Cambridge St. - We limited parking on our street due to the bike lane so we have them park on Almond Ave. Will this impact the Almond parking by eliminating that parking spot now? Waverly St. I just purchased my home a year 'ago on Waverly and I have 4 cars so this affects me. 3 of the cars are there, if I leave my home now and comeback I can't parkin front of my house, so it does affect me a lot. I'm in favor of the permit parking. Chairman Beil - What are your thoughts on the alternative proposal of 1 Hour Parking? Sharon Young, 182 S. Waverly St. The only problem with 1 -Hour Parking is the people come and go but the minute you leave your house you won't be able to park there again, some days are worse than others but almost on a daily basis except for street sweeping day you can't park on our street. Chapman Ave. I'm the director at Family Preservation Community Services, we are a non - profit, community based program, and we serve the children and families of Orange County. We relocated here from Anaheim in July 2013 and I apologize for the inconvenience we are placing on the neighbors but we want to be in a more centralized location in order to closer to the families we serve. We have always worked in the community and my staff appreciates the safe neighborhood. We specifically chose this neighborhood with its mix of residential and commercial. When we first moved in we went door -to -door and introduced ourselves and let them know about our program and we also modified our meeting times. We now meet every other Wednesday after the doctor's office has closed so we can utilize the whole parking lot, and it's every other week. We have talked to some of our neighbors whenever we have seen them outside and basically the message we have received is that they don't want us parking here. We want to know that what we do and what we can do to make this work. The efforts we have made have not satisfied the neighbors and we would like to request that you consider changing the "1 Hour" parking to something more reasonable to our business such as either 2 or 3 Hour parking restriction. Most of our appointment last more than an hour they could be with us for 21/2 hours. We have staff that come in to do paperwork, consultations but primarily they are perform their work outside our office environment but it's important that they have the opportunity to consult with their team members and to be here. This area of Orange is zoned for residential- commercial, we don't want to inconvenience anyone at all but we need to come to the office periodically. Chairman Beil — Your business is located at 942 E. Chapman Ave. but that's actually the business fronting Waverly? Bertie Chawla, 942 E. Chapman Ave. — I'm one of the owners of 942 E. Chapman Ave. building. We acknowledge that Waverly St. is being used for public parking by businesses and the residents on the street. We understand their concerns and we hope to alleviate them but we want a fair solution. We believe that 1 -Hour parking limit proposed by the staff may negatively impact the businesses along that street. We are all small businesses with limited parking and we need that. space. As the staff study indicates the majority of the time between 8 am and 5 pm there is some parking available. There are some times where is very limited parking available but that's very limited between maybe 10 am to 1 pm during the day. The residents have their own driveways and a garage so this area is not downtown Orange or the University area. Potential buyers will be concerned when they see that parking sign up there. If this proposal is implemented the residents and their guests will likely get a' citation once in a while this is bound to happen. The State Department negatively affects the ability of operating this small businesses include the doctor's office fronting on Waverly and it's patients, Family Preservation Center these businesses provide a vital much- needed service to the community. These businesses are a valued part of the community. If the Commission approves No Parking for business on Waverly then the financial liability of these businesses are threatened. The medical office that fronts Chapman Ave. are the most aggressive users of Waverly St. but as I understand the Commission has approved additional parking on Water St. and therefore those people can now park on Water St. instead of Waverly St. and thus alleviating the pressure on Waverly St., is that correct? Chairman Beil - Yes. Bertie Chawla, 942 E. Chapman Ave. - I urge the staff and Commission to reconsider the 1 -Hour parking limit as a matter of compromise and fairness we will support a 2 -3 Hour parking limit on that street, we will be happy with that. We believe this will alleviate the concerns of the residents and accommodate the reasonable needs of the businesses on Waverly St. neighborhood. I have had my business here in 1999, I love the character and the charm of the City and I wish to stay in the City for many more years. Chairman Beil - So you're one of the owners of 942 E. Erica Kirkpatrick, 138 S Waverly St. - I'm in the home right next door to the business at 942 E. Chapman Ave. I have several concerns, one of them is safety. I have two children 6 & 9. Daily there are cars coming up into my driveway to turn around and my children play in the driveway and front yard and there are always all these cars around. There are people parked on the street all day with people just sitting in them, I don't know what they are there for, I assume they are going to one of the businesses but I can't be sure. It's inconvenient, numerous times there are people pulling my trash cans off the street and putting them up in the yard so they can park there, I don't have one spot for myself or my guests, ever. If my family outgrows its home my family would move. If the businesses can't respectfully accommodate parking for their patients or customers then perhaps they have outgrown their facility and need to look for a new location with parking. This is a depreciation of home values in the area, if I were in the market for a new home and I drove down that street I would turn around and never come back, the parking would be a deal breaker. 