SUBJECT PUBLIC HEARING: Zone Change No. 1289-18 to expand an existing historic district overlay zone to add 12 properties on South Batavia Street to the local Old Towne Historic District. With the overlay zone, the City of Orange Historic Resources Inventory will,be updated accordingly to reflect the status of these properties. T. 2. SUMMARY The City of Orange is proposing to expand the boundary of the local Old Towne Historic District (Historic District) to include 12 properties in the 100 and 200 block on the west side of South Batavia Street. The Historic District boundary is currently the centerline of Batavia Street. Under Orange Municipal Code Chapter 17.17,historic district designation is processed as an overlay zone with protections for histbric resources added to the base zoning. 3. RECOMMENDED ACTION Approve for first reading Ordinance No. 12-18: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING A ZONE CHANGE TO EXPAND AN EXISTING HISTORIC DISTRICT OVERLAY ZONE TO ADD 12 PROPERTIES ON SOUTH BATAVIA STREET TO THE LOCAL OLD TOWNE HISTORIC DISTRICT AND UPDATE THE CITY OF ORANGE HISTORIC RESOURCES INVENTORY ITEM . GENERAL PLAN IMPLEMENTATION Cultural Resources Element Goal 1.0: Identify and preserve potential and listed historic resources, including buildings, structures, objects, sites, districts, and archaeological resources citywide. Policy 1.3: Provide long-term assurance that potential and listed historic resources will be used, maintained, and rehabilitated in conformance with SecretaYy of the Interior's Standards for the Treatment of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring and Preserving Historic Buildings (SecretaYy's Standards). Goal 3.0: Provide incentives and expand education efforts for historic preservation. Policy 3.2: Provide incentives to encourage and support historic preservation. Implementation Pro�ram I-19 Program I-19 of the General Plan Implementation Plan calls for maintaining and periodically updating an inventory of historic resources in the city. 7. DISCUSSION and BACKGROUND Local Old Towne Historic District The local Old Towne Historic District was established to recognize and protect the cultural and architectural history of Orange's late 19th and early 24th century commercial downtown and surrounding residential neighborhood. The Historic District consists of historic (contributing) buildings dating from the 1880s through 1940. The boundaries of the local Historic District were established in Ordinance No. 38-88, adopted by City Council in 1988,as"Batavia Street on the west,Cambridge Street on the east,Walnut Avenue on the north, and La Veta Avenue on the south, including the Nutwood Tract on the south side of La Veta Avenue. The boundaries of the Old Towne Area shall run along the centerline of the designated streets and the borders of the Nutwood Tract." In the City's 1991 Historic Resources Inventory, several houses on the west side of South Batavia Street were identified as historic resources. However, these houses were not included within the Historic District boundary and are not protected by design standards for the Historic District. ITEM 2 10109/18 Historic District Expansion Following Council direction in March 2018, Historic Preservation staff surveyed the properties in the 100 and 200 blocks of the west side of South Batavia Street. The survey found that these blocks of South Batavia Street contain a concentration of 12 properties dating from 1903 to 1940 and representing historical themes consistent with the existing Historic District. The houses first identified as historic resources in the 1991 Inventory retain their historic character and additional , houses not previously identified are also historic resources eligible for inclusion in the local Historic District. The two blocks have a high degree of historic integrity representing the same period of construction and architectural styles as properties within the Historic District. The properties to be added to the Historic District are: 134 S. Batavia Street 204 S. Batavia Street 140 S. Batavia Street 210 S. Batavia Street 152 S. Batavia Street 220 S. Batavia Street 158 S. Batavia Street 224 S. Batavia Street 164 S. Batavia Street 236 S. Batavia Street 176 S. Batavia Street 248 S. Batavia Street Of these 12 properties, 11 are contributing historic properties. The one non-contributing property (236 S. Batavia Street)�was constructed in 1963, outside of the period of significance for the Historic District (1888-1940). The non-contributing property was included within the proposed boundary expansion, because it occurs mid-block and is flanked by two historic properties that could be affected by major changes to the property. Maps in Attachment 1 —Exhibit B show the proposed new Historic District boundary. With expansion of the historic district overlay zone, the Historic Preservation Design Standards for Old Towne will apply to these properties, consistent with all properties in the Historic District. Changes to the exterior of the properties will be reviewed by staff or the Design Review Committee for conformance with the Design Standards. Expanding the boundaries of the Historic District protects these historic resources and the Historic District as a whole from incompatible changes that alter the character of the historic