03.28 Declared Disasters Designated Agents1. SUBJECT Resolution No. 11061 — A Resolution of the City Council of the City of Orange designating agents to act on behalf of the City for declared disasters as required by the California Office of Emergency Services 2. SUMMARY The Governor's Office of Emergency Services (CalOES) requires that the City pass a Resolution to designate agents to act on behalf of the City for applications for financial assistance related to declared disasters. This Resolution will fulfill that requirement and allow the City to apply for reimbursement for its costs related to the Canyon Fire 2. 13. RECOMMENDED ACTION I Approve the Resolution. 4. FISCAL IMPACT This Resolution will allow the City to be reimbursed for its costs incurred as a result of the Canyon Fire 2. Those costs are estimated to be approximately $680,000. 1 5. DISCUSSION and BACKGROUND On October 9, 2017, City personnel responded to a wildfire known as Canyon Fire 2, which entered the City limits. The City's response included fire suppression, evacuations, including operating an evacuation center at El Modena High School, road closures and a full activation of the Emergency Operations Center. On October 10, 2017, President Donald Trump declared a major disaster making federal disaster aid available for the incident. When a federal disaster is declared, the Federal Emergency Management Agency (FEMA) reimburses 75 percent of eligible costs incurred, meaning a local share of 25 percent is retained by the City. However, CalOES provides a reimbursement of 75 percent of the local share, meaning that the City's net share of costs is 6.25 percent. On November 22, 2017, the President updated the disaster declaration to allow for 100 percent cost reimbursement of emergency protective measure costs from FEMA. All of the City's costs were related to emergency protective measures, meaning the City will be fully reimbursed for all eligible costs incurred as a result of the incident. In order to receive reimbursement, the City must submit a number of applications and forms to FEMA and CalOES. One of the items required by CalOES is a resolution designating agents to act on behalf of the City. Since the process involves frequent interactions with CalOES personnel, it is recommended that the City Council designated the City Manager and Finance Director to execute all forms and documentation related to disaster reimbursement. The California Disaster Assistance Act allows the option to designate agents for a specific incident or to cover all incidents for a period of three years. For efficient operations, staff is recommending that the City Council authorize the agents for a period of three years. 8. Stafford Disaster Relief and Emergency Assistance Act of 1988, and /or state financial assistance under the California Disaster Assistance Act. 2) The City of Orange hereby authorizes its Agents to provide to CalOES for all matters pertaining to such state disaster assistance the assurances and agreements required.
