an equivalent method to receive plans.
✓ Review plans for code compliance and return them within the timeframe requested,generally 10 business
days for new submittals and 5 business days for resubmittals measured from the day of initial notification.
✓ Be able to provide expedited plan review in shortened timeframes when requested to do so by the city. If
there is an increased cost to the city for expedited review,that fee shall be identified in the fee proposal.
✓ Certain plans identified by the city may only require review for specific issues,for example,structural
requirements only or access compliance features only.Such reviews shall adhere to the same timeframes
as for a complete review.

city.All inspections will be performed for conformance with the California Building, Mechanical, Plumbing, Electrical,

Our inspectors are qualified to perform inspections on a wide-range of projects including residential, large residential
developments, commercial, industrial and mixed-use buildings.Their extensive knowledge and understanding of the
construction and building process helps to mitigate problems both in the field and in the office.They look for solutions
and collaboratively work with city staff and/or the public to resolve any questions or problems related to the building
code—all the while maintaining the integrity of the code for the safety of the public.
Inspectors will work closely with the City to perform inspections according to the city turnaround schedule, usually
within 24 hours or the next business day. Our staff is sensitive to schedules being maintained while providing a high
level of customer service to the community. Inspections will be completed on-time and in a thorough manner. Staff
will ensure all paperwork and processes adhere to city-established policies and procedures.When needed, staff will
always consult with the Building Official,or designee,when a clarification or interpretation is needed on a project. For
any project for which a resolution cannot be reached between the inspector and contractodhomeowner it will be
presented to the Building Official for final resolution.
In an effort to assist our clients with staffing challenges, many of our inspectors can also perform plan review and/or
assist at the front counter.
When inspection requests are made services will include, but are not limited to:
• Staff will perform high quality building/structural, mechanical, plumbing, electrical and combination
inspection of buildings and structures for conformance with the California Building, Mechanical, Plumbing,
Electrical,Green Building,Energy Codes and City Codes and ordinances.
- Staff will provide code enforcement inspection activities related to the enforcement of City and state codes
for existing construction.
■ Staff will perform inspections of landscape and irrigation installations, if needed, in accordance with the
City's Water Efficient Landscape Ordinance.
■ Inspectors will check the City's Inspection Line daily, and review permit package to verify that onsite
condition is consistent with the appropriate records.

■ Services will be provided in a customer-friendly, timely and professional manner. Inspections will be
provided on a same day or next day basis.
■ Our inspectors are competent and knowledgeable in construction materials, methods, codes and standards
in the field in which they are performing inspections. They are also competent and knowledgeable in the
principles of code enforcement.
■ Coordinate inspection services with other city or county departments, government agencies providing
seroices, etc. or when more than one discipline is required for compliance with building and safety codes
and regulations.
■ All assignments will be approved by the Chief Building Official, who we understand may terminate such
inspector assignments at any time.
■ Inspectors are ICC certified and/or have knowledge State Title 24 Accessibility regulations. CASp
certification personnel are also available,when requested by the city,for certain assignments.
■ All inspections will be completed on the workday following the receipt of the request for inspection and using
City-established policies and procedures.

Coffimunication
Our engineers and plans examiners will review and provide clear and unbiased comments and recommendations
related to code interpretations for all building projects. Our ultimate goal is for all structures to be safe and adhere to
all state and city guidelines. Final review and approval related to code interpretations are subject to the city's Building
Official and/or designated staff. Upon completion of a plan review, clear communication will be provided via written
comments and redlined plans. For plans that are not approved, a letter will be provided with a list of comments
referencing the applicable code sections along with concise detailed information to assist the client, designer,
contractor or owner to make the necessary adjustments.
■ Provide login access to our intemal tracking system so the City may track status of plan reviews
■ Maintain records related to all plans, calculation and documents received. We will provide, in the City's
approved format, a complete list of plan check comments referring to appropriate sheets, details or
calculations pages and the code section of concern. Plan review lists shall bear the stamp and signature of
a licensed engineer when required.

