Cooperative Agreement with Orange Dog Park Association for use of the Dog Park located at
Yorba Park.
2. SUMMARY
This agreement grants Orange Dog Park Association (ODPA) non - exclusive use of the Yorba
Dog Park for a term of five years, with one optional five -year renewal. The agreement provides
for the City to maintain the Dog Park and ODPA to supply dog waste bags, encourage all users of
the park to observe the rules and regulations applicable to the dog exercise areas, and work
cooperatively with the City on future improvements to the Dog Park.
3. RECOMMENDED ACTION
Approve Agreement with Orange Dog Park Association and authorize the Mayor and the City
Clerk to execute on behalf of the City.
4. FISCAL IMPACT
The City currently maintains all elements of Yorba Park through the Community Services
Department annual general fund operating budget. The estimated annual maintenance cost for the
newly renovated park is $37,000. This agreement provides for ODPA to supply all doggie bags at
their expense, as well as potential cost sharing for future dog park improvements and /or
maintenance, such as re- sod /seeding, and /or additional dog park amenities.

City residents.
Policy 5.2 Provide a range of high quality recreational facilities and programming to serve a
broad cross section of residents, including youth, seniors, young adults, mature adults and people
with disabilities.
7. DISCUSSION and BACKGROUND
Background
The Orange Dog Park Association (ODPA) was organized for the purpose of, among other
things, raising funds and providing volunteer support to improve and maintain the dog park at
Yorba Park. The City and ODPA have enjoyed a cooperative partnership since the dog park
opened in June of 2005. ODPA satisfied their financial commitment to the City funding
approximately 80% ($35,212) of the original construction costs of the dog park.
The Dog Park is open every day from 7:00 a.m. to dusk with the exception of Wednesdays when
it is closed for maintenance. Although ODPA is an association supported through paid
memberships, the dog park is open to the general public and there is no obligation to be a
member of ODPA in order to use the dog park.
ODPA has been actively involved in the daily oversight of the park and has created a website and
newsletter to keep members and park users informed of the activities at the dog park as well as to
promote the rules and regulations. They provide an information table on weekends, and have
held several special events throughout the years. They are the frontline responders to patrons
who have questions or concerns related to the park and work closely with staff on issues that
require further follow -up or resolution. ODPA and the City have collaborated on several
improvements to the dog park over the years, such as re- seeding, adding benches, and making the
dog park a popular community amenity.

In 2015, upon expiration of the First Amendment to the original agreement, City staff began
working with ODPA on a new Cooperative Agreement. At the time, the City was planning the
current Yorba Park Renovation project, which includes complete renovation of the dog park. As
the project is expected to be complete in March 2018, a new agreement with ODPA is being
presented for consideration to continue our successful partnership.
Discussion
The term of the new agreement is for a period of five years, continuing through 2023, with an
option for an additional five year term through 2028. The agreement allows for the City Manager
to execute amendments to the agreement, in a form acceptable to the City Attorney. All other
conditions remain as originally proposed in the 2005 agreement as amended by the First
Amendment executed in 2010 as follows:
• The City grants ODPA a license to use the dog park together with any and all parking
now existing at Yorba Park for activities directly related to a dog exercise area on a non-
exclusive basis in common with public use;
• The dog park shall remain open to the public;
• The City agrees to maintain the dog park measured by City standards;
• ODPA agrees to provide dog waste bags and to encourage members of the Association
and the general public to observe the rules and regulations applicable to dog exercise
areas;
• The City and ODPA agree to meet annually and jointly consider and cooperate in efforts
to develop and mutually agree upon any additional maintenance items not presently
required, including but not limited to re- seeding or re- sodding the turf areas and/or other
changes, alterations or improvements that ODPA wishes to propose.
Funds for routine maintenance of Yorba Park, to include the dog park, are included in the
Community Services general fund budget and are estimated to be approximately $37,000 a year.

sod /seeding, or additional dog park amenities, such as benches, signage or specialty items.

Agreement and First Amendment to Agreement for Claims Administration Services
between California Insurance Pool Authority on behalf of the City and AdminSure, Inc. in
