Resolution No. 11033 — A Resolution of the City Council of the City of Orange authorizing the
disposal of surplus property know as Old Chapman Avenue.
2. SUMMARY
Adoption of Resolution No. 11033 will operate to cause a certain portion of City owned, vacant,
real property known as Old Chapman Avenue, located north of Chapman Avenue and east of
Cliffway Drive to be surplus to the City's needs and declares it available for disposal. This is a
companion report for Agenda Item 3.29 that removes this portion of Old Chapman Avenue from
the City Street System.

Adopt Resolution No. 11033.

7. BACKGROUND AND DISCUSSION
This portion of Old Chapman Avenue was put out of service when the County of Orange
realigned and enlarged Chapman Avenue over the Chapman Grade in 1970. At the time, this
parcel was owned by the County of Orange. The City of Orange acquired ownership of the parcel
when the area was annexed to the City in 1976 (Annexation 311, Resolution 4438). The unused
roadway is a dead end road and has fallen into disrepair. The parcel is 8,426 square feet in size
and the topography is a steep hillside. The property is not buildable as it is only 30 feet wide. The
parcel has been a continuing problem for the police and is also used for illegal dumping.
Upon the adoption of Resolution No. 11033, staff will initiate the process of offering the property
to other agencies and non - profit groups as required by Section 54220 et seq. Upon their decline
or interest to acquire the property or expiration of the offer to acquire the property (60 days
minimum), the City can then proceed to offer the property to the adjacent property owners.

RESOLUTION NO. 11033
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE FINDING THAT
CERTAIN CITY -OWNED REAL PROPERTY
LOCATED ON OLD CHAPMAN AVENUE IN THE
CITY OF ORANGE IS SURPLUS TO THE CITY'S
NEEDS AND AUTHORIZING THE DISPOSAL OF
SAID PROPERTY.
WHEREAS, the City of Orange (the "City ") is a municipal corporation exercising
governmental functions and powers, organized and existing under the laws of the State of
California; and
WHEREAS, the City owns property, which consists of approximately 8,426 square
feet and commonly known as a part of Old Chapman Ave. (the "Property"); and
WHEREAS, as authorized by California Government Code Section 37350, the City
Council finds and determines that the Property is not needed for the purpose for which it was
acquired or for any other public purpose and is, therefore, surplus real property; and
WHEREAS, in accordance with California Government Code Sections 54220 et seq.,
the City has extended written offers to sell the Property to certain public and private entities
described therein; and prior to disposing of the Property will consider and negotiate any
offers received from such entities for at least the time period required in said Sections 54220
et seq.; and
WHEREAS, pursuant Section 65402 of the California Government Code, the City
Council finds and determines that the location, purpose and extent of the proposed
disposition of the Property, have been considered and reported on by the Director of the
Community Development Department of the City and that said proposed disposition to the
Buyer in accordance with the terms and provisions of the Purchase Agreement conforms to
the City's adopted general plan; and
WHEREAS, this City Council, as the "lead agency" under the California
Environmental Quality Act ( "CEQA "), finds and determines that the sale of the Property is
categorically exempt from the provisions of CEQA under Section 15312 of the State CEQA
Guidelines relating to the sale of surplus government property; and
WHEREAS, the City Council believes that the sale of the Property is to the common
benefit of the City and its residents, and in accord with the public purposes and provisions of
applicable State and local law requirements.

4. REPORTS FROM MAYOR SMITH
Mayor Smith thanked the Orange Fire Department, Orange Police Department, and staff for their
great efforts during the Canyon 2 Fire. She also thanked the community for their generosity during
the mandatory evacuations.
Fire Chief Thomas gave a brief summary of the Canyon 2 Fire events.
5. REPORTS FROM COUNCILMEMBERS
Councilmember Alvarez briefed the Council on Anaheim's Operation Home S.A.F.E. and
distributed the resolution adopted by the City of Anaheim declaring a public health and safety state
of emergency. The resolution also outlines a 15 point plan to address homelessness.
