SUBJECT Resolution No. 11120 — A Resolution of the City Council of the Ciiy of Orange authorizing application for funds for the 2019 Bicycle Corridor Improvement Program(BCIP). 2. SUMMARY Resolution No. 11120 is required to be adopted as part of the application package for the BCIP Funding Program for the Environmental and Preliminary Engineering Phase of the Santiago Creek Multi-Purpose Trail Extension Project. If funded the City of Orange will commit $97,532 of General Fund and developer contributions and will provide 22% of the total project cost as , match to the requested $345,794 in Orange County Transportation Authority (OCTA) Congestion Mitigation and�Air Quality Improvement Program Funding (CMAQ) funds for a total project cost estimated to be $443,325. 3. GENERAL PLAN IMPLEMENTATION Circulation & Mobility 1.0: Provide o safe, efficient, and comprehensive circulation system that serves local needs,meets forecasted demands, and sustains quality of life in neighborhoods. Policy 1.1: Plan, build, and maintain an integrated, hierarchical, and multi-modal system of roadways, pedestrian walkways, and bicycle paths throughout the City Circulation&Mobility 2.0: Provide an effective regional transportation network. Policy 2.6: Encourage the use of regional rail,transit, bicycling, carpools, and vanpools for work trips to relieve traffic congestion. Circulation & Mobilitv 4.0: Provide efficient and accessible modes of pedestrian, bicycle, and equestrian transportation and improved facilities and amenities. Policy 4.1: Create a comprehensive bicycle network that is integrated with other transportation systems by establishing complementary on-street and off-street facilities as identified in the City of Orange Bikeways Master Plan and OCTA Commuter Bikeways Strategic Plan, including Santiago Creek,the Santa Ana River, and the Tustin Branch Trail. 7. DISCUSSION and BACKGROUND The City plans to submit an application for funds for the 2019 BCIP call for projects for the Santiago Creek Multi-Purpose Trail Extension Project. OCTA is responsible for selecting regionally significant projects for Orange County and working with the California Department of Transportation (Caltrans) in administering selected projects. The 2019 BCIP call is funded using ten percent of OCTA's annual CMAQ apportionment and prior BCIP project savings. The 2019 BCIP call will program funds in Fiscal Year 2019-2020 through 2023-2024. Currently the call is estimated to be approximately $25 million. Project applications are limited to either environmental or implementation phases,with a maximum request limit of$500,000 and $4 million, respectively. The City will be applying for the environmental phase of the project. If granted the funding, the City will finalize the environmental portion of the project and be eligible to submit for a future call for projects for the implementation phase. The BCIP call for projects is anticipated to be on a two-year cycle. A minimum local match of 12% of each project phase cost is required. Local agencies may provide an "overmatch" for the project; that is, they can contribute additional match dollars beyond the minimum match requirement. The City will commit a 10% overmatch to receive ten additional points in the evaluation process for providing matching funds above the minimum requirement. The City has previously submitted a grant application through the State 2019 Active Transportation Program (ATP) for about $10.8 million covering 100% of engineering, right-of- � way, environmental, and construction costs. This BCIP application just gives the City another opportunity for funding preliminary engineering and environmental phases of the project in case we are not awarded the ATP grant. ITEM . 2 11/13/18 This project is the final phase of the Santiago Creek Bike Trail alignment in the Master Bikeway Plan. Construction of the multi-purpose trail will connect the existing bike trail west of Cannon Street and parallel the existing equestrian trail on the northern bank and will terminate at the Santiago Oaks Regional Park. The project will construct an asphalt concrete bike trail and rehabilitate the existing equestrian trail with decomposed granite along with needed amenities such as rest areas and trash receptacles. The trail will allow for pedestrian and bicycle traffic along an eight-mile stretch of trails. After the applications are reviewed by OCTA for overall compliance, an advisory panel will review and rank projects. A recommended priority list of projects is scheduled to be forwarded to the OCTA Board for approval in March 2019. If the project is funded the City will enter a cooperative agreement with OCTA as required to secure the 2019 BCIP funding. 8. WHEREAS, the United State Congress enacted the Fixing America's Surface Transportation (FAST) Federal Transportation Act on December 4, 2015, which makes Congestion Mitigation and Air Quality Improvement Program (CMAQ) funds available to the Orange County Transportation Authority(OCTA); and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS,CITY OF ORANGE possesses authority to nominate bicycle projects funded using Congestion Mitigation and Air Quality Improvement Program funding and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the City Council authorizes the nomination of Santiago Creek Multi-Purpose Trail Extension Project, including all understanding and assurances contained therein, and authorizes the person identified as the official representative of the City of Orange to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Orange will maintain and operate the property acquired, developed,rehabilitated, or restored for the life of the resultant facility(ies) or activity; and WHEREAS,with the approval of the Califor'nia Department of Transportation(Caltrans) and/or OCTA, the City of Orange or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Orange will give Caltrans and/or OCTA's representatives access to and the right to examine all records,books,papers or documents related to the bicycle project; and WHEREA5, the City of Orange will cause project work to commence within six months following notification from the State or OCTA that funds have been authorized to proceed by the Federal Highway Administration or Federal Transit Administration and that the project will be carried to completion with reasonable diligence; and WHEREAS, the City of Orange commits $97,532 of General Fund and Developer Contributions and will provide 22%of the total project cost as match to the requested$345,794 in OCTA CMAQ funds for a total project cost estimated to be$4443,325 WHEREAS, the City of Orange may elect to commit additional funds to the Santiago Creek Multi-Purpose Trail Extension Proj ect,to fund an expanded scope which provides additional quantifiable benefits. The City of Orange is required to notify OCTA to grant approval prior to commencing on the additional scope; and WHEREAS, the City of Orange will comply where applicable with provisions of the California Environmental Quality Act,the National Environmental Policy Act,the American with Disabilities Act,Federal Title VI,Buy America provision,and any other federal,state,and/or local laws,ntles and/or regulations; and WHEREAS,the City of Orange's City Council authorizes the execution of any necessary cooperative agreements between the City of Orange and OCTA to facilitate the delivery of the proj ect; and WHEREAS, the City of Orange will amend the agency Capital Improvement Program (CIP)to include the project if selected for funding; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange hereby authorizes FRANK SUN as the official representative of the City of Orange to apply for the Congestion Mitigation and Air Quality Improvement Program funding under the Fixing America's Surface Transportation Act for Santiago Creek Multi-Purpose Trail Extension Project BE IT FURTHER RESOLVED that the City Council of the City of Orange agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
