Pete Goodrich, Zoning Administrator, called the Public Hearing to order on Wednesday, August 14

1. CUP 2981-15 – THE NEW HOME COMPANY (MARYWOOD) 20

The applicant proposes a temporary onsite crushing operation associated with the 22
Marywood Residential Development Project. 23

Pete Goodrich, Zoning Administrator (ZA), asked Staff to give the Staff Report presentation on 27
CUP 2981-15 – The New Home Company, Marywood Residential Development project. 28

Robert Garcia, Senior Planner, presented a project overview consistent with the Zoning 30
Administrator Staff Report. Mr. Garcia had in possession a memorandum from the applicant 31
dated August 24, 2015. This memorandum corrected some typographical errors from a previous 32
memo dated August 12, 2015. The applicant wished to confirm the project hours of operation to 33
be 7:30 a.m. to 4:30 p.m. Monday through Friday. 34

Mr. Goodrich stated the Zoning Administrator is not the final determining body, but can only 36
make a recommendation to the Planning Commission and City Council. 37

The applicant, Douglas Woodward, said the two choices were to either crush the material onsite 39
using it as fill material, or haul it away offsite. He said he believed that crushing it onsite would 40
be less impactful to the neighborhood in regard to noise, air quality, traffic, and consistency with 41
the City’s recycling goals. 42

Sonny Centeno and Tom Stevens (names on file) were present from American Integrated, the 44
demolition and asbestos removal company for the project. Mr. Centeno affirmed that crushing 45
was the best alternative. 46

Mr. Goodrich opened the item to the public for comments. 48

Terrie Warner (name on file) was concerned about the hours of operation, but was satisfied with 50
the 7:30 to 4:30 timeframe. She agreed the material crushing was the best option. She asked that 51
contact information be posted, along with the specific recommendations in the DEIR. 52

Michael Spix (name on file) was concerned with mitigation of the noise, dust and particulate 1
matter going into the air. 2

Hsien Chen (name on file) was concerned with impacts on residents living close to the site. He 4
wanted to know how the applicant would address them and what the City requirements would be. 5
He wanted certain air tests to be done. Mr. Chen was also concerned about dust covering plants, 6
laundry, etc., and when the job should be stopped if conditions aren’t met. He wanted to know 7
the conditions, monitoring and mitigation plans, and how these would be implemented. 8

Lanell O’Neill (name on file) said she lives directly above Marywood Chapel, and is concerned 10
about the stability of the hills, due to residences with cracked foundations, and sliding homes. 11
She wanted to know if a retaining wall would be built. She asked that the mitigation measures be 12
posted onsite. 13

Mr. Goodrich closed the public comment section of the meeting. 15

Applicant Douglas Woodward and his team responded to the comments. He stated there would 17
be an employee onsite presence at the site every day. The employee’s phone number will be on a 18
sign on his trailer. Also AQMD regulations require a sign be posted. Mr. Woodward and 19
employees will be available to speak with residents. He can bring in a geologist to discuss any 20
impacts. 21

Tom Stevens discussed details on how asbestos materials would be removed. The client will get 23
full reports on what is done, a visual inspection, and air clearances all completed according to 24
state requirements. 25

Sonny Centeno discussed noise and dirt impacts. He said materials will be wetted down with a 27
rain bird or sprinkler system continually to prevent “fugitive” dust. The AQMD requires a sign to 28
be posted with a phone number to call if anyone sees any fugitive dust. 29

Mr. Goodrich asked for clarification on the exact completion date. Mr. Centeno said it would 31
take 10 days. Mr. Goodrich suggested 15 days, taking into consideration any equipment issues 32
that might arise. 33

Mr. Goodrich also asked Mr. Garcia about posting the mitigation measures. Mr. Garcia said he 35
will work with the applicant to develop these for posting onsite. Mr. Woodward said they would 36
also be posted on their website. 37

Bill Crouch, City of Orange Community Development Director, asked the applicant to address 39
the possible equipment vibration issue. Mr. Centeno said there would be no vibration, but rather 40
the crushing of the material. 41

Mr. Goodrich said he appreciated the community being involved in this project. Besides the 43
comments made in this meeting, he also received some letters. He said all of these concerns were 44
addressed in today’s meeting. 45

Mr. Goodrich, Zoning Administrator, stated he will make a recommendation to the Planning 47
Commission approval of the Conditional Use Permit (CUP) 2981-15 the materials crushing 48
operation at the Marywood development site located at 2811 E. Villareal Drive, with the 49

conditions that are listed in the staff report and the following two additions: 1) Conditional Use 1
Permit (CUP) 2981-15 for the materials crushing operation shall expire after 20 working days 2
from the commencement of the first day of materials crushing; 2) The applicant shall work with 3
staff to make the conditions of approval and mitigation measures available to the public at the 4
site. 5

Since there were no other items on the agenda, Mr. Goodrich thanked everyone for attending, 7
and adjourned the meeting. 8
