Resolution No. 11054 — A Resolution of the City Council of the City of Orange Approving the
Application for Grant Funds from the Land and Water Conservation Fund for the Construction of
the Hart Park Pickleball and Fitness Circuit.
2. SUMMARY
Staff is preparing a competitive grant application to leverage available park development funding
in support of the proposed project. After review and consideration of several options and locations,
staff feels the proposed project at Hart Park is responsive to the community, adds significant value
to the park system, and provides for a very competitive grant application. The proposed project
includes installation of the City's first outdoor pickleball courts, new exercise equipment and
apparatus, and associated irrigation and infrastructure work at Hart Park. Resolution No. 11054 is
formatted based on the grant application template and is required to be adopted as part of the grant
application package.
3. RECOMMENDED ACTION
Adopt Resolution No. 11054.
4. FISCAL IMPACT
The total project cost estimate, which includes design, construction and administration, is
$3,375,500. If awarded the full amount, the grant would fund 50% of the project, requiring a 50%
agency match. Park Development Fees are available in the amount of $1,687,750, 50% of the total
project cost, for the City's match.

City residents.
7. DISCUSSION and BACKGROUND
Background
The Land and Water Conservation Fund (LWCF) is a federal grant program administered by the
State of California Department of Parks and Recreation. The purpose of the LWCF program is to
assist in preserving, developing and assuring accessibility of outdoor recreation resources. The
LWCF program provides matching funds from federal recreation fees, sales of federal surplus real
property, federal motorboat fuels tax, and Outer Continental Shelf mineral receipts. Awarded funds
may be used for statewide planning, acquiring, and developing outdoor recreation areas and
facilities.
Discussion
The proposed project allows the City to combine the current Hart Park irrigation replacement
capital improvement project, with leveraged grant funds to add new amenities requested by the
community, on the south side of Hart Park, located at 701 S Glassell Street. The project scope
includes a number of elements to enhance offerings available to the public for health and wellness.
Elements include a six -court lighted pickleball facility, walking /jogging path, static exercise
equipment, a mechanical exercise equipment area with shaded canopy, slackline venue with
rubberized surface, improved pathway lighting, landscape renovation and irrigation replacement,
as well as improved access to the orange grove.
Pickleball is a racquet sport that combines elements of badminton, tennis, and ping pong. Two,
three, or four players play at once, and use a solid paddle to hit a perforated ball, similar to a wiffle
ball, over a net. Pickleball was invented in the mid 1960s as a children's backyard pastime, but has
become very popular over the past decade among active adults, and continues to grow rapidly in
popularity with all ages across the nation. The City has received several requests from residents to
provide pickleball courts in Orange. The south side of Hart Park, just east of the orange grove,
provides an ideal location to add pickleball courts as the area is relatively flat, away from

residential homes, and this area could benefit from more active regular use to deter unwanted
activities. Building new courts in an existing park also provides existing restrooms and
infrastructure to support added park patrons, and therefore does not requiring building or
maintaining additional support elements.
The City also regularly receives requests to install additional exercise equipment in our parks,
similar to the Grijalva Park exercise circuit installed in 2015. The south side of Hart Park, which
is frequently used by many patrons now to exercise, provides an ideal linear space along the
freeway wall to locate new exercise equipment. Installing this type of amenity at Hart Park also
provides an opportunity for the City to partner with local hospitals, whereby the hospital could
fund the required match portion for the exercise equipment, and then provide the health related
information with their logo on the equipment signage.
Staff had previously identified the need to replace the irrigation at Hart Park due to age and
functionality. Hart Park Irrigation Replacement is currently listed in the City's Capital
Improvement Program as a four phase, multi -year project. The matching -funds LWCF grant
provides an opportunity for the City to leverage use of Park Development Fees identified for
irrigation replacement (the City's matching funds) with the ability to add desired elements to our
park system (funded by the grant award). If awarded the grant, it will also allow for the south side
irrigation replacement to be completed collectively with the other improvements. Community
Development planning staff have been consulted regarding the necessary environmental review of
the project, in particular the City's historic planner as Hart Park is within Old Towne. Staff's initial
review concluded this is an appropriate project, consistent with current park offers, and it adds
value to the park.
The grant application is due February 3, 2018 and announcement of award is noted as fall of 2018.
If awarded funds, design development is anticipated to begin in early 2019, with construction in
2020.
8. ENVIRONMENTAL REVIEW
The proposed project is statutorily exempt from the provisions of the California Environmental
Quality Act (CEQA) per State CEQA Guidelines 15262 (Feasibility and Planning Studies) because
the project is limited to seeking authorization to submit a grant application. The project does not
involve City approval of park improvements, detailed plans, City funding for park improvements,
or LWCF grant funding. At this time, the project is seeking only to engage in funding a feasibility
analysis and environmental analysis to determine if pursuit of LWCF grant funding is feasible.
Before the LWCF grant application can be considered for approval by the State, a complete
environmental analysis under CEQA and the National Environmental Policy Act (NEPA) must be
conducted. If the grant is awarded, Hart Park improvements and matching funding will be
considered by the City Council accompanied by an environmental determination that encompasses
a fully- defined park improvement project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ORANGE APPROVING THE APPLICATION FOR LAND AND
WATER CONSERVATION FUND HART PARK PICKLEBALL
AND FITNESS CIRCUIT PROJECT
WHEREAS, the Congress under Public Law 88 -578 has authorized the establishment of
a federal Land and Water Conservation Fund Grant -In -Aid program, providing Matching funds to
the State of California and its political subdivisions for acquiring lands and developing Facilities
for public outdoor recreation purposes; and
WHEREAS, the California Department of Parks and Recreation is responsible for
administration of the program in the State, setting up necessary rules and procedures governing
Applications by local agencies under the program; and
WHEREAS, the Applicant certifies by resolution the approval of the Application and the
availability of eligible Matching funds prior to submission of the Application to the State; and
hereby:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as
1. Approves the filing of an Application for Land and Water Conservation Fund
assistant for the proposed Hart Park Pickleball and Fitness Circuit Project;
2. Agrees to abide by Section 6(f)(3) of Public Law which states "No property
acquired or developed with assistance under this section shall, without the approval of the National
Secretary of the Interior, be converted t other than public outdoor recreation uses. The Secretary
shall approve such conversion only if he finds it to be in accord with the then existing
comprehensive statewide outdoor recreation plan and only upon such conditions as he deems
necessary to assure the substitution of other recreation properties of at least equal fair market value
and of reasonably equivalent usefulness and location."
3. Certifies that said agency has Matching funds from eligible source(s) and can
finance 100 percent of the Project, which up to half may be reimbursed; and
4. Appoints the City's Community Services Director as agent of the Applicant to
conduct all negotiations and execute and submit all documents, including, but not limited to,
Applications, Contracts, amendments, payment requests, and compliance with all applicable
current state and federal laws which may be necessary for the completion of the aforementioned
Project.
