GENERAL PLAN IMPLEMENTATION Circulation and Mobilitv Element Goal 1.0: Provide a safe, efficient, and comprehensive circulation system that serves local needs, meets forecasted demands and sustains quality of life in neighborhoods. Policy 1.2: Identify key intersections and streets with historical or projected traffic congestion problems and apply creative management measures to improve overall circulation. 7. DISCUSSION and BACKGROUND The Meats/Tustin critical intersection improvement project was approved by City Council o approximately ten years ago. With limited funding, the City was able to improve three of the four corners in 2011. Because of a lack of funding at the time, the southeast corner was not improved at that time. With new funding, the City is now able to improve the southeast corner and complete the Meats/Tustin critical intersection improvement project. There are three privately owned properties that are affected as part of the southeast corner improvement project. They are the Orange-Villa Park Motel (2085 N. Tustin St.), a 4-unit strip center (2091-2097 N. Tustin St.), and Primm Jewelers (1736 E. Meats Ave.). The City real property agent has completed negotiations with the first two property owners and the Primm Jewelers property is the only remaining property needed for this project. The City needs 304 s.f. of the Primm Jewelers' property. The City engaged the services of a M.A.I. real estate appraiser in March 2017. The appraised value was $22,570. The City proceeded to make a purchase offer to the property owner in that amount. The property owner retained an attorney and obtained their own appraisal in June 2017. They made a counteroffer to the City in the amount of$158,000. After a series of negotiations, the properly owner suggested trading his 304 s.f. for the City's dead end portion of Park Lane. This dead end portion of Park Lane is encumbered with City water and sewer pipelines, Orange County Sanitation District (OCSD) sewer pipe, Southern California Edison (SCE) power pole. The property is also encumbered with an access easement to the parcel located to the south. The City's appraiser determined the remaining usable area to be about 3,340 sf and with 70%-75% discount due to various factors (easements encumbrances, limited use, and irregular shape), the dead end Ciiy property is valued between $52,188 to $62,625. Since this exchange will relieve the City from future maintenance responsibility of the site, staff believes this is a fair exchange. ITEM 2 11/13/18 The City proposed a trade to obtain the 304 s.f. in a detailed offer letter dated September 19, 2018. The points of that trade offer are: 1. The property owner will deed in fee the 304 s.f. of Primm Jewelers' property to the City, 2. The City will deed in fee, 6,580 s.f. of the Park Lane dead end street to Primm Jewelers', 3. The City will retain a 10' wide irrevocable dedication for future street and public utilities along the northerly border, 4. The City will retain an ingress/egress easement of 2,267 s.f. in favor of the parcel adjacent to the southerly boundary, 5. Each party to the property exchange (Primm Jewelers and the City) will be responsible to pay their fair share of escrow fees and charges. 6. The City will complete additional landscaping improvement in the planter area and will install 10' landscaped strip along Meats. A companion agenda report (Resolution 11115) on the agenda tonight to declare the dead end portion of Park Lane surplus property, and that it will no longer be needed for any City purposes now or anticipated. The resolution made that portion of Park Lane surplus to City needs and retained the public utility easements. 8. This project will require the acquisition of fee title to a small portion of your total property(304 square feet), hereafter referred to as the Prim Jewelers Property. The legal description of the property to be acquired by the City is attached hereto as Street Ri h� Way Dedication, Exhibit A and shown on a map attached hereto as Exhibit B. It has been expressed by your attorney, Mr. Leon Alexander, it is your desire to acquire the City cul- de-sac ("City Property")behind your property. It is estimated by your appraiser(Lidgard)that the City Property is 2,750 square feet(+/-). Without a field survey and the area mapped,the exact square footage is unknown. The City has retained the surveying services of Joseph C. Truxaw and Associates, Inc. ("Truxaw Associates")to survey the City Property and produce a legal description of the property. This is attached hereto as Ci Propertv to be Exchan�ed, Exhibit A and shown on a map hereto as Exhibit B. The Lidgard estimate of the City Property is greatly erroneous. The actual City Property is 6,580 square feet per the Truxaw Associates survey. I have been working closely with Mr. Alexander and we both believe that we can provide a solution � that would require no money to change hands�and both parties would receive the properties they � desire. The solution would be a simple exchange of your 304 squaxe foot property(Prim Jewelers Property) for the City Property of 6,580 square feet. As part of this property exchange agreement,this sign would be relocated to another location on the shopping center property when the street widening project takes place. The relocation expense of tne sign would be borne by the City as part of the project. On the City Property, an access easement to the church located on the south side �would be retained. This is attached heretq as Tn re�Egress Easement, Exhibit A and shown on a map hereto as Exhibit B. This easement area is 2,267 square feet. In addition, an irrevocable offer of dedication of 10' on the north side of the City Property would be offered. The City has no intention of accepting the dedication at this time. That offer of dedication would only be accepted by a City resolution if and when Meats Avenue in the location is widened. Both parties,Mahroukian and the City agreed in concept for the exchange of properties as detailed in the attached May 14, 20181etter. Upon the signing of the letter by the Mahroukians,the City proceeded with the retention of surveying services by Truxaw Associates. Now that the legal descriptions,plat maps, and determination of fee ownership of the cul-de-sac by the City, the parties can now move forward with the property exchange. As noted in the May 14, 20181etter for the conceptual exchange of properties, both parties are , responsible for their own fair share of escrow charges as are typically charged and allocated.in Southern California escrows and documentary transfer tax.
