3. NEW HEARING:
3.1 CONDITIONAL USE PERMIT NO. 3072-18, DESIGN REVIEW NO. 4945-18,
AND MINORSITE PLAN REVIEW NO. 0946-18, ENTERPRISE RENT-A-CAR.
LOCATION: 745 N. TUSTIN ST.
A proposal to establish a rental car agency in the Limited Business (C-1) zoning district.
The project includes conversion of an existing historic single-family residential building
into a rental car office and installation of a vehicle washing station in an existing detached
storage building.
RECOMMENED ACTION:
Adopt Planning Commission Resolution No. PC 31-18 entitled a resolution of the Planning
Commission Approving Conditional Use Permit No. 3072-18, Design Review No. 4945-
18, and Minor Site Plan No. 0946-18 to establish a rental car agency at 745 N. Tustin Street
NOTE: The proposed project is also categorically exempt from the provisions of the
California Environmental Quality Act (CEQA) per State CEQA Guidelines 15331
(Historical Resource Restoration/Rehabilitation). The proposed modifications to the two
existing buildings on the lot comply with the Secretary of the Interior’s Standards for the
Treatment of Historic Properties.

Kelly Ribuffo, Assistant Planner, provided an overview of the project consistent with the
staff report.
Commissioner Correa asked if staff received any opposition on the project.
Ms. Ribuffo responded that there had been no opposition from any of the residents or
surrounding businesses.
Larry Casarez, design consultant for Enterprise Rent-a-Car, explained the vehicular egress
and ingress for the property, the conservation and restoration of the historic features of the
building, and the proposed lighting, parking, and carwash conditions.
Commissioner Simpson asked if there would be enough parking on the property.
Mr. Casarez responded that vehicles would be brought back and forth by enterprise
employees and they pick up customers or deliver vehicles to the customers, therefore
parking will be sufficient.
Commissioner Gladson asked if there are accommodations for vehicles that need to be
dropped off after business hours and whether or not they researched the history of the
original owner of the house.
Joshua Hilliger, Rental Manager for Enterprise, explained there would be no after-hours

drop off due to the proximity of the residential area; cars would be dropped off during
business hours for security reasons. If need be, cars can be dropped off at other nearby
branches. As for the original owner, Enterprise had not found any information in its
research. However, the home would be restored to what it was. The home does not have a
legal second floor, which will be sealed off and used, as an attic.
Commissioner Correa suggested that the applicant contact Douglas Westfall who has
written numerous historical books on the City of Orange and he may have information on
the original home.
Commissioner Simpson asked staff how the required parking spaces were calculated.
Ms. Ribuffo provided an explanation of the calculation and explained that a condition of
approval had been added to ensure that additional vehicle inventory would not be allowed to
be stored or parked on the property. Commercial vehicles could not to be stored on the
public right-of -way and if they were, it would be enforced by Code Enforcement and the
Police Department.
Chair Glasgow opened the public hearing.
Jesse Opgenorth, 1804 E. Mayfair Ave., lives behind the proposed location and asked for
the hearing to be postponed because the neighborhood was experiencing a power outage and
residents needed to stay home to tend to their family and were unable to attend the hearing.
He provided images of the residential street to the Commissioners. He stated the
neighborhood was currently undergoing a parking permit process and did not want any
added traffic. Also, he expressed concerns about the small entryway, egress onto a busy
residential street that has frequent accidents, water runoff, and increased noise.
Chair Glasgow invited the applicant to respond to the comments.
Mr. Casarez stated the lot is a commercial property and feels it is the best operation for this
property as it would not create an increase in traffic. There could possibly be an additional
20 to 30 cars a day; however, they would be spread out intermittently throughout the day
and would not be there all at once. The noise would be minimal and cars would be hand
sprayed; there is no carwash machinery.
Chair Glasgow inquired about the size of the drive aisle.
Mr. Casarez stated that the Public Works Department has requested a new aisle, which
would be wider, and ADA compliant.
The Commissioners expressed their support for the project and they did not feel there will
be a traffic impact to the neighborhood, the restoration of the house will be a benefit to the
neighborhood and the ingress and egress has been satisfied.

A motion was made to Adopt Planning Commission Resolution No. PC 31-18 entitled a

3.2 ZONE CHANGE NO. 1291-18 TO CREATE A HISTORIC DISTRICT
OVERLAY ZONE FOR THREE EICHLER TRACTS AND ADOPT THE
ORANGE EICHLER DESIGN STANDARDS.
The City of Orange is proposing to create a historic district overlay zone for three
Eichler Tracts (Fairhaven, Fairhills, and Fairmeadow) and to adopt the Orange
Eichler Design Standards to preserve the character of the Eichler Historic Districts.
Under Orange Municipal Code Chapter 17.17, historic district designation is
processed as an overlay zone with protections for historic resources added to the base
zoning.
RECOMMENED ACTION:
Adopt Planning Commission Resolution No. PC 30-18 entitled: A resolution of the
Planning Commission recommending City Council approval of Zone Change No. 1291-18
to create a historic district overlay zone for three Eichler tracts and adoption of the Orange
Eichler Design Standards.
Marissa Moshier, Historic Preservation Planner, provided an overview of the process the
City conducted to develop the Design Standards and create the historic district overlay zone
for the Eichler Tracts. She also noted the differing community perspectives on the
appropriateness of second-story additions and reviewed the process for City Council
approval of the Design Standards document and Zone change.
Commissioner Willits inquired about the breakdown of contributing verses non-contributing
homes in the three tracts.
Ms. Mosher responded:
Fairhaven has 145 homes, 132 contributing, 13 non-contributing;
Fairhills has 80 homes with 76 contributors and four non-contributors;
Fairmeadow has 119 homes with 109 contributors and 10 non-contributors;
There are a total of 22 noncontributing homes among the three tracts.