Electronic Plan Check Services
Annealta staff is experienced with a variety of electronic plan check software programs and can perform electronic
plan check if requested by the city. Electronic Plan Check programs enables applicants to submit Portable Document
Files (PDF), as an alternative to submitting the required, application, construction drawings, and supportive
documentation (i.e. structural calculations, soils reports, water supply tests, etc.) in the traditional paper form. Many
cities are utilizing a variety of software programs to adopt this method as a means improve turnaround time and
reduce time and cost for the applicant.

Annealta Group provides building inspection services, which include inspecting building/structural, mechanical,
plumbing, electrical and combination inspections of buildings and structures to ensure they are adhering to the
California Building,Mechanical, Plumbing, Electrical,Green Building, Energy Codes and City codes and ordinances.
City of Lake Forest— Building Official
Mr. D'Zmura served as the contract building official with responsibility of managing the city's building & safety
department. He provided building department administration, plan check, managed inspection and permit technician
staff,and assisted residents and the development community with any inquiries or complaints.Attended meetings as
needed and reviewed all building code updates for municipal adoption.
City of Pomona— Building Official
Mr. D'Zmura served as Public Works Director/City EngineedBuilding Official reporting directly to the City Manager.
Charged with overall responsibility for managing and directing the engineering, public works and building safety
divisions, Tim focused on ensuring the timely implementation of the City's capital improvement program and re-
structuring the building safety division. Department and budget restructuring resulted in the successful
implementation of nearly$2 million in annual operational savings.
• Coordination of all Building&Safety services including plan check, inspection and administration

In support of the building & safety division, Mr. Park performed engineering plan design review for entitlement.

effectiveness, and hydrology&hydraulics report. He performed Area Plans reviews with environmental assessment
including master roadway systems and master drainage systems with water quality measures. Coordinated with
developer and engineer to resolve engineering complex;provided the administrative process for subdivision project.

Permit Technician
Ms. Griffin seroed as a contract Permit Technician for a variety of clients and was responsible for all aspects of
managing the permit counter including; providing customer assistance to contractors, home owners and developers
for permit issuance for both residential and commercial projects.Assisted with plan reviews, provided estimates for
both permit and plan check fees and routing and tracking of all plans.Answered a variety of questions and handled
all complaints in a courteous and professional manner. She also developed a records management process to
ensure the most efficient tracking and administration of building permits, processed monthly reports and maintained
excellent communication between city departments
Representative CASp Experience
■ Temecula Valley Hospital (2014) — Provided CASp services for construction of the new 4 story hospital
with emergency and surgery centers. Project included in the project was extensive site work and parking.
Project Cost:$225,000,000.00
■ Liberal Arts 2, 3, 4 Renovation Project (2015) — Provided Executive management of the programming,
design and construction process and CASp inspections and ADA consulting. Project was a renovation and
seismic upgrade of the Liberal Arts complex.The addition of an HVAC mechanical system to the buildings
as well as an upgrade to the electrical infrastructure. The project built 23 smart active learning classrooms
for the campus as well as an extensive upgrade to the outdoor areas of the campus. Project Cost:

■ Orange County Children's Hospital- CHOC Tower II (2013) — Delivered CASp services throughout the
construction of the project and provided ADA design review. Project consisted of a new 7 story hospital

Mark brings 20 years of industry experience providing technical construction administration consulting,organizational
consulting and expert CASp/ADA/code analysis services for a variety of complex and diverse construction projects.
This includes the technical construction inspection of all aspects of the construction process with a specialty in
accessibility,to ensure that work is performed in accordance with approved contract documents, industry standards,
and governing building codes. He ensures all plans and specifications adhere to the latest code compliance as well
as constructability; and delivers clear and helpful comments to the applicant. He provides sustainability consulting

Bill Tarin I INSPECTOR
Bill brings more than 30 years of experience in building administration, plan checker, field inspector, code
enforcement, NPDES coordinator and public works project managerlinspector. He is proficient in managing entire

specific requirements. As an ICC building inspector, he is well versed in all aspects of residential, industrial and

Daniel is an experienced ICC certified professional who has cultivated more than 20 years expertise in the areas of

Coliseum Renovation, City Hall Earthquake Repair Project and the Oakland Firestorm Restoration Project(1991). He
