Celebration.
2. SUMMARY
Five year agreement for a professional fireworks display at the Third of July Celebration for
$17,500 per year, for a total of $87,500 over a five year term.
3. RECOMMENDED ACTION
Approve Agreement with Pyro Spectacular, Inc. in an amount not to exceed $87,500, and
authorize the Mayor and the City Clerk to execute on behalf of the City.

7. DISCUSSION and BACKGROUND
Background
The City has offered the family -based 3 1d of July annual event to the community for the last 22
years at El Modena High School, Fred Kelly Stadium. This event brings approximately 10,000
community members together. Since its inception, in addition to the musical program provided
by the Orange Community Master Chorale, a professional fireworks display has been a main
component of this event. In order to ensure safety, as well as continue with tradition, it is
necessary to hire professionals in the pyrotechnic field to provide a professional, safe, and quality
fireworks display. Pyro Spectaculars, Inc. has been the City's provider of fireworks at this event
since its inception in 2000.
Discussion
In October 2017, the City conducted a formal Request for Proposal (RFP) to secure a vendor to
provide a professional fireworks display for the annual 3` of July Celebration over the next five
years. The RFP was released on October 5, 2017 and mailed to three vendors: Pyro Spectaculars,
Zambelli Fireworks and Fireworks America. Proposals were due on October 26, 2017. Only one
bid was received and it was from Pyro Spectaculars. Based on their proposal, work experience
and prior City of Orange satisfaction with their services over the past 17 years, staff is
recommending the approval of a five -year agreement with Pyro Spectaculars. The scope of work
for this agreement is outlined in Exhibit A of the attached agreement and includes a 14 minute
fireworks display as provided in the previous contract scope. The term of the agreement includes
the 3` of July fireworks displays for 2018 — 2022.
The cost for the annual fireworks display is $17,500 per year, for a total of $87,500 over the five
year term. This annual amount represents an increase of $1,500 (9%) per year from the previous
five year contract amount for FY13 — FY17 and is effective for the next five years. In speaking
with other municipal agencies who utilize firework vendors, this is a competitive price and
moderate increase for our annual show. Sufficient funds for the 2018 fireworks display are
included in the department budget in FY18. Funds to cover the fireworks display beyond FY18
will need to be included in future fiscal year annual budget appropriations. In the event funding is
not available, the City may terminate the agreement by April 2 of any given year without penalty,
after giving a minimum five days written notice to contractor.

ACTION: Approved Amendment with Cornerstone Communications in an amount not-
to- exceed $48,000 and authorized the Mayor and City Clerk to execute the agreement on
behalf of the City.
3.9 Amendment No. 1 to Consultant Services Agreement No. 6370 with Secoy Architect,
Inc., for additional Professional Services for Council Chamber Remodel Project.

ACTION: Approved Amendment No. 1 to the existing Secoy Architect, Inc., Consultant
Services Agreement and increase the contract amount by $25,500; and authorized the
Mayor and City Clerk to execute the Amendment on behalf of the City.
3.10 Contract with Advanced Aquatic Technology, Inc. for regular maintenance and
repair of City fountains. (A2100.0; AGR -6573)
ACTION: Approved a four -year contract with Advanced Aquatic Technology, Inc. for an
amount not -to- exceed $78,232.20; and authorized the Mayor and the City Clerk to execute
on behalf of the City.
3.11 Purchase of Four Storage Area Network (SAN) Fabric Switches from Sidepath, Inc.

NOTE: Mayor pro tem Murphy recorded an abstention due to a potential conflict with
employment.
ACTION: Approved the purchase of four SAN Fabric Switches from Sidepath, Inc. in the
amount of $92,742.14; and authorized the appropriation of $12,750 from Information
Technology (790) unreserved fund balance to account number 790.1601.56033.20293.
3.12 Cooperative agreement with the City of Anaheim for the design and construction of
the 16" water main on Orangewood Avenue. (A2100.0; AGR -6575)
ACTION: Approved the Cooperative Agreement for the design and construction of the 16"
water main on Orangewood Avenue from State College Boulevard to Eckhoff Street.
