1. SUBJECT
Request for the installation of a Neighborhood Parking Permit Program for North Highland
Street, East Mayfair Avenue, East Lomita Avenue, East Barkley Avenue, North Victoria Drive,
North Russell Drive, North Shirley Drive, and East Rose Avenue.
2. SUMMARY
A request to implement neighborhood permit parking in order to provide residents with a
reasonable expectation of parking in proximity to their homes. The applicant circulated a petition
and received enough support from the neighborhood to present the request to the City Traffic
Commission, and subsequently to the City Council at a future meeting.
3. RECOMMENDED
Recommend the City Council approve the request to implement permit parking.

7. DISCUSSION and BACKGROUND
Background
Mr. Bob Guthrie of 651 North Highland Street submitted a request with a $1,000 deposit to
initiate the process for neighborhood permit parking on February 2, 2018. Bob Guthrie lives in
the neighborhood that includes North Highland Street, East Mayfair Avenue, East Lomita
Avenue, East Barkley Avenue, North Victoria Drive, North Russell Drive, North Shirley Drive,
and East Rose Drive. Upon submission of the application fee, Traffic Division staff initiated the
parking occupancy study to determine which streets met minimum eligibility under the program
guidelines.
Existing Conditions
Staff mapped and counted the number of legal parking spaces for each street in the study area.
Because the demand for on- street parking was highest in the evenings staff conducted the parking
observations during those hours. Beginning at 5:30 PM and progressively later each night staff
made eight observations in the subject neighborhood including one Sunday observation. The
minimum level of parking occupancy established in the Permit Parking Resolution is 75 %. The
level of parking occupancy observed by staff for all the streets in the study area is 75.6%
After the minimum parking demand threshold was met, the proponent then provided staff with
the remaining $1,500 application fee to cover the petition phase costs. A petition letter and a list
of permit parking advantages and disadvantages were provided by the Traffic Division to Mr.
Guthrie, with instructions to make a good faith effort to contact all the addresses on the petition.
Traffic Division staff also sent petition letters to all absentee property owners for renter occupied
properties under the policy guidelines. The table below shows the results of the neighborhood
polling.

For non - returned petitions, Traffic Division staff made a second attempt to notify the property
owners of the active permit parking petition process and request the return of a filled out petition
to the City, which did garner further submissions.
The final results of the petition indicate 75.7% of property owners are in favor of the permit
parking program, which exceeds the minimum 75% required under the program implementation
policy. Once approved for implementation, the Orange Police Department will issue the permits
for eligible households. Participation in the permit program is voluntary; however, after
implementation any vehicle parked on the street without a permit can be cited.

Analysis
Staff has documented a consistently high demand for on- street parking in the subject area that
becomes progressively greater through the evening hours. The level of parking demand exceeds
the minimum requirements under the policies of the Neighborhood Parking Permit Program. The
subject neighborhood has met all requirements described in the Neighborhood Parking Permit
Resolution and therefore qualifies for implementation of the permit parking program.
The Traffic Commission may consider limited hours of implementation as part of the
recommendation to City Council, from 5 PM to 5AM, based upon the parking occupancy study
results. This may maximize the benefits of permit parking to the applicant neighborhood while
minimizing impacts to adjacent property use (multi - family) and would allow daytime parking for
visitors, contractors, and other services to the neighborhood without requiring a permit from the
property owner. The Neighborhood Parking Permit Program Implementation Policy (attached)
suggests targeted hours as a way to balance competing parking needs.
Recommendation
Based on the analysis staff recommends that the Traffic Commission approve the implementation
of a Neighborhood Parking Permit Program for the following street segments and forward to the
City Council for final action:
• The south side of East Rose Avenue from 1932/1934 to North Highland Street.
• Both sides of North Highland Street from East Rose Avenue to East Barkley Avenue
• Both sides of East Mayfair Avenue from 1740 East Mayfair Avenue to North
Highland Street.
• The south side of East Lomita Avenue from 1734/1736 to North Highland Street
• The north side of East Lomita Avenue from 1901 to North Highland Street
• Both sides of East Barkley Avenue from the cul -de -sac to North Highland Street
• Both sides of the cul -de -sac streets of North Victoria Drive, North Russell Drive, and
North Shirley Drive north of East Mayfair Avenue.
• Consideration of limited hours, from 5 PM to 5 AM as recommended in the
Implementation Policy.
It should be noted on street parking on the sections of East Lomita and East Rose Avenues not
noted above will remain unrestricted.
The proponent and all residents and businesses within potential impact areas of this
neighborhood were notified of this item on Traffic Commission Meeting agenda.