neighborhood. Contributing historic properties within the Historic District may use the California Historical Building Code to address building code requirements in a way that does not affect the character of the historic property. Contributing properties also are eligible to apply for Mills Act Contracts. Environmental Impact Zone Change No. 1289-18 to expand the historic district overlay zone is related to the public welfare and is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15308 (Class 8 — Actions by Regulatory Agencies for Protection of the Environment) and 15331 (Class 31 — Historical Resource Restoration/Rehabilitation). The overlay zone is established for the protection of historic resources and makes no changes to the land uses permitted by the base zoning. The regulatory process for projects within the historic district overlay zone involves review to ensure conformance with the Secretary of the Interior's Standards for the Treatment of Historic Properties (SOI Standards). The Historic Preservation Design Standards for Old Towne, required for projects within the Historic District, are consistent with and incorporate the SOI Standards. Expansion of the overlay zone ensures that additional ITEM 3 10/09/18 historic resources and the Old Towne Historic District as a whole will be preserved and protected from changes that may affect the integrity of its historic character, design, materials, and features. No environmental public notice is required for a Categorical Exemption. Public Outreach and Noticin� Letters were mailed directly to potentially affected property owners inviting them to participate in an informational meeting about the proposed Historic District boundary change on June 27 with Planning staff at the Orange Civic Center. A second letter was mailed on July 3 inviting property' owners to an additional meeting on July 12. Six property owners representing five affected properties attended the meeting on July 12. Staff also had phone conversations with two additional property owners. The meeting allowed City staff to present information on how a historic district overlay zone could affect properties and get property owner feedback on the proposal. Property owners asked questions about the requirements of the Historic Preservation Design Standards, design review for projects in the Historic District, the effects of the overlay zone on existing base zoning, and the Mills Act Program. The majority of property owners expressed support for the boundary expansion. Some property owners were neutral but did not express opposition to the proposal.No additional responses were received at the time of publication of this staff report. Public notice of the City Council hearing on the proposed zone change was published in the Orange City News newspaper on August 9, 2018. A total of 278 notices were mailed to the owners and occupants of affected properties and owners and occupants within 300 feet of the affected properties.Notices were also posted at the subject blocks of South Batavia Street,the Civic Center, and Library posting locations. Planning Commission Hearin� The Planning Commission reviewed the subject proposal and considered the entire public record at the August 20, 2018 public hearing. There were no public speakers at the hearing. The Commission recommended approval of the Zone Change to the City Council by a vote of 5-0. A copy of the approved resolution is provided as Attachment 2. The Planning Commission minutes are provided as Attachment 4. Council Action Zone Change No. 1289-18 expands a historic district overlay zone to add 12 properties to the local Historic District. The action includes updating the City's Historic Resources Inventory to include survey forms identifying the 12 properties. The survey forms are provided in Attachment 1 — Exhibit C. 9. The boundaries of the Old Towne Area shall run along the centerline of the designated streets and the borders of the Nutwood Tract"; and WHEREAS, Ordinance No. 15-98 amended the local Old Towne Historic District boundaries at Walnut Avenue and Waverly Street to match the National Register of Historic Places Old Towne Historic District,designated in 1998.As established in Orange Municipal Code(OMC) 17.17.030,the boundaries of the local Old Towne Historic District are delineated on a map on file in the Planning Division of the City of Orange entitled"Old Towne Boundaries"as adopted under Ordinance No. 15-98; and WHEREAS, OMC Chapter 17.17 establishes that"application for a historic district shall comply with the zoning amendment procedure for a change in the zoning district classification upon designation approval by City Council as prescribed under OMC Section 17.10.020"; and WIiEREAS, a historic district overlay zone includes additional regulations over the base zoning of a particular area to encourage historic preservation and complementary new development. The Historic Preservation Design Standards for Old Towne, incorporating the Secretary of the Interior's Standards for the Treatment of Historic Properties, apply to all properties within the boundaries of the local Old Towne Historic District; and WHEREAS, the City Council directed the Community Development Department Planning Division to proceed with expansion of the local Old Towne Historic District to include properties on the west side