Public Hearing: 3:00 p.m.
Pete Goodrich, Zoning Administrator, called the Public Hearing to order, Wednesday, March 23,
2016 at 3:02 p.m.
NEW ITEMS:
1. CONDITIONAL USE PERMIT 2990-15
A proposal to install plumbing facilities in an accessory habitable structure greater
than 450 SF in size. The subject property is a contributing resource within the Old
Towne Historic District.

Pete Goodrich, Zoning Administrator (ZA), asked Staff to give the Staff Report presentation on
CUP 2990-15 - Albert Residence.
Kelly Ribuffo, Associate Planner, presented a project overview consistent with the Zoning
Administrator Staff Report.
The ZA confirmed the structure was currently an uninhabitable building.
The ZA opened the Public Hearing.
Rick Fox, architect for the project, indicated the applicants had read the conditions and they
concur with them. They were there to answer any questions the ZA might have. He explained
they have removed 2 feet of the existing structure to bring it within the 5 foot setback
requirement.
Ted Albert, owner of the property, stated he and his wife love this house and they are very
sensitive to the interest of the Old Towne Historic District.
The ZA closed the Public Hearing.
The ZA rendered a decision and approved CUP 2990-15, Albert Residence, based on the 10
conditions listed in the Staff Report.

2. CONDITIONAL USE PERMIT 2970-15
A proposal to construct a 1,200 square foot, two story game room. The habitable
structure would have plumbing facilities but no kitchen.

Pete Goodrich, Zoning Administrator (ZA), asked Staff to give the Staff Report presentation on
CUP 2970-15 – Seiveke Accessory Structure.
Chad Ortlieb, Senior Planner, presented a project overview consistent with the Zoning
Administrator Staff Report. He explained the 2 issues which included the habitable size and use
of the structure, and the septic usage on the property. He stated that Condition 13 placed a deed
restriction on the accessory structure on the property so it could not be rented as a second unit.
The ZA opened the Public Hearing.
Brian Brennan, address on file, was present to answer any questions the Zoning Administrator
might have.
The ZA closed the Public Hearing.
The ZA had concerns with this request because it could become a secondary dwelling unit. He
explained that it could become a future problem for the City and it appeared to be configured like
a secondary unit. He did note that with the deed restriction that if it became an issue, Code
Enforcement would become involved.
The ZA rendered a decision and approved CUP 2970-16, Seiveke Accessory Structure, based on
the 36 conditions listed in the Recommended ZA Action letter dated March 23, 2016,
Attachment 1 of the Staff Report.