I am asking for some help and direction due to an escalating problem within the
neighborhood. I have lived here in Orange for 29 Years, after servicing 8 years in the
Marine Corp I fell in love with the city and have raised my family here.
My wife and I have even opened a Mortgage and Real Estate company within the city.
The problem is a parking issue within this neighborhood, due to an apartment complex
around the corner. They at one time had open parking stalls and now they have placed
garage doors on the car port stalls, so the occupants are not using the stalls for parking.
We the home owners are now dealing with the parking over flow,
It has gotten to the point that we have seen cars with vandalized broken windows and
flat tires, Police records should show that.
It has also become so bad that it has become a safety issue for my wife and niece to
walk the streets at night after coming home from a long day or night at work.
They are unable to find parking close to the house.
This is not right.
I have viewed on the City of Orange web site that we have a Neighborhood parking
permit program. But I did not find the application forms or who to send in to, that is why
I have sent this to you.
I have already started talking to all the neighbors so I know we can get the majority rule.
The street is Highland between Mayfair and Rose.

Advantages and Disadvantages
Please read the following summary of the advantages and disadvantages of implementing a neighborhood
parking permit program. Sign the petition and choose whether you oppose or favor a parking permit program in
your residential neighborhood.
Advantages
1. The Neighborhood Parking Permit Program allows the residents of a candidate neighborhood the
ability to park within a reasonable distance to their homes.
2. The Parking Permits will reduce the level of parking demand on residential streets that is being
generated by sources outside of the neighborhood.
3. Parking permits are good for three (3) years.
4. Participation in the permit program is voluntary. However, all non - permitted vehicles must be
parked off street.
5. Temporary (one -day) visitor parking permits may be obtained for special occasions from the Police
Department (Monday thru Thursday during business hours, no exceptions).
6. Permit areas are enforceable seven (7) days a week, including holidays and weekends.
7. Vehicles with disabled placards are exempt in permit parking areas.
Disadvantaees
1. Vehicles parked on the street without permits are subject to parking restrictions and citation, even
if they belong to residents or their visitors.
2. The parking permits need to be properly displayed in the vehicles.
3. Permits are limited to seven (7) permits per single - family home and four (4) permits per each unit
of a duplex.
4. Residential parking permits cost $25 and must be renewed every three (3) years.
5. Parking permits do not supersede any other posted parking restrictions, such as street sweeping.
6. Parking permits are only valid for the area they are issued for and may not be used in another
parking permit area.
7. The program does not reserve or guarantee a parking space to any resident of a permit area.
8. Lost or stolen permits will only be replaced once during the three (3) year permit period.

• The program to mitigate the intrusion of college- oriented, commercial, institutional, multi-
family residential (more than two units) or other long -term vehicular parking on streets in
residential areas to assure that local residents and their guests have convenient parking on
streets in proximity to their homes shall be referred to as the Neighborhood Parking Permit
Program.
Permit Parking shall only be permitted in single - family residential areas, where the problem
is ongoing, and it is determined that the permit parking is the only solution. Only single -
family residences and duplexes (two units on one lot) are qualified for this program.
• The Traffic Engineering Division shall determine the boundaries of the permit area for each
request.
Since Permit Parking Areas benefit certain residents, and not the general public, a "Permit
Parking Program Application Fee" $2500.00 shall be paid by the proponent(s) of each new or
additional permit area, for consideration of the implementation of permit parking. (This
could also be implemented with a $1000 deposit and an additional $1500 when the petition is
issued.)
• The neighborhood parking permit areas that are adjacent to a K -12 school shall not be
enforced during the school A.M. drop -off (from 7:30 am to 8:30 am) and P.M. pick -up time
(from 1:30 pm to 3:00 pm) on days school is in session.
Implement restricted hours for permit parking enforcement on an as- needed basis to address
Recreational Intrusions and Business Intrusions. The intent of this policy change is to
maximize the benefits of permit parking to the applicant neighborhood while minimizing
impacts to adjacent property use to balance parking need with quality of lifestyle.
• Institutional Intrusions (Universities, hospitals) shall remain 24/7/365.
• Recreational Intrusions (Parks, Schools and Sports Complexes) shall be enforced from 8:00
a.m. to 8:00 p.m. or as otherwise approved.
• Business Intrusions (Commercial Businesses) shall be enforced Monday through Friday
7:00 a.m. to 5:00 p.m. or as otherwise approved.
Implementation of Permit Parking Program areas will only be considered when the following
are satisfied:

