1. SUBJECT
Resolution No. 11115 — A Resolution of the City Council of the City of Orange finding that
certain City-owned real property known as Park Lane dead end, located adjacent and east of 1736
E. Meats Avenue in the City of Orange is surplus to the City's needs and authorizing the disposal
of said property.
2. SUMMARY
Adoption of Resolution No. 11115 will operate to cause a City owned, vacant, real property
known as Park Lane dead end, located adjacent to and east of 1736 E. Meats Avenue, to be
declared surplus to the City's needs and declare it available for disposal.
3. RECOMMENDED ACTION
Adopt Resolution No. 11115.

� 7. BACKGROUND and DISCUSSION
The subject property was part of a larger parcel of land purchased by the State of California from
a private party in 1961 when they constructed the 55 Costa Mesa Freeway and the Meats Avenue
', bridge that crosses over the freeway (recorded 1/25/1961, book 5603, page 394). Upon
� completion of the freeway and bridge project, the State of California relinquished the remainder
, remnant parcels to the City of Orange, including the subject property in 1966 (recorded
I 10/5/1966, book 8067,pages 780-782).
� At the time of the relinquishment, the subject parcel was utilized as the Paxk Lane entrance street
from Meats Avenue. Soon afterwards, there was the construction of Orange Mobile Home Park
at 1931 E. Meats Avenue. The mobile home park had a public street frontage road that exited
onto Meats Avenue approximately 75' east of the Paxk Lane entrance onto Meats Avenue. In the
interest of safety, and also to facilitate the possibility of the installation of traffic signals in the
future, the Park Lane entrance was moved easterly to line up with the mobile home park frontage
road exit on Meats Avenue. Thus, the cut off portion of Park Lane became a dead end. Being a
dead end street, it is not used for through traffic and has been a source of maintenance issues with
trash, abandoned mattresses, vehicles, etc.
The subject property is 6,580 square feet. The highest and best use of the subject property is as
assemblage to one of the adjacent parcels. Upon the City Council declaring the property surplus,
the City intends to trade it with the adjacent property owner for property that is needed for the
Meats Avenue Intersection Improvement project. The City would reserve all public utility
easements that are on the property. In addition to an ingress/egress easement of 2,367 square feet
to allow access to the church property on the south side of the subject property, the City would
also reserve an irrevocable offer of dedication of the northerly 10' of the subject parcel in case
Meats Avenue is widened in the future.
With the public utility easements on the property and the additional easements reserved by the
City, the parcel has limited use. With the proposed exchange for right-of-way needed for the
' Meats Avenue and Tustin Street critical intersection improvement, the City will no longer need
to incur any more expense in maintenance of the property.
Since the subject property is greater than 5,000 square feet, the City has notified other agencies
and low income housing groups regarding the surplusing of the property per section 54221 of the
Government Code.

The City Fire, Police, Public Works, and Community Services Departments, and the Water
Division have all been notified and the respective directors declined any interest in obtaining the
property.
Upon the adoption of Resolution No. 11115, staff will proceed with the concept of trading the
subject property with the adjacent property owner for properly that is needed to complete the
Meats Avenue Intersection Improvement project.

WHEREAS, the City of Orange (the "City") is a municipal corporation exercising
governmental functions and powers, organized and existing under the laws of the State of �
California; and.
WHEREAS, the City owns property, which is irregulaxly shaped and consists of
approximately 6,580 square feet and is commonly known as Paxk Lane dead end, located
adjacent and East of 1736 E. Meats Avenue (the "Properiy"); and
, WHEREAS, pursuant Section 65402 of the California Government Code, the City
Council finds and determines that the location, purpose and extent of the proposed
disposition of the Property, have been considered and reported on by the Director of the
Community Development Department of the Ciiy and that said proposed disposition
conforms to the City's adopted general plan; and '
WHEREAS, as authorized by California Government Code Section 37350; the City
Council finds'and determines that the Property is not needed�for the purpose for which it was ,
acquired or for any other public purpose and is,therefo"re, surplus real property; and
VVFIEREAS, this City Council, as the "lead agency" under the California
Environmental Quality Act ("CEQA"), finds and determines that the disposal of the Property is
categorically exempt from the provisions of CEQA under Section 15312 of the State CEQA
Guidelines relating to the sale of surplus government property; and
WHEREAS,the City Council believes that the sale and disposition of the Property is to
the common benefit of the City and its residents, and in accord with the public purposes and
provisions of applicable State and locallaw requirements.
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
resolves, on the basis of the facts set forth in the agenda report presented to it and any
testimony received at the meeting at which this matter was considered, as follows:
1. The foregoing recitals are true and correct.
2. The City Council� finds and determines that the Property is categorically
exempt from the provisions of CEQA under Section 15312 of the State CEQA Guidelines
because the property is of no value for wildlife or environmental purposes, and is of such an
irregular shape and size that it is incapable of independent development or use. As such, the �
City Council hereby authorizes and directs the City Clerk to file a Notice of Exemption with
the Orange County Clerk.
3. The City Council hereby�finds and determines that the Property is not needed
for the purpose for which it was acquired or for any other public purpose and is, therefore,
surplus real property, and directs staff'to solicit bids,for the sale and disposition of the
Property, which bids shall be considered at the time of bid closing by the City Council.

3.30 Exchange of City-owned real property known as Park Lane dead end for privately
owned property at 1736 E. Meats Avenue as part of the Meats/Tustin critical
intersection improvement project. (D4000.0)
ACTION: 1) Approved the exchange of City-owned real property known as Park Lane
dead end for privately owned property at 1736 E.Meats Avenue as part of the Meats/Tustin
critical intersection improvement project; 2) Authorized the Mayor and City Clerk to
execute the grant deed for the City owned property; 3) Executed the acceptance of the
privately owned property; and 4) Authorized the Mayor to execute the necessary escrow
and related documents. This exchange is conditional pending the expiration of the 60 days
surplus notification and no agency is interested in purchasing the City property.
