03.22 Exchange of Property1. SUBJECT Exchange of vacant City owned real property for Chapman University owned real property. 2. SUMMARY The City owns a vacant future water well site adjacent to the 3.24 acre parcel (known as Panther Village expansion property) near Chapman Avenue and Rampart Street that Chapman University purchased from the City in 2017. Chapman University desires to exchange that parcel for a vacant parcel they own near the main Chapman University campus. Staff recommends the exchange as it is beneficial to both parties. 3. RECOMMENDED ACTION Approve the exchange of unused City owned real property for Chapman University owned real property; and authorize the Mayor and City Clerk to execute the quitclaim deed for the City owned property and execute the acceptance of the Chapman University owned property. 4. DISCUSSION and BACKGROUND In December of 2016 the City Council approved the sale of a surplus parcel adjacent to Chapman University's Panther Village located at 3101 W. Chapman Avenue. The City reserved a corner portion of the property 100' x 150' (15,000 square feet) as a sit for a future water well. Recently Chapman University approached the City to indicate their desire to acquire the 100' x 150' future water well site so that it can be included in the project planned for the surplus property they purchased. Knowing that the City values its future water well sites as a necessary function to maintain the ability to serve water to the residents, Chapman University proposed to exchange a property they own for the City owned future water well site. The property Chapman University owns is a 15,681 square foot parcel located at the northeast corner of Maple Avenue and Lemon Street. The City real property agent has reviewed the title report for the Chapman University property. The title report shows the property is free and clear of any encumbrances. The property value of the Chapman Property is more than the City owned property. However, the City owned property would allow Chapman University to be able to develop the full vacant parcel adjacent to Panther Village. The Public Works Department Water division has determined that the location for a water well site in this area of the City is more beneficial than one adjacent to Panther Village. The Public Works Department supports the exchange of the City owned future well site for the Chapman University owned parcel. The water department expects that it will be necessary to install a new water well at this location in the next three to five years. The requested City Council action is to approve an exchange of the City owned future water well site adjacent to Panther Village for the Chapman University owned parcel at the northeast corner of Maple Avenue and Lemon Street; and to authorize the Mayor and City Clerk to execute the quitclaim deed for the City owned property and execute the acceptance of the Chapman University owned property. 8.