of South Batavia Street in March 2018; and WHEREA5, eight properties on the west side of South Batavia Street were identified as historic resources in the City's Historic Resources Survey completed in 1991; and ATTACHMENT NO. 1 DRAFT ORDINANCE 12-18 ZONE CHANGE NO. 1289-18 OCTOBER 9,2018 CC MTG WIiEREAS, the City Council adopted the City of Orange 2010 Historic Resources Inventory Update,including the survey results from 1991,through Resolution No. 10426 in March 2010; and WHEREAS, in April 2018, Historic Preservation staff, meeting the Secretary of the Interior's Professional Qualifications Standards for architectural history, surveyed the area and deternuned that the 100 and 200 blocks of South Batavia Street contain a concentration of intact historic properties constructed prior to 1940 that are eligible for inclusion in the local Old Towne Historic District; and WHEREAS, Historic Preservation staff conducted community information sessions for potentially affected property owners on June 27, 2018 and July 12,2018; and WHEREAS, the Planning Commission, having considered Zone Change No. 1289-18 at a public hearing held on August 20, 2018, including review of the staff report and having invited public testimony on the item, has determined the proposed amendment is justified and recommends approval thereof; and WHEREAS, the City Council held a duly advertised public hearing on October 9, 2018 for the purpose of considering Zone Change No. 1289-18 as it pertains to the expansion of the local Old Towne Historic District as shown in the attached Exhibits"A", "B", and"C". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: The existing local Old Towne Historic District is depicted on the map attached hereto as Exhibit "A" and incorporated herein by reference. The boundaries of the Old Towne Historic District are amended to include the 12 properties on South Batavia Street depicted on the map attached hereto as Exhibit"B" and incorporated herein by reference. The "Old Towne Boundaries"map adopted in OMC 17.17.030 is hereby amended to depict the change in the local Old Towne Historic District established by Zone Change No. 1289-18. The contributing and non-contributing properties within the expansion area are depicted on the map in Exhibit"B"and described in the historic resources survey forms attached hereto as Exhibit "C" and incorporated herein by reference. The City of Orange Historic Resources Inventory is hereby updated to include the historic resources survey forms attached hereto as Exhibit"C." The expansion of the Historic District's boundaries provides long-term assurance that additional historic properties will be used, maintained, and rehabilitated in conformance with the Secretary of the Interior's Standards fo� the Treatment of � Historic Properties (SOI Standards). Projects in the local Historic District are reviewed for conformance with the Historic Preservation Design Standards for Old Towne,which are consistent with and reference the SOI Standards. Inclusion in the local Historic District also provides access to incentives for preservation including the Mills Act Program and California Historical Building Code. Consistent with the General Plan Implementation Program for Historic, Cultural, and Archaeological Resources Surveys,the expansion of the Historic District's boundaries recognizes a small concentration of historic resources that reflects a unique sense of time and place and establishes a design review process for its protection. Historic District Criteria(OMC 17.17.050) An historic district may be established to preserve landmarks and areas exemplary of architectural, archaeological, cultural, economic, social, or historical value if the landmark or area meets the following criteria: A. The resource exemplifies or reflects special elements of the City's cultural, social, economic,political, aesthetic, engineering, architectural or natural history and possesses an integrity of location, design, setting, materials, workmanship,feeling and association; and 1. It embodies distinctive characteristics of a style, type, period or method of const�uction, or is a valuable example of the use of indigenous materials or craftsmanship; or 2. It contributes to the significance of an historic aYea, being a geographically definable area possessi�zg a concentration of historic or scenic properties o�� thematically related grouping ofproperties which contribute to each other and are unified aesthetically, by plan or physical development; or 3 3. It reflects significant geographical patterns, including those associated with different eras of settlement and growth, particular transportation modes, or distinctive examples of park or community planning; or 4. It embodies eletnents of architectural design, detail, materials, or craftsmanship that represent a significant structural or architectural achievement or innovation; or 5. It has a unique location or singular physical characteristic or is a view or vista representing an established and familiar visual feature of a neighborhood, community or the City of Orange. The local Old Towne Historic District embodies the cultural and architectural history of late 19�'and early 20th century Orange County.The Historic District represents the original residential community, central business district, and industrial