1 Hour parking won't solve it in my opinion because there are so many people idling, stopping, waiting, looking for cars to leave, and causing more traffic. I'm curious how they would watch the street every hour and how they are going to patrol it. Our street doesn't have charm and character anymore, it's gone. Pamela Kaa, 144 S. Waverly St. Some of the problems is that it's not safe, people are constantly coming and going or hanging around. We don't know if the man sitting in his car works for the business or if he's just scoping out the block. Our once quaint, quiet street is now loud with people talking on phones and car alarms going off. It's dirty, people leave their trash behind when they come and have their lunch they don't live on the street so they don't care. It's unsafe driving and I can't fee oncoming traffic when I'm trying to get out of my driveway. We have a speeding problem so that makes it even harder. On trash collection day I have received many notes and been warned by my trash man saying that he won't be able to pick up my cans because the cars are parked so close to them that he can't get out and get to them every time. There's difficulty when the gardener comes or when I have guests over. Our street is the last street in the Historic District, it's not a commercial business location but it looks that way, it's ugly and looks horrible. The home values have gone down. I've taken pictures for 15 consecutive days at the same time in the morning and there are 25 -26 cars every day, these are not all the residents, these are all people that come from wherever and park (leaves a set of the photographs). I'm not interested in the 1 Hour Parking Bruce Morrison, 152 S. Waverly St - I am not in favor of the Permit Parking program it's going to be a cat and mouse game with the Police Dept. and for them to enforce it they are going to have to come out and mark tires and come back another time to issue tickets. With the standard permit parking program they only have to come out once and anybody who doesn't have a permit will get a ticket. I have a picture here of how courteous some of those people are. I was able to get my work truck back in the driveway but I wasn't able to get my everyday drive - around car, it's a low profile car and there's no way to get it out. I called the Police, this car was parked here for 3 hours and the Police never responded. Water St. has painted out that entire red curb and there's room for about 30 cars if they would just walk a little bit further it would be fine. I think permit parking is the solution. Marla LanFranco, 167 S. Waverly St. - I have moved in to my parent's home to help my mother with my 95 year old father, they have their own vehicles and now that I have moved in I have to park in the driveway. There are numerous times I have barely been able to get out of the driveway to take my dad to his doctor's appointments. If there are two cars parked in front of our house they extend into the driveway and I do not want to wreck my car, I do not want to have to worry about getting my dad to the hospital because I'm blocked in. He's lived there 75 years and this is his home and we would like to keep the integrity of our property. We would like to have the parking permit program, not the 1 Hour parking because when one car moves the other one moves in, and T still have the issue of trying to get out of the driveway. Shaun Field, 192 S. Wavelry_St. - I live on the corner of Almond Ave. and Waverly so I also have the issue of concern with if we put the permit parking on Waverly St. which I am in favor of, I am concerned that people are now going to park on Almond Ave. where I barely have enough room for my family to park in front of our house. That is a concern, where we are taking one problem and just pushing into another place. I would like to see them have enough parking somewhere dedicated to them so this doesn't impact other residents. My other comment is that I don't understand why a business would be allowed to have so little parking when obviously they know they need more. Corky Crochow, 136 S. Waverly St. - I have a long driveway and my house is to the rear. I have been over and knocked on their door 3 times and advised them they need to move their car or I'm going to back into it or I will call the Police because when they park they park so the front or back of their cars inch into the driveway approach, there's no way you can get through. The thing that concerns me more than anything else is if we have an emergency where we need emergency vehicles, they can't get in there, there's no room. If the trash truck is going by no other traffic can go through. Just go out there on trash day and watch, that poor man, one of these days he just not going to pick up trash and that's really bad. We should have permit parking and permit parking only and that will solve part of our problem anyway. Harwood St. - We own two homes in the 100 block of S. Waverly St., the residents of those homes are my mother and our son and his family. I worked on two committees with city staff that included Bernie Dennis to address business impacted parking issues in Old Towne. I worked with the O C Register where for my last 22 years I was responsible for all of our properties. I worked with numerous city officials