_02212018-319Planning Commission February 21, 2018 1 Final Minutes Planning Commission February 21, 2018 City of Orange Monday 7:00 p.m. PRESENT: Commissioners Simpson, Correa, Glasgow, Gladson and Willits ABSENT: None STAFF PRESENT: Anna Pehoushek, Assistant Community Development Director Gary Sheatz, Senior Assistant City Attorney Simonne Fannin, Recording Secretary REGULAR SESSION 1.1 CALL TO ORDER: Chair Glasgow called the meeting to order at 7:00 p.m. 1.2 FLAG SALUTE: Chair Glasgow led the flag salute. 1.3 ROLL CALL: All Commissioners were present. 1.4 PUBLIC PARTICIPATION: None 1.5 CONTINUED OR WITHDRAWN ITEMS: None 1.6 PLANNING MANAGER REPORTS: Anna Pehoushek, Assistant Community Development Director provided an update on the remodel of the City Council Chambers which will begin in March and will be completed sometime in September. Vice Chair Simpson indicated that the OCTA Board Room could be on option for meeting locations if needed. 1.7 Announcement of Appeal Procedures: Chair Glasgow provided an explanation of the appeal process. 1.8 Election of Chair and Vice Chair: A motion was made for Chair Glasgow and Vice Chair Simpson to remain in their current positions for an additional year for the sake of continuity. Planning Commission February 21, 2018 3 2.2 ADOPT PLANNING COMMISSION RESOLUTION NO. 4-18 DENYING APPEAL NO. 0551-18 OF A COMMUNITY DEVELOPMENT DIRECTOR APPROVAL OF ADMINISTRATIVE DESIGN REVIEW NO. 0093-17 AND MINOR SITE PLAN NO. 0923-17 APPROVING CONSTRUCTION OF A NEW SINGLE FAMILY RESIDENCE AND ACCESSORY DWELLING UNIT ON THE VACANT PROPERTY LOCATED AT 837 AND 839 N. CAMBRIDGE STREET A motion was made to adopt Planning Commission Resolution No. 4-18 entitled Resolution for the Planning Commission for the City of Orange denying appeal No. 0551 – 18 approval of Administrative Design Review No. 0093 – 17 and Minor Site Plan No 0923-17 approving construction of a new single family residence and accessory dwelling unit on the vacant property located at 837 and 839 N. Cambridge Street; it is also CEQA except. NEW HEARING: 3.1 THE PROPOSED AMENDMENT TO THE DESIGN STANDARDS FOR THE AMENDMENT TO THE SOUTHWEST PROJECT AREA REMOVES CONTENT RELATED TO THE OLD TOWNE THEMATIC DISTRICT, WHICH INCLUDES A PORTION OF THE OLD TOWNE ORANGE HISTORIC DISTRICT. THIS ACTION IS INTENDED TO CLARIFY THAT THE HISTORIC PRESERVATION DESIGN STANDARDS FOR OLD TOWNE IS THE ESTABLISHED POLICY DOCUMENT FOR DESIGN REVIEW IN THE HISTORIC DISTRICT. LOCATION: PORTIONS OF OLD TOWNE LOCATED WITHIN THE BOUNDARIES OF THE FORMER MERGED AND AMENDED SOUTHWEST REDEVELOPMENT PROJECT AREA. NOTE: The amendment to Design Standards for the Amendment to the Southwest Project Area (Southwest Design Standards) that removes content related to the Old Towne Thematic District is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines 15308 (Class 8 - Actions by Regulatory Agencies for Protection of the Environment) and 15331 (Class 31 - Historical Resource Restoration/Rehabilitation). The amendment deletes text and modifies graphics related to a geographic area of the former Merged and Amended Southwest Redevelopment Project Area that falls within the boundaries of the Old Towne Orange Historic District in order to recognize the 2017 update to the Historic Preservation Design Standards for Old Towne (Old Towne Design Standards) as the primary policy document regulating historic properties. The Old Towne Design Standards are intended to protect and preserve the character of Old Towne as a historic district by assuring the maintenance and protection of the environment through the preservation of historic resources and appropriate standards for new construction in the historic districts, as required by the Class 8 exemption. In addition, the Old Towne Design Standards are written such that projects that are found to be in conformance with the Design Standards also will be in conformance with the Secretary of the Interior’s Standards for the Treatment of Historic Properties (Secretary’s Standards). The Old Towne Design Standards are consistent with and uses extensive guidance from the National Park Service on interpreting and implementing the Secretary’s Standards, including the Guidelines for Preserving, Rehabilitating, Restoring, and Reconstructing Historic Buildings. The content of the Southwest Design Standards pertaining to the Old Towne Historic District has not been entirely consistent with either the Old Towne Design Standards or the Secretary’s Standards. Therefore, removal of Old Towne content from the Southwest Design Standards results in clarified City policies with respect to project implementation in conformance with the Secretary’s Standards as described in the Class 31 exemption for Historical Resource Restoration/Rehabilitation. No public review is required. RECOMMENDED ACTION: Adopt Planning Commission Resolution No. 5-18 recommending an amendment of the Design Standards for the Amendment to the Southwest Project Area to remove content related to the Planning Commission February 21, 2018 5 Old Towne Thematic District to the City Council Anna Pehoushek, Assistant Community Development Director introduce the item and provided an explanation consistent with the staff report. She provided background and stated the purpose of the amendment is to eliminate all content related to Old Town to clearly establish the 2017 update to the Old Town Design Standards as the guiding design standards for the historic district. Commissioner Correa stated for the record that Councilmember Alvarez asked him why he voted to allow the deletion of Planning Commission's review and approval of accessory dwellings units. He explained the State of California removed the City's authority; the review standards by City staff have not changed and all commercial buildings will still come before the Planning Commission. Commissioner Gladson wants staff to make sure any exhibits that make reference to Old Town are removed from the document. Anna Pehoushek stated there is an attachment to the staff report which identifies all of the exhibit deletions. The final clean version will be presented to the City Council. Commissioner Simpson stated a comment should be added that the Redevelopment Agency no longer exists. Anna Pehoushek added that in the coming year, staff will be taking a comprehensive look at the Southwest Design Standards and The Tustin Street Design Standards together because there is a redevelopment area there as well.