Commissioner Gladson asked how many two-story homes exist in the Eichler tracts.
Ms. Mosher responded that houses with second stories on top of the original house are non-
contributors; there are at least three homes that are non-contributing two-story structures.
Another house has a two-story addition in the back that is still considered a contributor.
Commissioner Gladson asked if the Orange Eichler Design Standards follow the Old Towne
Historic District in terms of how they interplay with design.
Ms. Mosher responded that both the Old Towne Standards and Eichler Design Standards are
based on the Secretary of the Interior Standards. Each are then tailored to the specific
features and characteristics of their respective neighborhoods. There is enough guidance in
the Eichler Design Standards to allow a non-contributor to become a contributing property.
Commissioner Simpson asked if 22 non-contributing homes will be subject to the same
Design Standards as the contributors or only subject to the Municipal Code.
Ms. Mosher stated the Design Standards and the historic district designation apply to the
entire tract; they apply to non-contributors because changes to a non-contributor can have an
effect on the character of the historic district as a whole. A specific section in the Design
Standards regarding changes to non-contributors allows more flexibility to exterior changes
for properties that are not historic.
Commissioner Correa asked staff how many residents were in opposition.
Ms. Mosher stated that staff received three letters in opposition.
Chair Glasgow opened the public hearing.
Tim Rush, Preserve OC board member spoke in support of the Design Standards and
recommendations made by the Planning staff.
Douglas Wade, 723 E. Palmdale Ave., spoke in support of the Eichler Design Standards in
order to preserve the integrity of the tracts.
Heidi Topansky, 816 S. Woodland St., submitted Redfin maps with real estate values to the
Commission comparing properties in different neighborhoods in Illinois with and without
historic regulations. She spoke in favor of the document; however, she is in opposition of
prohibiting second-story additions based on the possible impacts to property values.
Carol Fox, 741 E. Glendale Ave., spoke in favor of the overlay zone and Design Standards
and encouraged the Commission to bring it forward to the City Council. She stated there are
very few houses in the tracts that could comply with the guidelines for second-story
additions.
Steve Prothero, 741 E. Briardale Ave., has been an Eichler homeowner for 38 years and

spoke in opposition of second story additions, as they were never intended to have two
stories.
John Thorne, 1291 N. Linda Vista St., stated the homes are distinctive, simple and support a
good lifestyle. He is not in favor second floor additions.
Thuy and Adrian Turner, 3810 E. Fernwood Ave., agreed with previous speakers and are
opposed to second stories.
Hanh Bannister (no address given) spoke in opposition of second stories due to privacy
impacts.
Chair Glasgow asked staff which units would allow for second-story additions and if there
would be a change in land use designation.
Ms. Moshier responded that based on the standards, a feasible lot would have to be deep, one
that does not back up to another Eichler home or may be located on the corner lot. Only 5 to
10% of the properties would qualify. The Land Use is single-family residential, R-1-8 and
will not change.
Commissioner Correa commented that second stories do not fit the community and change
the character of what Mr. Eichler intended the tract to be. He would not support two-story
homes.
Commissioner Simpson supported the staff's recommendation for addressing second stories
as presented in the Design Standards; it is what the community wants and feels guidelines in
Section 5.1 are stringent enough.
Commissioner Willits spoke in favor of the prohibition of second stories.
Commissioner Gladson supported the historic overlay district, was in favor of the prohibition
of second stories and liked that non-contributing homes could become contributing.
Chair Glasgow stated this document was long overdue and Mr. Eichler did not intend for the
homes to be two-story tracts. He is in favor of the Design Standards. He feels the Design
Standards were stringent on what could be done to a house and he would like to leave the
allowance for second stories in because there may be a point in time when someone in a cul-
de-sac would like to add a second story. He was willing to make a motion with a two-story
overlay portion left in the document; if it does not carry, a single-story limitation could be
included in a second motion.
Gary Sheatz, Senior Assistant City Attorney, explained that section 5.1 of the Design
Standards allows for second stories in very limited instances. The motion can move the
recommendation on to the City Council as presented by staff, which would allow second
stories in limited situations. Staff has not provided a second resolution for a single-story
overlay.

Ms. Moshier explained the motion in the second instance would be to recommend approval
of the Design Standards to the City Council with a revision to eliminate Section 5.1.6 which
allows for second stories and replace it with a statement that prohibits any two -story
construction.
Mr. Sheatz stated that making the motion and striking Section 5.1 would allow the two-story
additions, the effect of that would be a single-story overlay.
A motion was made to Adopt Planning Commission Resolution No. PC 30-18 entitled:
A resolution of the Planning Commission recommending City Council approval of Zone
Change No. 1291-18 to create a Historic District Overlay Zone for three Eichler Tracts
and adoption of the Orange Eichler Design Standards.
Mr. Sheatz corrected the motion to read: Adopt Planning Commission Resolution No. PC
30-18 entitled: A Resolution of the Planning Commission recommending City Council
approval of Zone Change No. 1291-18 to create a historic district overlay zone for three
Eichler tracts and adoption of the Orange Eichler Design Standards.
Bill Crouch, Community Development Director approached and clarified that if the motion
carries, they are allowing the possibility for second story additions.

Orange Eichler Design Standards with the removal of Section 5.1.6 to prohibit two-
story construction in the historic districts.
