08062014-193 CITY OF ORANGE ZONING ADMINISTRATOR MINUTES – FINAL August 6, 2014 Staff in Attendance: Rick Otto, Zoning Administrator Chad Ortlieb, Senior Planner Bette Springer, Recording Secretary Public Hearing: 3:30 p.m. Rick Otto, Zoning Administrator, called the Public Hearing to order, Wednesday, August 6, 2014 at 3:34 p.m. NEW ITEM: 1. Variance No. 2234-14 – Golshani Residence, 1902 N. Zion Street The applicant proposes to construct two 8-foot tall columnar features at the front property line in connection with a pronounced property entry stairway and, two slope-stepping, staggered, retaining walls. A retaining wall with a railing on it alongside the left side of the property entry stairs and, the innermost retaining wall with a wrought iron or tube steel fence on it are the two features that require a Variance because they are over 42 inches high. The 8-foot columns do not require a Variance because they are not considered walls or accessory structures by definition of the Orange Municipal Code and pursuant to a determination of the Community Development Director. ___________________________________________________________________________ Rick Otto, Zoning Administrator (ZA), asked Staff to give the Staff Report presentation on Variance No. 2234-11 – Golshani Residence. Chad Ortlieb, Senior Planner, presented a project overview consistent with the Zoning Administrator Staff Report. The applicant, Mike Golshani, address on file, was present at the hearing to answer any concerns of the Zoning Administrator. Mr. Otto asked if this property had a homeowner’s association (HOA), and if so, had they seen the plans. He said the City’s approvals are contingent upon the HOA decisions. Based on a nod from Mr. Golshani, Mr. Ortlieb indicated that the HOA seen them. Mr. Otto asked if this application was a result of a Code Enforcement case, since the property was currently under construction. Mr. Ortlieb said it came in as a Building Inspector investigation. It does require building permits for the columns, retaining walls and an y electrical components. The applicant has not gotten the permits yet; however, there was a progression of the work at the site. Mr. Otto opened the public hearing to the public, including the applicant. Mr. Otto asked what the original condition was. Mr. Golshani said it could be viewed in Google Maps. Mr. Golshani said he wanted to know what could be done to make the process go faster. Mr. Otto asked if anyone else had any comments. Jill Loucks stated the applicant has broken every rule possible. Bins are out front for months at a time, overflowing into the streets. The streets and gutters have never been cleaned at the bottom. Ms. Loucks said all the neighbors have step-ups, not just him. She said Mr. Golshani has never gotten approvals. Also, his construction doesn’t match anything in Mayberry Ranch. She said he signed the CC&R’s and then started in on the project. He doesn’t go to any of the HOA meetings when they requested approval for the project. He works morning to night. Mr. Otto asked where Ms. Loucks lives on the street, and she showed him on the plans (three houses away). Mr. Otto asked when the application was filed, and Mr. Ortlieb said June 24, 2014. He also asked when the photos were submitted, and Mr. Ortlieb said they came in a week after the application date. Mr. Otto asked if the neighbors would have the same opportunity for construction as the applicant, and Mr. Ortlieb said they did (based on different topographical differences). Mr. Otto said the Zoning Administrator must review the request presented, and cannot punish the applicant for inappropriate work he continued to do during the application process. He asked if there were any conditions recommended by Staff. Mr. Ortlieb said there is an attached letter with Condition 6, requiring building permits for all construction work. Mr. Otto asked Mr. Ortlieb to ensure the permits are requested and issued, and that no additional work should occur until the permits are received. He told Mr. Golshani it’s quite possible some of the materials would have to be removed in order for the inspectors to look at the footings or other installations that had occurred. Mr. Otto approved, in the letter attached to the staff report, Variance No. 2234-14 with the conditions. Mr. Otto stated that there were no other items on this agenda and the meeting was adjourned. ADJOURNMENT: The ZA adjourned the Public Hearing at 3:56 p.m.
