1. SUBJECT
First Amendment to Agreement with Annealta Group for field inspection services for the
Building Division of the Community Development Department.
2. SUMMARY
Currently, the Building Division is understaffed with its Combination Building Inspectors
and is experiencing a large number of inspection requests. This contract amendment will
continue to augment our existing staff with the use of professional consultants through
the end of the fiscal year while maintaining service levels.
3. RECOMMENDED ACTION
Approve the Amendment to agreement with Annealta Group for building inspection
services and authorize the Mayor and the City Clerk to execute on behalf of the City.
4. FISCAL IMPACT
The total expenditure for this amendment is $90,000 and will be funded through General
Fund (100).
5. STRATEGIC PLAN GOALS

6. DISCUSSION AND BACKGROUND
There continues to be a need to utilize the services of professional consultants to assist
staff with the inspection of structures for compliance with local ordinances and state laws
pertaining to the building code. This request is for contract building services while a
position is vacant due to an employee on medical leave. The proposed amendment will

assist staff during this busy period while the Building Division is not fully staffed by
providing a contract building inspector through June 30, 2019.
Staff recommends approval of the First Amendment to Consultant Services Agreement
with Annealta Group.

FIRST AMENDMENT
TO
CONSULTANT SERVICES AGREEMENT
This First Amendment to Consultant Services Agreement (the "First Amendment") is made
and entered into as of , 2019, by and between the CITY OF ORANGE, a
municipal corporation (the "City"), and ANNEALTA GROUP, a California corporation (herein
referred to as the "ConsultanY'), with its principal office for purposes of this First Amendment at
4952 Warner Avenue, Suite 227, Huntington Beach, California 92649 and with reference to the
following:
A. The City and the Consultant entered into that certain Consultant Services Agreement
(Agreement No. 6476.B) dated as of December 18, 2018, which is incorporated herein by this
reference (the "Original Agreement"); and
B. The City and the Consultant desire to amend the Original Agreement to modify,
amend and supplement certain portions of the Original Agreement.
NOW, THEREFORE, the parties hereby agree as follows:
Section 1. Defined Terms. Except as otherwise defined herein, all capitalized terms
used herein shall have the meanings set forth for such terms in the Original Agreement.
Section 2. Cross-References. The City and Consultant agree that all references in this
First Amendment are deemed and construed to refer to the Original Agreement, as implemented by
this First Amendment.
Section 3 Revised Scoue of Services. The Scope of Services, Exhibit A to the Original
Agreement, is hereby amended, modified and supplemented to include the services described on
Exhibit A attached hereto and incorporated herein by this reference.
Section 4 Compensation. The total not-to-exceed compensation (exclusive of
reimbursables) set forth in Section 2 of the Original Agreement for the services to be rendered
thereunder was the sum of THIRTY THOUSAND DOLLARS and 00/100 ($30,000.00). Section 2
of the Original Agreement is hereby amended to provide for an increase of NINETY THOUSAND
DOLLARS and 00/100 ($90,000.00) in the total not-to-exceed compensation such that the
Consultant's total compensation under the Original Agreement, as amended by this First Amendment
shall not exceed ONE HUNDERED TWENTY THOUSAND DOLLARS and 00/100 ($120,000.00)
without the prior written authorization of the City.
Section 5. Integration. This First Amendment, the agreements specifically referred to
herein, and all attachments hereto (if any) integrate all of the terms and conditions mentioned herein,
and supersede all negotiations with respect to the subject matter hereof. This First Amendment
amends, as set forth herein, the Original Agreement and, except as specifically amended hereby, the
Original Agreement shall remain in full force and effect. To the extent that there is any conflict or
inconsistency between the terms and provisions of this First Amendment and the terms and
provisions of the Original Agreement, the terms and provisions of this First Amendment shall
control and govern the rights and obligations of the parties.
IN WITNESS of this Agreement, the parties enter into this First Amendment on the year and
day first above written.

there is an increased cost to the city for expedited review,that fee shall be identified in the fee proposal.

Mr. D'Zmura served: as the contract building .official with responsibility: of managing the city's building & safety

Permit Technician
Ms. .Griffin served as a contract Permit Technician for,a variety of clients and was responsible for all aspects of
managing the permit counter including; providing customer assistance to contractors, home owners and developers
for permit issuance for both residential and commercial projects. Assisted with plan reviews, provided estimates for
both permit and plan check fees and routing and tracking of all plans. Msuvered a variety:of questions and handled
all complaints in_a courteous and professional manner. She also developed a records management process to
ensure the most efficient tracking and administration of building permits, processed monthly reports and maintained
excellent communication between city departments

• Temecula Valley Hospital (2014) — Provided CASp services for construction of the new 4 story hospital
� with emergency and surgery centers. Project included in the project was extensive site work and parking.

� Liberal Arts 2, 3, 4.Renovation Project (2015) — Provided Executive management of the programming,
design and construction process and CASp inspections and ADA consulting. Project was a renovation and
seismic upgrade of the Liberal Arts complex. The addition of an HVAC mechanical system to the buildings
as well as an upgcede to the electrical infrastructure. The project:built 23 smart active leaming classrooms
for the campus as well as an extensive up.grade.to .the outdoor areas of the campus. Rroject Cost:

Mark brings 20 years of industry experience providing technical construction administration consulting,organizational
