08172016-194CITY OF ORANGE ZONING ADMINISTRATOR MINUTES – FINAL August 17, 2016 Staff in Attendance: Pete Goodrich, Zoning Administrator Judy Eguez, Contract Planner Corinna Rivas, Recording Secretary Public Hearing: 3:00 p.m. Pete Goodrich, Zoning Administrator, called the Public Hearing to order, Wednesday, August 17, 2016 at 3:01 p.m. NEW ITEMS: 1. VARIANCE NO. 2239-16 – ABEGUNDE RESIDENCE  The applicant proposes a variance to allow a 70% reduction to the rear yard setback in order to accommodate an unpermitted 403 square foot expansion of a secondary kitchen and a den.  2340 N. Robinhood Place  Planner: Judy Eguez, 714-744-7239, jeguez@cityoforange.org ______________________________________________________________________________ Pete Goodrich, Zoning Administrator (ZA), asked staff to give the Staff Report presentation on VARIANCE 2239-16 – ABEGUNDE RESIDENCE Judy Eguez, Contract Planner, presented a project overview consistent with the Zoning Administrator Staff Report. The ZA opened the Public Hearing. Steve Abegunde, owner of the property on 2340 N. Robinhood Place thanked staff and zoning administrator for their time to review this matter. He stated in the Staff Report there are two key points of concern which is why the denial is recommended. One of the points was that the structure as it exists will encroach on the neighbor’s privacy. He stated that with the structure in place it would actually give the neighbors more privacy. Otherwise it would be open space that people can run around on that would allow noise in the backyard. Having that structure would restrict people in that area. The original plan we had requested a deck on the second floor of that structure which would give access into the neighbor’s yard. We would eliminate the deck so it would not have access into the neighbor’s yard. In the report it states we are asking for a 70% reduction set-back but actually we are asking for 40%. The structure that is already there is where we would like to continue the line. If five feet is enough of a distance on the side of the homes to create privacy then six feet would be enough in the back of the home to create that same privacy. Steve Abegunde stated it was built in 1987 and he stated he did not own the home back then so he is not too sure. Bill Euell resident of the property on 2119 Denise Cove stated when they moved into their home in 1990 the owner of the 2340 N. Robinhood Place property agreed to grow the trees to allow for privacy. The addition beyond those trees is what we are here about today.  Audience Discussion The ZA would like to also put on the record that the City has received an email of opposition from a neighbor. The ZA asked staff a question on the plans. The plans show area B and C and it shows that area B is existing. So is area C the area we are discussing with on permits. Judy Eguez stated area C is area in question with the permits. The ZA closed the Public Hearing. The ZA rendered a decision and denied VAR 2239-16, ABEGUNDE RESIDENCE.