1. The area must abut an institutional, residential apartment, commercial or industrial use
which is generating the parking intrusion.
2. A minimum of 75% of the area residents must sign the petition in favor.
3. Any identified problem must be on- going, not occasional or temporary.
4. To demonstrate a need, 75% of the available on- street space in a proposed permit area
must be occupied during the perceived problem times.
5. Staff must see evidence that required off street parking is being utilized.
• Program shall not be approved to attempt to solve social problems that should be addressed
through other means, such as Police or Code Enforcement.
• Program shall not be approved if the identified parking problems can be mitigated by less
restrictive parking control measures. Council directs staff to identify the least restrictive
permit hours to achieve the desired results.
• If recommended for approval by the City Traffic Commission, the Commission will direct the
Traffic Engineering Division to prepare a resolution for adoption by the City Council.
• Number of permits per household (single family residence) shall be limited to 7 permits
including guest permits. The total number of permits shall not exceed 7 per household.
• Number of permits for each unit of a duplex shall be limited to 2 permits (for registered
vehicles only), plus 2 guest permits. The total of permits shall not exceed 4 permits per unit.
• Permits cost $25 per household and are valid for 3 years. Permits are non - transferable and
are invalid if the registered permittee moves from the household.
• Single day event guest permit (up to maximum of 20) are available 4 times per year at no cost
to a resident.
• To minimize sign pollution, permit parking area shall be identified by area posting wherever
possible.
The City Manager /or his designee shall have the authority to suspend enforcement of
neighborhood parking permit enforcement on a case by case basis for special requests.

Steps for Implementation of a Neighborhood Parking Permit Program
• Parking Permit areas are implemented on a block -by -block basis.
• The area must abut an institutional, residential apartment, commercial or industrial use which is
generating the parking intrusion.
• Only a property owner of the candidate area may initiate the permit process.
• Since Permit Parking Areas benefit certain residents, and not the general public, a "Permit Parking
Program Application Fee" $2500.00 shall be paid by the proponent(s) of each new or additional
permit area, for consideration of the implementation of permit parking. (This could also be
implemented with a $1000 deposit and an additional $1500 when the petition is issued.)
• NOTE: Requests will not be processed until the application fees are submitted.
• Upon receipt of the letter of request and the application fee the Traffic Engineering staff will
conduct parking studies in the candidate area to determine if the proposed permit area
demonstrates a need for permits.
• To demonstrate a need, 75% of the available on- street space in a proposed permit area must be
occupied during the perceived problem times.
• Staff will identify the least restrictive permit hours to achieve the desired results.
• If the minimum parking occupancy is met, a petition that covers all of the addresses on the
affected street(s) will be mailed it to the proponent.
• The proponent circulates the petition through the neighborhood and returns it to the Traffic
Engineering Division within 45 days. The proponent shall sign under penalty of perjury that the
signatures collected are those of the identified households.
• There must be a minimum of 75% of residents in favor of the proposed parking permit
program in order for the request to receive a favorable recommendation by the Traffic
Engineering Division.
• Only property owners can sign the petition one signature per household, either spouse, is
required. Corner lots participation is limited to street frontage where the home's address is visible.
• Petition shall be read thoroughly prior to resident signing. Resident will initial the
Advantages & Disadvantages column prior to signing the petition to indicate they have read
the Pro's and Con's. The vote is final and cannot be changed.

• The Traffic Engineering Division assigns the issue to the first available Traffic Commission
agenda.
• All addresses on the petition will be notified of the Traffic Commission Meeting at least 10 days
prior to the meeting. The property owner of each address will be notified in addition to the
resident of each address, if they are different. In addition as part of the city notification practice,
all residents and businesses within a minimum 300 feet radius of the area will be notified of the
meeting 10 days prior to the meeting. The notification area may be expanded to include more
properties in proximity to the proposed permit area that receive direct benefit from the
availability of on- street parking within the proposed permit parking zone.
• If the Traffic Commission approves the request, it is then forwarded to the City Council for
final approval. The affected street(s) are added to the City's Permit Parking Resolution.
• Residents are notified as to where they can pick up their permits and when the Police Department
will begin its enforcement.
Number and Cost of Permits Per Household
• Parking Permits are for single family and duplex residential units only. Apartments, commercial
and institutional uses are not eligible to receive parking permits.
• Number of permits per household (single family residence) shall be limited to 7 permits including
guest permits. The total number of permits shall not exceed 7 per household.
• Number of permits for each unit of a duplex shall be limited to 2 permits (for registered vehicles