in meeting their expectations of the newspaper as it respected employee and customer parking requirements, requirements that were an integral part of the process that we had to complete with in order to obtain new and renew various construction permits and business licenses. Parking was a big issue for those cities. I believe that providing for employee and customer parking needs at their business locations and not on nearby residential street was a requirement of the City of Orange when a business applied for construction permits or business licenses. But that evidently is not the case. That lack of reasonable requirement in Orange is what has driven we and fellow homeowner's to apply for parking permit system on S Waverly St., the same type of permit parking that exists on the 200 block of N. Orange St. where we own 3 homes, and the 300 block of N. Harwood where we own two. Permit parking which the city approved as a mitigation measure to address downtown business and Chapman University caused parking problems and I would add approved at no cost to us or other homeowners on either of those streets. ' My wife and I was part of the ownership group that opened the Citrus City Grille and the application process for our building permit and business license we would not have been granted those city approvals where it not for the fact that we could substantiate we had sufficient off- street parking behind the restaurant for our customers and employees. If our applications had included like a request for the City to simply change the parking signage on nearby residential streets east, west and north of the restaurant to accommodate 1 Hours parking for our employees and customers we would not have been granted the requested permits and licenses. Why then would the city approve 1 Hour parking on a residential street to accommodate the needs of businesses at 942, 1036 and other addressed businesses on E. Chapman Ave. Businesses which have been granted building permits and or business licenses when they cannot or will not meet what should be reasonable expectations for the city permit process. Scott Stegner, 164 S. Waverly St. - We're very proud of our neighborhood. The camaraderie that we have on this street is unlike anything I have been on in any town anywhere. It reminds me of Mayberry, and it's changing every minute. These cars that back up on our street they don't simply take up our parking spaces they bring in traffic that it's such a mess you can't believe, it. ' It's my understanding that somebody applied for the lawyers partnership in one of these businesses. Did they disclose how many possible clients they might have on any given day and they realized they were over the parking limits and they were denied their permit. It bothers everybody on the street how a building on our street has a Chapman Ave. address. The number one thing for me is Old Towne Orange. The Old Towne Preservation Society if you have a house in Old Towne you are familiar with the restrictions and requirements put upon you to keep your house in line with their policies. These cars shouldn't be here we shouldn't have to fight for our own privacy; we shouldn't have to fight to maintain the peace and quiet that drove us to want to live here. Michael Ames, 133 S. Waverly St. — We're homeowners, we pay taxes, and we should be able to park on the street. These businesses on Chapman, he knew the building when he bought it, he know what parking was there. The doctor's have places they tell their employees to park on the street because they need their parking spaces for their customers. In addition to the permit parking we need speed humps. It's a freeway to get down from Chapman to Almond it's a nightmare. Forget the 1 Hour parking that's a given. I'm in business in Newport and Irvine and you can get around that stuff easy, it's gotta be no parking. Larry Kaa, 144 S. Waverly St. — I've heard the saying that it takes a village to raise a child. My primary concern is with all the cars on both sides of the street when the children are playing, they way they play, they're little kids and they run all over the place, they don't pay attention. Somebody is going to run out between two of these cars and we're going to have a tragedy. I've been a general contractor for over 40 years and I had my business when it was viable in Orange, like the other residents we were enchanted and fell in love with the community, not the business community. I have great respect for entrepreneurs, I've been one myself practically my whole career but I'm also familiar with parking regulations, zoning regulations, I know how strict the City is and the Old Towne Preservation Assoc. with their requirements if we want to add a mother -in -law apartment in the back of our house and increase the traffic we're not allowed to do that. I think these people should have been more familiar with the growth of their own company and what their expectations were for parking before they made the bad decision to move their business that has all these cars in a parking area that does not accommodate their customers or their personnel. You should approve a high -rise parking facility somewhere in town. Larry Kaplan, 940 E. Chapman Ave. — I occupy a small office building on the corner of Waverly St. and Chapman Ave. We do not have any signage on our building out of respect for the neighborhood so if anybody drives by and looks at us they see a nice little stone- front house. Our family has occupied this small building for 34 years. We have coexisted peacefully with the neighbors on Waverly St. for that entire period of time. In my opinion this problem did not arise until the non - profit business moved into the building at 942 Chapman Ave. relatively a short