area of Orange with historic buildings dating from the 1880s through 1940. The houses throughout the Historic District represent the popular residential architectural styles of the period,including Folk Victorian, Craftsman, Tudor Revival, and Spanish Colonial Revival. The 100 and 200 blocks of the west side of South Batavia Street contain a concentration of residences representing the themes of early development and growth of the City of Orange, consistent with the existing Historic District. The houses are distinctive examples of the architectural styles prevalent in the Old Towne Historic District. These blocks, combined with the east side of South Batavia Street within the Old Towne Historic District, have a high degree of integrity of design,setting,materials,workmanship,feeling and association. Of the 12 properties proposed for inclusion in the Historic District, 11 are contributing historic properties. The one non-contributing properiy was constructed after 1940, outside of the period of significance for the Historic District. Including these properties within the boundaries of the Old Towne Historic District will protect these historic resources and the Historic District as a whole from incompatible changes that alter the chazacter of the historic neighborhood. B. It is one of the few remaining examples in the City, region, state, or nation possessing distinguishing characteristics of an aYchitectural or historical type, or specimen; oY The 100 and 200 blocks of the west side of South Batavia Street are characteristic of the historical development and architectural styles of the City of Orange from the late 19th and early 20th centuries. This area is contiguous with and represents the same distinguishing characteristics and themes as the Old Towne Historic District, which is one of the few remaining intact historic downtowns from this period in Orange County. C. It is identified with persons or events significant in local, state or national history; or The Old Towne Historic Disixict was originally designated as a representation of the broad patterns of development in the history of Orange, rather than for its association with a specific event or person. This criterion does not apply. D. It is representative of the work of a notable builder, designer or architect. The buildings throughout the Historic District are vernacular examples of late 19th and early 20th century architectural styles and are rarely identifiable as the work of a specific builder, designer, or architect. This criterion does not apply. 4 SECTION IV: A summary of this ordinance shall be published and a certified copy of the full text of this ordinance shall be posted in the Office of the City Clerk at least 5 days prior to the City Council meeting at which this ordinance is adopted. A summary of this ordinance shall also be published once within 15 days after the ordinance's passage in a newspaper of general circulation,published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted ordinance along with the names of those City Councilmembers voting for and against the ordinance in accordance of Government Code Section 36933. Site Integrity: Opportunities The house is an excellent example of its architectural style. Appears individually eligible for National Register of Historic Places. History of Ownership: James M. and Emily D. Marsh, citrus ranchers, lived at the property from 1919 to 1922. Neil H. and Viva Edgar lived here in 1923. Mr. Edgar was part owner in Edgar and Hays Company in Santa Ana. In early 1924, they sold the house to Frank E. and Nellie Miles, and moved to 2302 Spurgeon in Santa Ana. Mr. Miles was a pioneer in the grocery business, and had operated grocery stores in Goldfield, Nevada and Pomona, California before coming to Santa Ana in 1913. He opened a new store there and soon had outlets in Orange, Anaheim, Fullerton and Garden Grove. He sold that firm after a few years, then started a new chain with stores in Orange, Anaheim and Fullerton and a bakery in Tustin. Around 1919, he sold out to Acme chain. Mr: and Mrs. Miles had a son, Frank E. Chapman. In 1932, another Miles, Glenn R. was also listed as a resident. He was an operator with Standard Stations, Inc. The Miles family lived here until 1933 when the financial pains of the Great Depression cost them the home. Mr. Miles retained his ranch in Lemon Heights, where he died in 1950 at the age of 73. In September of 1937, the house was purchased by Edwin Gould for $5,500. Gould had moved from Wisconsin and become the manager of the Anaconda Wire & Cable Company, Orange's first successful large-scale industrial plant. He was active in many social and fraternal organizations and also served on the Orange High School Board of Trustees. He lived in the house until he died at 67 in January 1963. His widow, Alma, continued to live here a£ter that. His son, Richard, was the proprietor of Orange Camera and Photo in the Plaza. Russell a prominent contractor and real estate entrepreneur, who built and sold houses throughout the Santa Ana and Orange areas. In 1941, Vera Wettlin purchased the house as her sole and separate property, where she lived with her husband David Wettlin and their children until 1954. From 1935 to 1954, Vera Wettlin served as the City of Orange Postmaster, a federally appointed position, and