Parker Street SUMMARY At its April 3, 2017 meeting the Planning Commission recommended approval to upgrade an Alcohol and Beverage Control (ABC) Type 42 (On-sale Beer & Wine-Public Premises) License to an Alcoholic Beverage Control (ABC) Type 48 License (On-Sale General – Public Premises) to serve distilled spirits at an existing tavern and directed staff to draft a resolution with appropriate findings and conditions of approval. RECOMMENDED ACTION Adopt Planning Commission Resolution No. PC 13-17 entitled: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE APPROVING CONDITIONAL USE PERMIT NO. 3031-16 AUTHORIZING THE UPGRADE AN ALCOHOL AND BEVERAGE CONTROL (ABC) TYPE 42 (ON-SALE BEER & WINE - PUBLIC PREMISES) LICENSE TO AN ALCOHOLIC BEVERAGE CONTROL (ABC) TYPE 48 LICENSE (ON-SALE GENERAL – PUBLIC PREMISES) TO SERVE DISTILLED SPIRITS AT THE SALTY DAWG TAVERN LOCATED AT 1214 N PARKER STREET Planning Commission Agenda Item May 1, 2017 Planning Commission Staff Report May 1, 2017 Page 2 AUTHORIZATION/GUIDELINES Orange Municipal Code (OMC) Section 17.30.030.C. and Table 17.08.020 authorize the Planning Commission to review and take action on Conditional Use Permits for eating establishments with the sale of alcohol beverages. ENVIRONMENTAL REVIEW Categorical Exemption: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15301 (Class 1 – Existing Facilities) because the project consists of licensing the sale of alcoholic beverages at an existing tavern. PROJECT BACKGROUND At its April 3, 2017 meeting the Planning Commission conducted a public hearing and took testimony from the community and the applicant. The Commission approved the request to upgrade an Alcohol and Beverage Control (ABC) Type 42 (On-sale Beer & Wine-Public Premises) License to an Alcoholic Beverage Control (ABC) Type 48 License (On-Sale General – Public Premises) to serve distilled spirits at an existing tavern and directed staff to draft a resolution with appropriate findings and conditions of approval staff to by a vote of five ayes.
