REGULAR SESSION
1.1 CALL TO ORDER: Chair Glasgow called the meeting to order at 7:01 p.m.
1.2 FLAG SALUTE: Commissioner Correa led the flag salute.
1.3 ROLL CALL: Commissioner Simpson was absent. All other Commissioners were present.

1.6 PLANNING MANAGER REPORTS: Anna Pehoushek, Assistant Community Development
Director explained the agenda was revised in order to provide a resolution of denial for Conditional
Use Permit 3003 – 16.
2. CONSENT CALENDAR:
2.1 APPROVAL OF MINUTES FROM THE REGULARLY SCHEDULED MEETING
OF DECEMBER 18, 2017.
2.2 ADOPT PLANNING COMMISSION RESOLUTION NO. 02-18 DENYING
CONDITIONAL USE PERMIT NO. 3003-16, TO ESTABLISH A NEW
ALCOHOLIC BEVERAGE CONTROL (ABC) TYPE 20 (OFF-SALE BEER &
WINE) LICENSE TO ALLOW THE SALE OF ALCOHOLIC BEVERAGES (BEER
AND WINE) FOR OFF PREMISE CONSUMPTION AT A NEW APPROVED
CONVENIENCE STORE.

3. NEW HEARING:
3.1 ORDINANCE AMENDING CHAPTER 17.08 OF THE ORANGE MUNICIPAL
CODE RELATED TO NOTICING REQUIREMENTS IN HISTORIC DISTRICTS
An Ordinance amending Section 17.08.040 of the Orange Municipal Code to modify the
notification requirements for certain types of Design Review projects in the Old Towne
Historic Districts.
LOCATION: Old Towne Historic District
NOTE: Per California Environmental Quality Act (CEQA) Guideline 15378, the draft Zoning
Ordinance Amendment is not a project, because project noticing is an administrative
activity of a local government that does not have the potential to result in a direct or
reasonably foreseeable indirect physical change to the environment. Because the
amendment is not a project, it is not subject to the provisions of CEQA and no public
environmental review is required.
RECOMMENDED ACTION:
Adopt Planning Commission Resolution No. PC 01-18. Recommending City Council
approval of an Ordinance amending Title 17 of the Orange Municipal Code to establish
notification requirements for design review projects involving construction of second
stories or additional units on properties in residential zones within the boundaries of an
established historic district
Marissa Moshier, Historic Preservation Planner provided an explanation consistent with the staff report.
Staff drafted an amendment that requires posted notices at the subject property in advance of the Design
Review Committee meeting and mailing notices to property owners and residents within a 300 foot radius.
Ms. Moshier noted that while staff was recommending a 300 foot notification radius to be consistent with
the city’s typical notification practices, staff also considered an alternate approach that would consist of
mailed notices to adjacent owners that share property lines or to properties that are located directly across
the street or an alley. This would reduce the amount of administrative staff time and be more cost and time
effective for property owners.
Commissioners were in agreement that the 300 foot radius notice requirements was preferable.
Chairman Glasgow stated his concern about reducing the 300 foot radius noticing requirements and would
like it to remain the same as it is.
Gary Sheatz, Senior Assistant City Attorney reiterated that the staff recommended the 300 foot notification
radius which was consistent with other planning- related noticing procedures. Staff simply wanted to
advise the Commission that they did look into an alternative option.
Anna Pehoushek, Assistant Community Development Director clarified that the adoption of the Old
Towne Design Standards eliminated the requirement for Planning Commission's approval of a CUP
however; these types of applications would go directly to the Design Review Committee for an extensive
for review final approval.

A motion was made to adopt Planning Commission Resolution No. 01-08 recommending
City Council approval of an ordinance amending Chapter 17.08 of the Orange Municipal
Code to establish notification requirements for design review projects involving
construction of second stories or additional units on properties in residential zones within
the boundaries of an established historic district.