was the primary income earner for her family. She served as Postmaster during the dedication of the new Post Office at 308 W. Chapman Avenue in 1935. She was Postmaster when the Orange Post Office received first class office status, the highest class rating in the Postal Service, and was present at the first airmail drop in the City in the summer of 1946. Wettlin's position as Postmaster, her pro£essional and civic life, and her homeownership reflect the slowly increasing number of women in the workforce during the mid-twentieth century and the reality of women's roles as income earners and heads of households from the Great Depression through the 1950s. Wettlin was a member of a number of important Orange community organizations, including the Toastmasters and the Woman's Club, where she held the presidency for several terms. She was also an active member of the Orange Business and Professional Women's Club, where she served as Public Relations Chair in 1941. As a prominent member of the community, her home served as an important meeting place for these community institutions. The house retains the majority of its features from its construction in 1940 and through Vera Wettlin's ownership of the house, which ended when she sold the house the same year as her retirement in 1954. Opportunitles Appears individually eliqible for National Register. In October 1918, John W. and Gail C. Young purchased four acres of land at 224 S. Batavia. At that time, Batavia Street marked the western edge of the City limits, putting this property just over into county territory. South Batavia was then considered an upscale neighborhood, populated by gentlemen citrus farmers. In 1919, he built this house on his property and lived and ranched here for the next ten years. In 1929, the house and land was aquired by John J. and Ida M. Collins, another local citrus rancher. Born in Missouri, Mr. Collins had settled in Northern California in 1887 and in 1916 moved here. Collins continued to live in this house until he retired from ranching in the late 1940s. His son, Ray Collins, took over the groves at that time and movecl into the house. About 1940, the home was acquired by Judge French. David French became a resident of Orange in 1937 and served as City Attorney from 1946 until he was appointed to the Santa Ana/Orange Municipal Court bench in 1957 by Gov. Goodwin Knight. He was named to the Superior Court bench in August of 1966 and retired in November o£ that same year but seemed to serve an occasional assignment on the state judicial council. Among his other accomplishments was a term serving as trustee of the Orange Unified School District, secretary of the Orange County Municipal Water District and chairman of the Orange Red Cro'ss. A total of 278 notices were mailed to the owners and occupants of affected properties and owners and occupants of properties within 300 feet of the affected properties. Planning Commission Staff Report August 20,2018 Page 3 PROJECT BACKGROUND The local Old Towne Historic District(Historic District)was established to recognize and protect the unique buildings, features, and character of Orange's historic commercial downtown and surrounding residential neighborhood. The boundaries of the local Historic District were established in Ordinance No. 38-88, adopted by City Council in 1988, as "Batavia Street on the west,Cambridge Street on the east,Walnut Avenue on the north,and La Veta Avenue on the south, including the Nutwood Tract on the south side of La Veta Avenue. The boundaries of the Old Towne Area shall run along the centerline of the designated streets and the borders of the Nutwood Tract."In 1998,the boundary of the Historic District was revised on Walnut Avenue and Waverly Street to match the National Register of Historic Places Old Towne Historic District designated in 1997. The initial boundary was drawn to encompass roughly a square mile azound the Plaza, plus the Nutwood Tract. The centerline of Batavia Street is the western boundary of the Historic District. In the City's 1991 Historic Resources Inventory, several houses on the west side of South Batavia Street were identified as historic resources. However, these houses were not included within the Historic District boundary and aze not protected by design standards for the Historic District. Following Council direction in March 2018, Historic Preservation staff investigated the potential of expanding the Historic District to include the west side of South Batavia Street. In Apri12018, staff surveyed the properties in the 100 and 200 blocks of South Batavia Street.The survey found that the houses identified as historic resources in the 1991 Inventory retained their historic chazacter and that additional houses not previously identified could be considered historic resources eligible for inclusion in the local Historic District. Staff also surveyed properties in the 900 block of West Almond Avenue and the 100 block of South Citrus Street. However, there was not a sufficient concentration of historic properties in these blocks to justify including them in the Historic District. PROJECT DESCRIPTION The west side of South Batavia Street contains a concentration of historic properties representing the historical themes of eazly development and growth of the City of Orange, consistent with the