time ago. I am against a permit for the simple reason that if someone to make a quick stop by our business maybe make small deliveries and do not want to pull into a small parking lot this would be an inconvenience to them and interfere with our business. I have no objection a 1 Hour time parking sign that limits the parking on Waverly. What will happen whether you decide on a permit or a limited parking time will put tremendous pressure on our small lot and we will probably end up in a lawsuit .because the number of people that work at the site at 942 E. Chapman Ave. Either the landlord misrepresented how much parking he had or the tenant misrepresented how many employees they have. But there are other people that work at this site is just too great for this small site in the respect of parking. There will be a consequence to whatever decision is made. I suggest a study session between city representatives, homeowners and businesses and try to come up with an agreed upon solution. Dr. Montelongo, 932 E. Chapman Ave. When people refer to me as a business I get insulted, please don't refer to me as a business. I've been in this location since 1982 and this problem here arose about a year ago, prior to that we did not have a problem. I'm very happy to be here tonight and I'm totally in sympathy with my neighbors. I approached this problem with the landlord the first week that I saw the number of people moving into this facility. I was very concerned and I spoke with him and that very afternoon I was very rudely confronted. I've tried changing my hours of operation and I have a huge patient population that 1 am responsible for and that I take care of. My patients are in and out of my office within 45 minutes. In the past there have been very few instances when one of my patients has parked on the street and everything was okay. Only recently in the last year, I'd like to know how many employees are in this 942 building, obviously it's too many. I think the City of Orange has some responsibility for this as well. How does the parking work at your building? Dr. Montelongo; 932 E. Chapman Ave. — When I moved in it was just two buildings, Larry's and mine, and we had a common parking area. We have designated parking stalls that my patients honor, my people and staff honors, Larry's people honors, we have a common area and we made that very clear to the landlord that it is a common to be exclusively used and all the overflow goes onto Waverly. That is a major problem. Commissioner Lebeau — Up until the past year with the expansion of the offices at 942 you were adequately able to accommodate your patients? Dr. Montelongo, 932 E. Chapman Ave. - We never had any problems. Albert Arellares, 159 S. Waverly St. — It is an inconvenience for parking, especially for my neighbors. A lot of my neighbors are retired or are physically disabled they can't go to work. I work in LA and I see over there with parking especially in Long Beach, it's bumper to bumper all the way down the street. I grew up in Whittier, a same small town community like this, which is why I moved here, that small town community. Whittier caved in to businesses and parking is a big issue over there and I'm hoping Orange won't be the same. I oppose the 1 Hour parking; I would rather have the permits. Earlier today I drove down Citrus St., they have permit parking, and there were maybe 4 cars on that block. It does work. Chairman Beil closed the public hearing and returned the item to the Commission for further discussion and a motion. Chairman Beil This is an ever expanding problem in Orange we ran into the same issue along Glassell St. north of Walnut Ave. and that is an area that is kind of a mixed residential area that slowly evolved to allow smaller businesses in what used to be residential houses along there. Let's look at Waverly St, most of the lots except one guy on the street has a big lot, most of the lots are fairly narrow lots so you have very limited parking to start with. It's evident from what we have heard today there has been a big change there recently, I did hear some of the concerns about if the problem with move down to Cambridge and Almond? That's always a possibility, it's really hard to predict. Some of the other permit parking areas we have seen in past have had some of that, it's trying to find out how far people will go. On enforcement of the 1 Hour parking restriction there is a question how enforcement would work. I would say enforcement would be problematic, our law enforcement is stretched pretty thin, they have traffic enforcement officers, they will make rounds but essentially it's going to come down to responding the residents who begin complaining that there are people who are parking a lot longer and then it becomes an enforcement issue. I heard an idea about the businesses trying to come up with a solution of available parking. Available parking is very problematic anywhere in the Old Towne area, we're very under- parked and I don't think there is an option for available parking unless business owners work together and find lots elsewhere that they can lease and park employees. Commissioner King — How many of you people have a problem hearing the speakers from up here or at the podium? Nobody has problems. I have a big problem. I've been in this chamber for 34 years and it's that dome, it bounces around the sound. How many of you own more than one car? Move everyone. How many of you own more than 2 cars? How many of you own more than 3 cars, small number. 