Resolution No. 11045 — A Resolution of the City Council of the City of Orange temporarily closing
West Palm Avenue between North Cypress Street and North Lemon Street every Saturday
7:00 a.m. to 2:00 p.m., starting January 6, 2018, continuing weekly as a condition of the Temporary
Use Permit for the Orange Home Grown Farmers and Artisans Market.
2. SUMMARY
With the pending construction of the Villa Park Orchard student housing project, the Orange Home
Grown Farmers and Artisans Market (OHG) has been looking in earnest for an alternative site for
the market. OHG has applied for a Temporary Use Permit (TUP) that is being reviewed by the
Zoning Administrator to hold the market in the Chapman parking lot adjacent to the former Time
Warner building at the NW corner of Palm and Lemon as well as the northern portion of the Film
School parking lot across the street. The site meets almost all of their needs except it is too small
to accommodate the current size of the market. Therefore, OHG is seeking permission from the
City to close one block of Palm Ave. between Lemon and Cypress streets each week for the
market.
3. RECOMMENDED ACTION
Approve Resolution 11045.
4. FISCAL IMPACT
Upon approval of the recommended street closure, and approval by the Zoning Administrator of
the requested TUP, staff anticipates presenting an agreement between the City and OHG at the
December City Council meeting outlining a recommendation for OHG to reimburse the City for
direct costs associated with the closure. Direct staff costs are estimated at $258 per week. The
City's estimated fully burdened cost to close the street each week is $760.

17. DISCUSSION and BACKGROUND I
Background
City staff have been working with Megan Penn, Executive Director for Orange Home Grown Farmers
and Artisans Market (OHG) to find a new location for the local farmers market. OHG's current
location, 304 N. Cypress Street, home of the Villa Park Orchards Packing House, is being
redeveloped into student housing by the property owner, Chapman University (Chapman). OHG
has been notified by Chapman that their last market in the current location will be Saturday,
December 16. To that end, OHG is seeking a new location starting January 6, 2018.
Several new locations have been considered and investigated. Key elements evaluated include the
appropriate amount of space for all elements of the market, good circulation, good visibility,
appropriate access and parking, minimal resident and business impacts, and overall safety.
Preliminary discussion and reviews have included Community Development, Community
Services, Fire, Police and Public Works Departments.
Discussion
OHG submitted an application for a Temporary Use Permit (TUP) to relocate the market just east
of their current location, utilizing Chapman's Becket Building (formerly Time Warner Cable)
parking lot, W. Palm Ave. between Cypress St. and Lemon St. and the north parking area of
Chapman's Dodge Film School. OHG's Letter of Justification, which includes a draft market
layout map, is attached for reference.
The proposed market outline requires a City street closure of W. Palm Ave., between Cypress St.
and Lemon St., every Saturday from 7:00 a.m. to 2:00 p.m. In evaluating multiple street closure
options, this portion of W. Palm, with both sides being Chapman's property, is the optimal closure

option. The closure would be executed each week consistent with a staff approved Traffic
Management Plan. Upon approval of the recommended closure, the permanent street signs on W.
Palm, between Lemon and Cypress will be updated to include no parking every Saturday, starting
at Midnight (12:00 a.m.), through Saturday at 2:00 p.m.
The City's annual fully burdened rate for all staff and equipment is estimated at $38,000 ($760 per
week). Consistent with past practice of charging Orange non - profit organizations (i.e., Street Fair
and Rotary Car Show) only direct staffing costs, staff anticipates recommending this same practice
for OHG. The estimated annual direct staffing costs only is $13,000 ($258 per week). OHG has
included in their Letter of Justification (copy attached) a request for additional financial support,
asking the City to reduce their street closure costs from $258 per week, to $150 per week, for an
annual OHG cost of $7,500. Upon approval of the recommended street closure, and approval by
the Zoning Administrator of the requested TUP, staff anticipates presenting an agreement between
the City and OHG at the December 12 City Council meeting that includes the provision for OHG
to reimburse the full direct costs associated with the closure.
An approved TUP will provide for OHG to occupy the new site for a period of up to 12 months,
with the opportunity to request an additional 12 -month extension provided the market operations
operate in compliance with conditions of approval and do not result in unanticipated impacts on
the surrounding area. Staff will continue to work with OHG to ensure the temporary location works
sufficiently, with minimal impacts to local residents and businesses, as well as, continue to work
with OHG to find a more permanent location. Upon approval, the W. Palm street closure will begin
January 6, 2018 and continue weekly, as long as a valid TUP is in place for OHG.

CYPRESS STREET AND NORTH LEMON STREET
EVERY SATURDAY, 7 A.M. TO 2 P.M., STARTING

CONDITION OF THE TEMPORARY USE PERMIT
FOR THE ORANGE HOME GROWN FARMERS
AND ARTISANS MARKET.
WHEREAS, Vehicle Code Section 21100 and OMC 12.58.015 (B) authorizes cities to
close portions of streets for celebrations and local special events when, in the opinion of the City
Council, the closing is necessary for the safety and protection of persons who are to use the portion
of the street during the temporary closing; and
WHEREAS, Orange Hoene Grown Farmers and Artisans Market has requested a
temporary closure of West Palm Avenue between North Cypress Street and North Lemon Street
every Saturday, from 7:00 a.m. to 2:00 p.m.; and
WHEREAS, Orange Home Grown has agreed to comply with the regulations governing
celebrations in public places, that alcoholic beverages on public streets are a violation of the law;
and
WHEREAS, Orange Home Grown will enter into an agreement with the City to provide
for the street closure traffic control; and
WHEREAS, Orange Home Grown will also notify area residents and businesses of the
event and temporary street closure in accordance with the Police Department's directions.
NOW, THEREFORE, by the City Council of the City of Orange, does resolve as follows:
That a portion of West Palm Avenue between North Cypress Street and North Lemon
Street, be closed from 7:00 a.m. to 2:00 p.m. on Saturdays, starting January 6, 2018.