existing local Old Towne Historic District. The City of Orange is proposing to expand the local Old Towne Historic District boundary to add 12 properties in the 100 and 200 blocks of South Batavia Street. Eleven of the properties are historic contributing properties. One property is non- contributing because it was constructed after the Historic District's period of significance (1888- 1940). Maps in Attachment 1 —Exhibit B show the proposed new Historic District boundary. Zone Change No. 1289-18 consists of a historic district overlay zone added to these properties to include them in the Historic District. APPLICATION(S)REQUESTED/REQUIRED FINDINGS Zone Change/Ordinance Amendment.Zone Change No. 1289-18 will expand the local Historic District boundary to include 12 properties on the west side of South Batavia Street. The historic district designation is a zone overlay added to the properties' base zoning. Required Findings: There are no required findings for an Ordinance Amendment or Zone Change since it is considered a legislative action. However, OMC Section I7.10.020 requires that when the Planning Commission makes a recommendation to the City Council, the Planning Commission include in its decision: 1) the reasons for the recommendation; 2)the relationship of the proposed amendment to the General Plan and applicable Specific Plans; and 3) the environmental deternnination. These three items are addressed in the Planning Commission Resolution. By adopting the Resolution, the Planning Commission will have complied with this Code provision. Historic District Designation (OMC 17.17.050). An historic district may be established to preserve landmarks and areas exemplary of architectural, archaeological, cultural, economic, social, or historical value if the landmark or area meets the following criteria: A. It reflects significant geographical patterns, including those associated with different eras of settlement and growth, particular transportation modes, or distinctive examples of park or community planning; or 4. It embodies elements of architectural desigrr, detail, materials, or craftsmanship that represent a significant structural or architectural achievement or innovation; or 5. It has a unique location or singular physical characteristic or is a view or vista representing an established and familiar visual feature of a neighborhood, communiry or the City of Orartge. The one non-contributing property was constructed after 1940,outside of the period of significance for the Historic District. The non-contributing property was included within the proposed boundary expansion, because it occurs mid-block and is flanked by two historic . properties that could be affected by major changes to the property. With expansion of the historic district overlay zorie,the Historic Preservation Design Standazds for Old Towne will apply to these properties,consistent with all properties in the Historic District. Changes to the exterior of the properties will be reviewed by staff or the Design Review Committee for conformance with the Design Standards. Expanding the boundaries of the Historic District protects these historic resources and the Historic District as a whole from incompatible changes that alter the chazacter of the historic neighborhood. Changes to interiors are not regulated by the Design Standards. The Design Standazds only apply when a property owner.is proposing a change to their home. They do not apply retroactively and do not require property ovmers to proactively make changes to their properties. Marissa Moshier, Historic Preservation Plartner provided an overview of the boundary expansion consistent with the staff report. Commissioner Simpson asked staff to explain the Council's initial direction on this matter of being in the Historic District and the Mills Act designations are to property owners. Ms. Moshier responded that Council directed staff to specifically look at the 100 and 200 blocks of Batavia due to the concentration of noteworthy historic residences and to bring forward a proposal for the expansion of the Historic District. Planning Commission August 20, 2018 She described the City's Mills Act program and the potential reduction in property taxes it offers. She also noted that in the Historic District the properties are allowed to use the California Historical Building Code which provides relief from the State's standard energy code and allows flexibility to preserve historic features that might otherwise be affected by the Standard Building Code. Commissioner Simpson asked why those particular properties were not originally included in the designation. Ms.Moshier responded that there is nothing specific in the record as to why the boundary was drawn at the centerline of Batavia. Her impression from reviewing the original Council resolution was that the City simply wanted to recognize a square mile around the Plaza.. She stated there are also a handful of historic resources around the edges of the local Historic District boundary that could also be considered for an expansion; however staff received specific direction from the Council to move forwazd with this particular boundary change at this time. Commissioner Correa asked why those particular homes were left out of the City's 1991 survey and registration. Ms. Moshier responded there are