SUBJECT � Resolution No. 11117 — A Resolution of the City Council of the City of Orange summarily vacating a portion of road easement at 5242 E. Lomita Avenue as excess street right of way that is no longer needed for street purposes. 2. SUMMARY Adoption of Resolution No. 11117 will operate to cause a City road easement at 5242 E. Lomita Avenue as excess street right of way that is no longer needed for street purposes, excepting�and reserving any existing public utility easements. 3. RECOMMENDED ACTION � Adopt Resolution No. 11117. 4. FISCAL IMPACT None. 5. STRATEGIC PLAN GOAL(S) 1. Provide for a safe community— b. GENERAL PLAN IMPLEMENTATION Economic Develonment Goa14.0: Encourage economic development efforts through outreach and maintenance of a pro-active business environment. Policy 3.1: Where appropriate, consolidate inadequately sized land or land owned by multiple owners into parcels suitable for integrated development with improved pedestrian and vehicular circulation. 7. BACKGROUND and DISCUSSION The subject road and public utility easement on a vacant parcel of land located at 5242 E. Lomita Avenue was reserved in a grant deed between individuals when the property was conveyed in 1958 (Grant deed recorded May 27, 1958, Book 4297, Page 381). Lomita Avenue is a private street and the road easement crossed over a private parcel to a large parcel. That large parcel today is now El Modena open space and is accessed from Cannon Street and not via this road easement. This road easement traverses over steep terrain covered in dense brush and has never been graded or improved for access. The owner has requested the City to vacate the road easement crossing the vacant lot, thus removing the burden on the title of the property. The property owner has paid the $1,300 street vacation application fee. The City Engineer has determined the road easement is not needed for City or public purposes in the futttre and will not be improved. The City is authorized to sluninarily vacate an easement for street purposes (i.e., notice is not required) which has been dedicated to it if: (1) the property is no longer needed for street purposes; (2) the easement being vacated is totally within the property of one owner; and (3) the easement does not touch upon the property of another property owner. This easement is not needed for present or prospective road projects. The easement is totally within the ownership of one property owner. As such, staff recommends the adoption of Resolution No. 11117 by City Council vacating this road easement, excepting and reserving any existing public utility easements. 8. AT 5242 E. LOMITA AVENUE AS EXCESS STREET RIGHT OF WAY THAT IS NO LONGER NEEDED FOR STREET PURPOSES. WHEREAS, pursuant to Streets and Highways Code Sections 8334, the City may summarily vacate an excess street easement if the easement is no longer required for street , purposes and it lies within property under one ownership and does not continue through such ownership or end touching the property of another; and WHEREAS, the City Counci�l of the City of Orange hereby finds and determines that � the road easement on a portion of Parcel 1, of Parcel Map 82-134 and more particularly described as Road Easement Reservation on Grant Deed recorded May 27, 1958, in Book 4297, page 381 in Book of Miscellaneous Maps in the office of the CounTy Recorder is no . longer needed for street purposes, lies within property under one ownership and does not continue through such ownership or end touching the property of another; and WHEREAS, all existing public utility easements, if any, shall be reserved; and WHEREAS, the City Council finds and determines, based upon the existing uses of the subject real property, that the proposed vacation of the subject real property will not result . in a direct or reasonably foreseeable indirect physical change in the environment and is not, therefore, subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15060 of the State CEQA Guidelines; and WHEREAS, pursuant to Section 65402 of the California Government Code, the City Gouncil finds and determines that the location, purpose and extent of the proposed vacation of the subject real properiy has been reported on by the Director of the Community Development Department of the City of Orange and that said proposed vacation of the subject real property conforms to the City's adopted general plan. NOW THEREFORE, the City Council resolves, on the basis of the facts set forth in� the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows: Section 1. The foregoing recitals are true and correct. Section 2. Pursuant to Division 9, Part 3, Chapter 4 of the Streets and Higliways Code (commencing at Section 8330), the road easement on a portion of Paxcel 1, of Parcel Map 82-134 and more particularly described as Road Easement Reservation on Grant Deed recorded May 27, 1958, in Book 4297, page 381 in Book of Miscellaneous Maps in the office of the County Recorder is hereby vacated effective upon recordation of this Resolution in the Official Records of the County of Orange, State of California(the "Official Records"). Section 3. The City reserves and accepts from such vacation all existing easements for public utility facilities purposes and any right necessary to maintain, operate, replace, remove or renew such public utilities or other public improvements within the subj ect easement. - , Section 4. The City Clerk is hereby authorized and directed to cause a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgement, certificate of acknowledgement, or further proof in the Official Records. Section 5.