4 cars? One response. I don't want to pick on anybody but it's us. We have found the enemy and it's us. Cars are a hard problem all over Orange, Santa Ana, and Anaheim, everywhere, there's not enough parking. I don't know what we're going to do about it, I don't think anybody knows what we're going to do about it. The City was built long ago and Waverly St. at best you have 2 car garages. In the old days you had one. I don't know what's fair for everybody. They made a recommendation; all of you spoke to the idea of 1 Hour Parking and Permit Parking. All over the City we have a broken range of how people park. Commissioner Glasgow — How did the 1 Hour Parking come about with the Permit Parking? Is that something staff recommended? Amir Farahani, City Traffic Engineer — We looked at the survey we conducted and we noticed two of the days were the busiest and that is Monday and Wednesday. We realized there might be some kind of special events taking place on those days which is kind of all day long. Being the owner I deal with the leases of commercial property and we have to be very careful in our presentation to leasee's what type of parking capacity this facility has. It sounds like things are getting out of control just from one lease moving in It may not be the leasee's fault it may not be the owner's fault, it's a happenstance of circumstance I would say but the fact of the matter is that it's there and given the lot lines on the block here and the very narrow and I know how the garage and the driveways are situated there. If it's a small car it's not that bad, certainly during the Angel games it's almost impossible to try to exit out. You will notice the westerly exit is at the same time people are trying to merge on the freeway so right at the end of the line of cars where they are currently parking that is where we would try to exit out onto the street, at the same time cars are trying to quickly get onto the freeway, so that really provides the problem. Apparently there have been a couple of accidents that weren't reported. I doubt there is a written report or anything that went to the Traffic Commission when they were implemented. They were installed at a time when we did what is called red tip the driveway and we put in a short stretch of red curb to keep traffic from parking adjacent to a driveway. It's adjacent to 1141 which is Orange County Striping, I'm not aware of what business relationship you may have had with each other. Commissioner Lebeau — If the City were to paint 6 ft. of red curb adjacent to the subject driveway would thee still be enough space for one vehicle on either side of that driveway? Dave Allenbach, Transportation Anal Test — The area of green curb as it is now its 26 ft. length, we could probably get by with 18 ft. on an install so that area would be a usable parking space. We have not had any parking problems until the last 6 months to a year when new businesses have moved in to the other side of the street and then also Chapman Ave. itself. We put orange cones right on the edge of our driveway to try to eliminate a little bit of the parking over there. We've had our orange cones thrown back in the yard. It's become two 20 ft flat -bed trucks and two 20 ft. trailers which we pull out of the back yard. Our property starts up against the Metrolink station so we have plenty of room on our property to house our vehicles. We mobilize mostly to the jobs late at night and come in early in the morning and we have a hard maneuvering it doesn't matter how wide we turn because we've got cars parked on both sides of the street. We're afraid we are going to clip a car when we turn in. The reason we asked only for 6 ft. is to try to compromise with the other residents and businesses in the area because we didn't want to have the whole curb painted red in front of our building and to the south side of our building. I think with the 6 ft. then we could have another car parked on the south side of our driveway and then there is still adequate parking on the north side of our driveway. That was kind of a compromise. We know the standard is 10 ft. The other reason we only asked for 6 ft. is for enforcement there would be no impact to law enforcement trying to enforce this 6 ft. red curb. I think most people would oblige the red curb they are pretty good with the 1 -Hour parking that has been placed there since the kitchen design' company moved in and the dentist moved in to the south side of the street. I took a picture to give you an example of what we are talking about regarding the obstruction of our driveways. We're only asking for the same consideration at that afforded to Orange County Striping who have red curb at their driveways. The alarm company that moved in always disregards that they are blocking our driveways, even when we has asked them not to. We have the same problem as others regarding trash pick -up, we put our cans out on Monday and other people pick them up and put them on the parkway and then they park in that space and so our trash doesn't get picked up. I'm not sure when Dave did his traffic counts because traffic and speed has increased dramatically on that street. We have Metrolink parking lot even though they a parking lot, but they also park on Pixley because they don't like the congestion in that parking lot. Kristi Stelle - Twice a year we demobilize from a project and re -tool our equipment and then we remobilize to another project. We may have moved the trucks out in order to move excess material out of the way. Normally we are on a jobsite about 6 months at a time. It's not to block people from parking there it's for us to rearrange vehicles to get ready to remobilize to another project for Caltrans. Commissioner Lebeau - I agree with your concerns Mr. Vice Chairman the reduction of the width of the red zones so that one space on either side of the driveway is preserved and the neighbors don't try to park 2 cars when 2 cars don't belong is an appropriate response.