homes that are scattered throughout the City that are recognized as being historic resources and are included in the list of City's inventory. The homes on the west side of Batavia were part of that inventory; she's not sure why they were not included in the Historic District at the time that the boundary was created. Commissioner Correa asked what criteria are used to determine that a home is historic. Ms. Moshier responded that the Orange Municipal Code has a section related to Historic Districts which lays out specific criteria. Generally, they are properties that are related to history, an event, a person or is an important architectural style. In the Old Towne Historic District,the criteria are related to the early development of Orange as a town;and commercial downtown and the residential area�hat was developed in the 20th century. It is also related to the architectural styles that were prevaIent in the late 19th century and early 20th century. Commissioner Conea asked how Mills Act contracts are monitored,if there is a specific timeframe for the property owner to make renovations, and what the City does if the owner fails to meet his contractual obligations. Ms. Moshier responded that there is an exhibit attached to the Mills Act contract that sets a timeline for a specific set of repairs;at the beginning of the year a reporting form is mailed to the owners to ask them what has been done in the prior year; and State law requires staff to do an inspection once every five years. If a person fails to keep up with the agreement,staff works closely with the owner to bring them into compliance. If compliance is not met,the City Council has the authority to cancel the coniract and there is a 12'/z%penalty of the fair market value of the property if canceled;staff has never gotten to that point with any of the owners. Commissioner Willits asked what the historic building survey process consisted of. 3 , Planning Commission August 20,201 S Ms. Moshier responded it was a survey taEcen in the public right-of-way from the sidewalk, exterior building photographs and a written architectural description. A survey code is also assigned indicating . whether or not it is e(igible to be a contributor to the Historic Disfict. Commissioner Gladson confirmed that this is just a step to acknowledge that they are in the Historic District of Old Towne. Ms.Moshier stated there is one property that is separately listed in the National Register. Chair Glasgow added that as a non-contributor the owner of 236 S.Batavia St.needs to be made aware that he needs to follow the standards and realize what they can and cannot do. Chair Glasgow opened the public comment portion of the meeting;seeing no one approached he closed the public comment period. All of the Commissioners agreed this has been a long time coming and thanked staff for tying up the loose ends as these are alI beautiful homes and should have been included from the beginning. This proposed ordinance establishes a single Master Land Use Matrix, reorganizes existing Code content and serves to promote ease of use and elimination of redundancy. Limited new supplemental text is incorporated to clarify City policy regarding table content and incorporates supplemental text to clarify City policy regarding table content. LOCATION: CITYWIDE NOTE: The proposed Ordinance is not a project under the Califomia Environmental Quality Act (CEQA) pursuant to the definition of a project provided in Section 15378(b)(5) of State CEQA Guidelines because the activity undertaken is consolidation and clarification of existing land use tables and use standards text. The activity will not result in direct or indirect physical changes in the environment. (Z1500.0) Time set for a public hearing to consider Zone Change No. 1289-18 to expand an existing historic district overlay zone to add 12 properties on South Batavia Street to the local Old Towne Historic District. With the overlay zone, the City of Orange Historic Resources Inventory will be updated accordingly to reflect the status of these properties. Historic Planner Marissa Moshier provided the staff report. She noted that the majority of the property owners are in support of the boundary adjustment. (Continued from September 11, 2018) (Z1500.0) Time set for a public hearing to consider Zone Change No. 1288-18 to rezone select properties in the Nutwood Tract to Single Family Residential (R-1-6) and Office Professional (OP) to establish consistency with the Low Density Residential and Neighborhood Office Professional General Plan land use designations in accordance with state law. The subject Zone Change addresses certain properties presently developed with single-family residences on the 500-block of S. Orange Street and S. Grand Street between E. La Veta Avenue and E. River Avenue and a professional office at 503 S. Glassell Street. Associate Planner Kelly Ribuffo presented the staff report and answered Council's questions regarding the property at 225 E.River. If left out of the zone change,there would be an inconsistency between the General Plan and zoning. CommuniTy Development Assistant Director Anna Pehoushek explained that if the property was to be removed from the proposed zone change, Council could make a General Plan Amendment in the future in order to resolve the inconsistency.
