Resolution No. 11049 — A Resolution of the City Council of the City of Orange finding that
certain City -owned real property located at 4537 W. Tiller Avenue (also known as Water Well
Site No. 3) in the City of Orange is surplus to the City's needs and authorizing the sale of said
property.
2. SUMMARY
Adoption of Resolution No. 11049 will operate to cause a City owned, vacant, real property
located at 4537 W. Tiller Avenue (also known as Water Well Site No. 3) to be declared surplus
to the City's needs and declare it available for disposal.

Adopt Resolution No. 11049.

17. BACKGROUND and DISCUSSION
The subject property was purchased from the City of Anaheim in 1965 (Grant Deed document
number 776800879, recorded December 9, 1965, and authorized by Resolution 65R -720). It was
formerly part of the Dyke Water Company Water Systems prior to the City of Anaheim's
ownership. When the City purchased the property, it became the City of Orange Water Well Site
No. 3. The well is now non - functional and has been filled per State of California regulations
regarding the abandonment of wells. All equipment has been removed from the property. The
Public Works Department Water Division has no future need for this property.
The property measures 25' by 60' for a total of 1,500 square feet. The property has 25' of street
frontage on Tiller Avenue. The property is undersized as a residential parcel. The highest and
best use of the property in this residential neighborhood is as assemblage to one of the adjacent
parcels.
Since the subject property is less than 5,000 square feet and is less than the legal minimum
residential building lot size for the area, the City is exempt from notifying other agencies and low
income housing groups regarding surplusing of the property per Section 54221 of the
Government Code. The City of Orange Fire, Police, Water, Public Works, and Community
Services Departments have all been notified and the respective directors declined any interest in
obtaining the property.
Upon the adoption of Resolution No. 11049, staff will initiate the process determining the fair
market value of the property and offering it for sale.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE FINDING THAT
CERTAIN CITY -OWNED REAL PROPERTY
LOCATED AT 4537 W. TILLER AVENUE, ALSO
KNOWN AS WATER WELL SITE NO. 3, IN THE
CITY OF ORANGE IS SURPLUS TO THE CITY'S
NEEDS AND AUTHORIZING THE DISPOSAL OF
SAID PROPERTY.
WHEREAS, the City of Orange (the "City ") is a municipal corporation exercising
governmental functions and powers, organized and existing under the laws of the State of
California; and
WHEREAS, the City owns property, which consists of approximately 1,500 square
feet and commonly known as 4537 W. Tiller Avenue, also known as Water Well Site No. 3
(the "Property"); and
WHEREAS, as authorized by California Government Code Section 37350, the City
Council finds and determines that the Property is not needed for the purpose for which it was
acquired or for any other public purpose and is, therefore, surplus real property; and
WHEREAS, pursuant Section 65402 of the California Government Code, the City
Council finds and determines that the location, purpose and extent of the proposed
disposition of the Property, have been considered and reported on by the Director of the
Community Development Department of the City and that said proposed disposition to the
Buyer in accordance with the terms and provisions of the Purchase Agreement conforms to
the City's adopted general plan; and
WHEREAS, this City Council, as the "lead agency" under the California
Environmental Quality Act ( "CEQA "), finds and determines that the sale of the Property is
categorically exempt from the provisions of CEQA under Section 15312 of the State CEQA
Guidelines relating to the sale of surplus government property; and
WHEREAS, the City Council believes that the sale of the Property is to the common
benefit of the City and its residents, and in accord with the public purposes and provisions of
applicable State and local law requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
resolves, on the basis of the facts set forth in the agenda report presented to it and any
testimony received at the meeting at which this matter was considered, as follows:
