03.27 Accepting 2900 Block of Collins Avenue1. SUBJECT Resolution No. 11060 — A Resolution of the City Council of the City of Orange accepting a portion of the 2900 block of Collins Avenue into the City Street System. 2. SUMMARY Adoption of Resolution No. 11060 will cause certain real property at the 2900 block of Collins Avenue, currently being used as public streets, to be accepted into the City Street System. 3. RECOMMENDED ACTION Approve Resolution No. 11060. 4. FISCAL IMPACT There is no fiscal impact to the City. 5. STRATEGIC PLAN GOAL(S) 1. Provide for a safe community. d. Assure the development of the City occurs in a fashion that maximizes public safety. 6. GENERAL PLAN IMPLEMENTATION Infrastructure Element Goal 3.0 Ensure adequate maintenance of public rights -of -way to enhance public safety and improve circulation. Policy 3.1: Continue to maintain and repair sidewalks and pavement surfaces on public rights - of -way. 7. DISCUSSION and BACKGROUND Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City Street System. A portion of Collins Avenue, in front of Fire Station No. 2, is erroneously shown on the Assessor's map as parcel (APN 383 - 161 -17) and not public street right -of -way. This was discovered during the recent planning process for the addition of an apparatus garage to be constructed at the fire station. Southern California Edison will be installing an underground vault as part of the project in the parkway (area between the curb and sidewalk). That vault is to be located in the public street right -of -way, but the Assessor's map does not show the area as public street right -of -way. Without the area officially being declared public street right -of -way and part of the City Street System, the City would have to grant Southern California Edison an easement for the vault location. As a public utility franchisee of the City, it is much preferred that Southern California Edison install the underground vault in public street right -of -way rather than in an easement area. This resolution will incorporate that public street right -of -way into the City Street System, thus allowing the Assessor to correct the configuration on their maps. Although the northerly 10' of APN 383 - 161 -17 is in the public street right -of -way, it is not considered public street until the City adopts a resolution to expressly adopt it into the City Street System, and only then it will be shown as a public street by the Orange County Assessor in the Assessor's map book. Upon the adoption of Resolution No. 11060 and recordation of a certified copy thereof in the Official Records of the County of Orange, the Assessor's map book will be revised by the County Assessor to correctly show that portion of APN 383 - 161 -17 as public street. 8. WHEREAS, Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City street system; and WHEREAS, pursuant to Section 1806 of the California Streets and Highways Code, the City Council desires to accept the real property and/or parcel described as the Northerly 10' of Assessor's Parcel No. 383 - 161 -17, which is depicted on the map attached to this Resolution as Exhibit A and further described as legal description shown on Exhibit B into the City street system. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: Section 1. Effective upon the date that a certified copy of this Resolution is recorded in the Official Records of the County of Orange, the real property and/or parcel described as the Northerly 10' of Assessor's Parcel No. 383 - 161 -17, which is depicted on the map attached to this Resolution as Exhibit A and further described as legal description shown on Exhibit B into the City street system. Section 2. The City Clerk is hereby authorized and directed to cause a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgement, certificate of acknowledgement, or further proof in the Official Records of the County of Orange. Section 3. All actions heretofore taken by the officers, employees and agents of the City with respect to the acceptance of conveyance and the recordation of any instrument relating to any and all of the real property and/or parcels described in Section 1 of this Resolution are hereby approved, confirmed and ratified, and the officers and employees of the City are hereby authorized and directed, jointly and severally, to do any and all things and to execute and deliver any and all certificates and documents which they may deem necessary or advisable in order to consummate the acceptance of said streets or roads into the City street system and otherwise to effectuate the purposes of this Resolution.
